Network Politics,Political Capital,and Democracy

Abstract

Is network politics a good or a bad thing for democracy? Seen from a narrow perspective of democracy the answer is clear. It is a bad thing. However, seen from broader perpsective the answer is more complex since it does not only focus on the preservation of representative democracy but also on the promotion of organizational democracy in civil society and on the enhancement of the citizens' political capital, that is their endowment, empowerment and political identity. The complexity of the relationship between democracy and network politics is apparent in a case study of political decision making in Skanderborg, a small town in Denmark.     

Avoiding the internet of insecure industrial things

Security incidents such as targeted distributed denial of service (DDoS) attacks on power grids and hacking of factory industrial control systems (ICS) are on the increase. This paper unpacks where emerging security risks lie for the industrial internet of things, drawing on both technical and regulatory perspectives. Legal changes are being ushered by the European Union (EU) Network and Information Security (NIS) Directive 2016 and the General Data Protection Regulation 2016 (GDPR) (both to be enforced from May 2018). We use the case study of the emergent smart energy supply chain to frame, scope out and consolidate the breadth of security concerns at play, and the regulatory responses. We argue the industrial IoT brings four security concerns to the fore, namely: appreciating the shift from offline to online infrastructure; managing temporal dimensions of security; addressing the implementation gap for best practice; and engaging with infrastructural complexity. Our goal is to surface risks and foster dialogue to avoid the emergence of an Internet of Insecure Industrial Things.     

地方政府网络治理稳定性影响因素研究

网络治理理论以其整合政府、市场和公民社会的理念而引起越来越多公共管理研究者的兴趣,如何使其顺畅运行,取得稳定的运行状态成为公共管理领域亟待解决的问题。本文对地方政府网络治理及稳定性的概念进行了界定和分析,识别了资源依赖、关系质量、稳定性3个变量,进而提出资源依赖、关系质量、稳定性变量间影响关系的假设,最终形成地方政府网络治理稳定性影响因素概念模型。在调研访谈的基础上,对西安、南京、深圳等地政府部门进行问卷调查,通过SEM分析,结果表明,资源依赖对稳定性具有显著的正向影响关系,同时资源依赖还分别对关系质量具有显著的正向影响关系。关系质量中的信任和沟通也分别对稳定性具有显著的正向影响关系,而承诺对稳定性的直接影响不显著。据此,在地方政府网络治理过程中,需要对主体间的分工进行明确,注重治理主体资源与能力互补的重要性,重视关系质量的维护。     

网络服务合同中不平等条款的类型及其法律规制——以虚拟财产权的保护为视角

网络服务合同是确立网络运营商与用户双方权利义务的协议,是用户行使及保护其虚拟财产权的重要依托。实务中由于网络服务合同缺乏完善的法律规范,导致其中存在大量不公平的争议条款,当法律纠纷出现时,严重不利于用户对其虚拟财产权的保护与行使。如何在法律上对网络服务合同进行规制以及在司法实践中如何认定部分争议类型条款的有效性将是保护网络虚拟财产的重中之重。正基于此,在分析网络服务合同与虚拟财产权保护的主要矛盾,探讨网络服务合同中部分争议类型条款之后,对网络服务合同的法律规范提出相关建议。     

数字治理下的“风险压力-组织协同”逻辑与领导注意力分配——以A市“市长信箱”为例

大量的信件诉求进入“市长信箱”,为什么有的得到领导批示,有的则没有?基于A市“市长信箱”探究领导注意力的影响因素,研究发现,上级政府强调的“一票否决”事项是地方领导在回应性政府活动中注意力的指挥棒,组织协同目标也通过领导注意力的选择性分配得到实现,领导注意力在科层运行中呈现出“风险压力-组织协同”逻辑,即符合“一票否决”事项的信件、需跨部门协作解决的信件诉求更可能获得情感强度越高的领导批示,且“一票否决”的风险逻辑优先于组织协同的“协同”逻辑。论文的研究价值不仅在于从“注意力分配”的视角探究互联网政治体系中的政府行为,还揭示了数字治理具有政治性与技术性二重属性的事实。

人类社会已经步入信息时代。互联网络对国际社会带来巨大冲击 ,各国为了维护“信息主权” ,加大了对“软国力”的追求。网络战是信息时代的重要产物 ,它的出现和发展同样对国际政治产生重要影响     

19世纪初至20世纪初的仰光华侨社会

中国人移居缅甸历史悠久,尤其在19世纪初至20世纪初,华侨不断地涌入缅甸,缅甸华侨社会由此发生了巨大的变化。这一时期仰光华侨社会的变化与19世纪缅甸社会历史的发展进程,特别是三次英缅战争（1824～1826年,1852年、1885年）有着密切的关联。在这一时期,仰光华侨社会随着缅甸社会的变化而变化,诸如华侨的籍贯构成、经济活动、人口分布、社会组织关系等。在移民与贸易的互动作用下,这一时期仰光华侨网络逐渐形成并成为缅甸华侨网络最重要的组成部分。     

Registration Data Access Protocol (RDAP) for digital forensic investigators

This paper describes the Registration Data Access Protocol (RDAP) with a focus on relevance to digital forensic investigators. RDAP was developed as the successor to the aging WHOIS system and is intended to eventually replace WHOIS as the authoritative source for registration information on IP addresses, Domain Names, Autonomous Systems, and more. RDAP uses a RESTful interface over HTTP and introduces a number of new features related to security, internationalization, and standardized query/response definitions. It is important for digital forensic investigators to become familiar with RDAP as it will play an increasingly important role in Internet investigations requiring the search and collection of registration data as evidence.     

论网络虚拟财产的性质及其刑法规制

随着信息技术的不断发展,“网络虚拟财产”已与现实的生活建立起越来越紧密的联系。随着网络行业行为的规范化和网络技术的飞快发展,许多公民在这个虚拟世界生活、工作和游戏,一个巨大的新兴产业已经形成,同时暴露出的关于网络虚拟财产的矛盾也越来越激化。如何保护网络虚拟财产在法律上还是一个盲点;由此导致的社会问题也随之而来。本文通过对网络虚拟财产的性质进行一系列分析,然后对网络虚拟财产进行刑法上的分析讨论,并对如何规制网络虚拟财产进行刑法上的论述,本文能对虚拟财产的立法完善起到参考作用。     

“网络招嫖”现状分析及防治对策

近年来,一些违法犯罪人员利用网络进行招嫖活动,并逐年呈现高增长和蔓延趋势,严重影响了社会和谐,败坏了社会风气。为此,社会各方面必须统一认识,形成合力,采取有效措施对“网络招嫖’’违法活动进行综合治理：加强对互联网的监控和管理;进一步加强网络文化建设;加大对“网络招嫖”的打击力度;运用综合治理健全长效管理机制。
