论法律规避制度在合同冲突法中的存废——从我国的司法实践展开

涉外合同司法审判中，法院在运用法律规避制度时出现了诸多问题，这些问题本质上是法律规避制度本身在合同冲突法领域无力实现其功能的表现。法律规避排除和惩罚当事人规避意图的功能与涉外合同法律选择中的盛行的意思自治原则相冲突，当事人的规避意图难以探究和证明。法律规避制度设计之始就给法院安排了不可能完成的任务。对于保证强制性规则适用的功能，法律规避制度亦难以有效实现。新兴的直接适用的法的理论则可以在涉外合同领域实现法律规避的功能的同时，克服法律规避制度适用中的实践性难题。     

农村已婚青年女性自杀现象研究——基于湖北省大冶市丰村的个案分析(1980-2000)

家庭结构及其变动和人们的死亡观念是理解农村已婚青年女性自杀的关键因素。婆媳关系和夫妻关系及两者变迁所呈现出来的双重失衡状态,使得处于劣势地位的已婚青年女性容易走上自杀之路。人们相信死后还有一个存在的世界,并认为在死后的这个世界中,能够看到对造成她们自杀死亡者的惩罚,因而,自杀成为已婚青年女性寻求救助的一种手段。在这两大因素背后,更为基础的社会实践推动了自杀的产生。社会实践现场中自杀后的一系列表达是构成农村已婚青年女性对自杀死亡后进行想象的现实基础。现实生活中这种社会实践的上演与习练,会通过女性意念的投射与模化映置到未来的自杀实践中。     

内幕交易犯罪客观要件的认定——以美国对证券内幕交易罪的相关规定为视角

伴随着中国民众投资理财观念的不断增强,证券交易已经成为我国国民经济中不可或缺的一种交易形式。其中,内幕交易、泄露内幕信息的行为日益频繁,且呈现出行为方式多样化、主体多元化的特征。最高人民法院、最高人民检察院于2012年5月出台了第一部专门针对内幕交易犯罪的司法解释。由此,结合美国关于证券内幕交易的相关理论、法规和案例,对《关于办理内幕交易、泄露内幕信息刑事案件应用法律若干规定的解释》中所涉及的关于内幕交易罪客观行为规定所存在的问题,提出相应的修改和完善建议。

'A Manual of Diplomacy': The Genesis of Satow's Guide to Diplomatic Practice

Often referred to as simply 'Satow', the Guide to Diplomatic Practice stands as a lasting monument to Satow's 'second career' as a scholar of international law and diplomacy. However, there was more to this phase in Satow's life than the Guide's two stout volumes. This article argues that in reconstructing the origins and genesis of this work, Satow's own conception of diplomacy as an historically evolved tool of international politics can be examined much more comprehensively than is possible on the basis on the current fifth edition of the Guide. Moreover, this examination will also offer further insights into the evolution of diplomatic studies as an academic discipline in the early twentieth century.     

Family Peacemaking with an Interdisciplinary Team: A Therapist's Perspective

Interdisciplinary teams provide an unparalleled opportunity for peacemaking in families within the consensual dispute resolution continuum. This interdisciplinary environment was born out of the integration of Collaborative Law, in which lawyers limit the scope of their services to settlement by way of a signed agreement, and Collaborative Divorce, a team approach to divorce services that includes a lawyer for each party along with a Collaborative Divorce Coach for each party, a neutral financial specialist, and a neutral child specialist. Taken together, Interdisciplinary Collaborative Practice supports the resolution of legal issues out of court as well as addressing any emotional, relational, or behavioral problems that create obstacles to the successful resolution of the separation process.
