刍议跨境制售假药案件的犯罪趋势和打防策略

随着电子商务、跨境汇付及物流寄送等相关领域服务的日趋完善,在不断推进全球贸易一体化的同时,也为跨国犯罪的滋生提供了温床。特别是在假药犯罪领域,不法分子利用各国监管政策差异较大、境外需求市场广阔等条件,跨境实施制售药品犯罪。因此,要从经侦实务出发,从信息流、物流、资金流等入手,结合侦办实践,剖析犯罪特点、蔓延成因,研判发展趋势,并从"打、防、管、控"角度,提出针对性策略。     

从英语演讲教学模式看英语语言技能之习得

把英语公共演讲内容融入大学英语课程是帮助学生获取英语语言技能的有效途径。论证了以英语演讲课堂为平台,将英语公共演讲教学模式与英语语言操练进行有机结合,使学生的英语语言技能、跨文化交际意识和逻辑思辨能力等都能得到循序渐进提高的可行性。     

政府整体绩效评价:理论假说及其实证检验——以2008年度广东省为例

政府绩效评价是公共管理及政府管理创新的前沿课题。作为一个全新的范畴,政府整体绩效评价具有典型的本土特色。社会主义历史条件下,我国地方政府整体绩效评价构成了民意表达的基本路径,具有民主导向与技术完善的双重功能。本文提出了政府整体绩效评价结果导向的理论假设,并依据既定的技术方案,基于独立第三方立场和公众满意度导向,利用2008年度针对广东省地方政府整体绩效评价及公众满意度调查的系统数据,检验理论假设的科学性与合理性。研究表明,我国地方政府整体绩效评价是公民对政府表现的综合评价,其过程承担民意表达的功能,其结果将成为民主政治发展和行政体制改革的内在动力。     

COLLABORATIVE PRACTICE IN THE CANADIAN LANDSCAPE

This article looks at the growth of collaborative practice in Canada in the last decade and the legal and Canadian cultural underpinnings influencing this growth. Government recognition of and support for collaborative process has come from both the federal and provincial governments. Statutory support in family law statutes and in ethical standards for lawyers encourage alternate dispute resolution and have helped normalize consensual dispute resolution options. The article also looks at decisions from Canadian courts relating to the practice of collaborative law, including the confidentiality of collaborative process negotiations as set out in the participation agreement and the standard of care necessary for collaborative lawyers.

情事变更原则适用的若干问题探析

情事变更原则在许多国家的立法中得到确认,但我国没有将其写进新《合同法》。情事变更原则适用的条件是:须发生情事变更的事实;须发生在合同成立后履行终止前;当事人所不能预见等。情事变更与不可抗力、商业风险是不同的概念不能混为一谈,明确规定情事变更原则不会导致法官权利滥用,且随着司法实践中对情事变更原则的需要,未来的立法应确立该原则。     

Hearing the Voice of the Child: Current Practice in Family Courts in Germany

German family courts have a long‐standing tradition of hearing the child's voice when proceedings affect the child. This article aims to provide an overview of the German procedural rules. The current role and practice of child hearings in family courts and the direct effects on the child are discussed in detail. The perceived benefits, challenges, and pitfalls are deliberated from the viewpoint of the psychological expert. Hearing the voice of the child in person is increasingly viewed as beneficial to the proceedings if the judges and other professionals involved possess the necessary qualifications and competence.     

Interdisciplinary Teamwork in Family Law Practice

For attorneys who engage in matrimonial practice, work is often performed by a sole practitioner. While members of other professions have already demonstrated that interdisciplinary practice and teamwork are integral to efficiency, client satisfaction, and career success, matrimonial attorneys are just beginning to work in deliberately constructed interdisciplinary teams. In this article, we examine the definition of teamwork and highlight the characteristics of an effective team, drawing examples from the business, medical, and mental health fields. We then determine how successful teams are built and explore the application of such approaches within matrimonial practice, offering recommendations for research and effective use of teams to help families that are facing conflict and reorganization.
