工会转型期需要注意把握的几个关系

要正确认识工会转型和社会转型的关系,要正确认识工会转型与国际工会的关系,要充分认识到工会转型期也是工会发展的重要机遇。     

Globalisation

The term ‘globalisation’ is widely used to describe a variety of economic, cultural, social, and political changes that have shaped the world over the past 50-odd years. Because it is a complex and multifaceted phenomenon, globalisation has been credited with a wide range of powers and effects. Its proponents claim that it is both ‘natural’ and an inevitable outcome of technological progress, and creates positive economic and political convergences. Critics argue that globalisation is hegemonic and antagonistic to local and national economies. This article argues that globalisation is a form of capitalist expansion that entails the integration of local and national economies into a global, unregulated market economy. Although economic in its structure, globalisation is equally a political phenomenon, shaped by negotiations and interactions between institutions of transnational capital, nation states, and international institutions. Its main driving forces are institutions of global capitalism – especially transnational corporations – but it also needs the firm hand of states to create enabling environments for it to take root. Globalisation is always accompanied by liberal democracy, which facilitates the establishment of a neo-liberal state and policies that permit globalisation to flourish. The article discusses the relationship between globalisation and development and points out that some of the most common assumptions promoted by its proponents are contradictory to the reality of globalisation; and that globalisation is resisted by more than half of the globe's population because it is not capable of delivering on its promises of economic well being and progress for all.     

创设利益制度是社会和谐的法治基础——和谐社会利益关系问题的法学思考

利益矛盾和冲突不仅是社会转型期国家的显著特征,同时,也是形成不受以往制度约束的和谐环境的重要前提。本文以分析和谐社会利益制度的法律根源作为出发点,在此基础上从利益博弈的机理层面上探寻利益制度形成的逻辑起点和实体条件,以及政府如何在利益群体博弈过程中作出创新性的实验安排,进而为在我国社会转型过程中,形成社会和谐与经济发展的基础性力量,以及进一步提高政府执政合法性的问题提供必要的实践依据和理论支持。     

缅甸当前政治经济观察

当前缅甸的政治、经济局势值得深入观察.制订新宪法是缅甸 "民主路线图"七步计划的第一步.经过将近9个月的休会之后,旨在为缅甸新宪法制订架构的新一轮国民大会于2006年10月10日复会,这有力地推动了缅甸民主路线图计划的实施.但是,美国的打压有可能导致缅甸军政府放缓民主改革的进程. 尽管如此,在"先经济,后政治"方针的指引下,缅甸政府凭借丰富的自然资源,借助中国的经验,开展经济改革工作.     

从旭普林公司案看我国法院对国际商事仲裁的监督

运用国际商事仲裁的一般理论和国际商事仲裁立法与实践,结合我国法院就国际商会国际仲裁院仲裁庭根据该院仲裁规则就德国旭普林公司案在我国上海作出的仲裁裁决所实施的司法监督,探讨了国际商事仲裁裁决与涉外裁决、外国裁决和《纽约公约》项下的非本国裁决之间的联系与区别。由此认为本案项下的裁决,既不是我国裁决,也不是外国裁决,而是《纽约公约》项下的非内(本)国裁决。     

论江泽民新安全观的辩证思维及实践问题

江泽民提出的新安全观 ,从背景看是对冷战思维的否定 ,从内容看是对传统安全观的发展 ,从结构看是辩证统一的有机整体 ,从实践看它不仅符合中国国家安全利益 ,也符合世界各国国家安全利益 ,反映了冷战后世界发展的大趋势。特别是在霸权主义有新的表现、恐怖主义危害上升、影响和平与发展的不确定因素在增加的情况下 ,江泽民新安全观越来越受到大多数国家的赞赏和欢迎。     

刑法主观主义之生成根基

刑法主观主义生成的根本推动力是经济因素。经济结构的变迁引起社会结构的变迁,而伴随社会结构的变迁,犯罪必然呈现出新特征,最终导致刑事犯罪治理策略取向由个人本位转向社会本位,从而导致刑法主观主义生成并渐趋强势。刑法主观主义并非只是为了作为客观主义的对立面而生成,而是对时代变迁的必然回应,是时代的必然产物。     

From newspapers to social media? Changing dynamics in Swiss direct democratic campaigns

Switzerland is a laggard in terms of digital campaigning. Direct democratic votes, more particularly, are centered around issues and little personalized. Combined with the specificities of voters’ information behaviour in direct democratic campaigns, these features are likely to disincentivize political actors from extensively campaigning online. Instead, we expect political actors to continue relying on traditional media. These propositions are tested on a large data base of social media posts and newspaper advertisements published before direct democratic votes held in Switzerland from 1981 to 2020 and 2010 to 2020, respectively. Counterintuitively, this research note finds a strong discontinuity in campaign communication practices. Over the past decades, and between 2010 and 2020 in particular, newspaper ads have become less central to direct democratic campaign communication. At the same time, political actors are increasingly shifting their communication to the digital sphere.

20世纪初,美国文坛上升起了一颗璀璨之星,即女作家伊迪丝·华顿。她运用细腻的人物心理描写和精当的语言描绘了一幅“老纽约”贵族女性的生活蓝图,以独特的视角审视上流社会中女性的地位及其命运。本文在仔细研读华顿作品的基础上,分析其小说创作中的婚姻主题,认为她通过对这些贵族女性的生活际遇以及她们所处社会环境的错置现象的叙写,揭示出女性在父权制社会中的从属地位,进而窥视其反抗的声音以及日益增强的女性自我意识。     

Institutional Change in Swiss Cantons: A Contribution to Describing and Explaining Institutional Reforms

Most accounts of Swiss federal institutions are unable to explain institutional change. In this contribution the authors trace change in Cantonal reforms and then use multivariate explanation models to account for institutional reforms such as New Public Management reforms. The multivariate analyses used rely on an “event count model” to explain the frequency of institutional reforms and a “binary response model” to explain why Cantons adopt New Public Management reforms. This research demonstrates that policy research as well as innovation and diffusion theories can contribute to explaining institutional reform.
