The coalition's programme for government promises to fund 200 open postal primaries during the current Parliament, targeted at seats which have not changed hands for many years. The lessons from the two open postal primaries used in 2009 are that they will change the numbers and characteristics of those involved in choosing candidates, the criteria for selection and the type of candidates chosen. Much will remain unchanged. Primaries are unlikely to affect the controlling influence of party in the House. The limits to their number and duration will leave most safe seats unaffected and prevent the development of any new form of accountability. Primaries will provide some voters with intra‐party competition but inter‐party uncompetitiveness will remain the norm.

我国现行《民事诉讼法》将连带债务共同诉讼作为必要共同诉讼的情形之一,要求连带债务人必须共同进行诉讼。学术界和实务界一致认为,应将必要共同诉讼划分为固有必要共同诉讼与类似必要共同诉讼,并将连带债务共同诉讼理所当然地归入类似必要共同诉讼的范畴。从民事实体法与民事程序法的联结点上来考察,连带债务共同诉讼应属普通共同诉讼,而非类似必要共同诉讼。

在商事案件审理过程中判断是否构成表见代理时，需要考虑从安全与效率的商事活动价值博弈入手，对照民事表见代理与商事表见代理的区别，不能以被代理人过错作为表见代理的构成要件，而以审查被代理人行为与代理权外观是否具有关联性作为表见代理构成的事实基础。完成对这一关联性的审查之后，还应综合考量构成关联的各项客观事由是否足以引起善意第三人信赖的因素，以最终判断是否成立表见代理。     

The Mexican Presidential and Congressional Elections of 2000 and Democratic Transition

The article examines the presidential and congressional elections of July 2000 in Mexico. The elections brought to an end more than 70 years of single party government and the culmination of a gradual democratisation process stretching back at least a decade. The long term decline in the bases of support for the regime and the changing institutional rules for elections and parties are described by way of contextualising the campaign itself and its leading protagonists. While the new rules of the game guaranteed free and fair elections, issues of internal party democracy and negative, personality-based campaigning do not paint a universally rosy democratic picture. Analysis of the election results demonstrates how the opposition was able to move beyond its traditional geographic confines and challenge across the country. However, voters did not give an unambiguous victory to Vicente Fox; his alliance does not possess a majority in either house of congress. Divided government and developments in the party system are considered as two key issues that will shape Mexico's democratic future.
