犯罪人罪后情状分析能为侦查机关在划定侦查范围、追逃、阻止继续犯罪、获取证据、深挖余罪等方面开展有针对性的工作提供依据,对侦查工作意义重大。其存在的理论基础是犯罪心理学的三大变量系统理论,事实基础是犯罪人的犯罪行为和犯罪后所面临的环境,以及渗透到生活领域的各种社会监控手段。     

中国古代证据制度的思想基础及特点分析

以中华法系为代表的中国古代法制文明在世界法律史中占有重要地位,也是中国古代文明的体现。法律制度的设计必须与其所处的经济、社会制度与环境相适应．古代中国法律体现了这点．作为法律制度一部分、对于事实的认定、纠纷的解决具有重要影响的证据制度也是如此。中国古代证据制度在设计及实施过程中受到了古代哲学、伦理观念、心理学等因素的影响,同时也与当时的生产力水平相适应。中国古代证据制度具有与西方不同的特征。这与中国古代对人的重视、以儒家为主导的哲学观念、当时的生产力水平以及家法宗族的统治密切相关。     

A critical understanding of good governance and leadership concepts written in the context of the New Partnership for Africa's Development (NEPAD) and the challenges to contextual discourse on Africa's development paradigms1

ABSTRACT

Good governance is a value-laden concept that is characteristically nebulous; it can mean different things to different people, depending on the context in which it is used. The same applies to leadership. Concepts, as Pauw (1999a, 465) puts it, are ‘tools of thinking’ and contexts are ‘the environments or frameworks in which they [concepts] operate’. Lucidity in the meanings of concepts is fundamentally important for shaping debate and enriching discourses. To maintain their power, concepts must be used in their proper contexts. This necessitates an understanding of the art of contextual discourse. Good governance is used in NEPAD as a principle and emphasised as a sine qua non for sustainable development in Africa. On the other hand, NEPAD premises Africa's re-birth or Renaissance on good governance and leadership, with a vision and commitment to repositioning the continent in global power balances. In this article good governance and leadership are considered as concepts. NEPAD is a textual context within which the two key concepts are used and should, consequently, be engaged. The article attempts a critical review of African scholarship engagement with good governance and leadership within the NEPAD context to determine the extent to which contextual discourse is practised. It further grapples with the immediate historical background to scholarship on Africa's development between the 1960s and early 1990s. The exercise reveals that much of the accumulated body of African scholarship and scholarship on Africa's development reviewed does not suffciently contextualise discourse on good governance and leadership within NEPAD, and its key assessment and monitoring device, the African Peer Review Mechanism (APRM), and offers an alternative framework.

The Thai Royal Project Foundation Retail Stores： How and why the consumers buy？

The Royal Project, established in 1969, has responded to His Majesty＇s initiative to help the hill tribes in growing useful crops which enable them to have a better standard of living. In 1992, the Royal Project was transformed into Royal Project Foundation in order to become the public organization that can be operated efficiently as a private company. After that, the Royal Project Foundation Retail Stores or ＂Doi Kham＂ were set up to help distribute products and produces from the project and its members. However, the Royal Project Foundation Retail Stores are currently lacking of adequate marketing information to help management make the right and more aggressive decision. Therefore, this research was conducted in order to explore the consumers＇ behaviors and their reasons towards the purchase from ＂Doi Kham＂. Furthermore, consumer clustering and characteristics of each group are discovered. A survey of 341 current customers from 2 most crowded branches--Don Muang International Airport and Farmer Market in Bangkok--was done using self-administered questionnaire. The data obtained was then analyzed by using factor analysis, chi-square test, ANOVA and cluster analysis. The results show that majority of customers are women aged between 24-50 and having income more than 20,000 baht （around $606） a month. Most of them bought the Royal Project Foundation products from ＂Doi Kham＂ directly instead of the private-owned stores. More than one third of samples shop more than twice a month and spend moderately around 100 to 499 baht. The most popular products are temperate-climate vegetables, followed by agricultural processed food and temperate-climate fruits consecutively. Main reasons that the consumers buy the products are the product quality, standard labeling, helping welfare of farmers and hill tribesmen and brand credibility respectively. For marketing factors, the most important factor influencing the purchase is product quality and safety, followed by convenience of shopping, pricing, store service, store layout/displays and promotion consecutively. Three groups of clusters are obtained--＂traditional buyers＂, ＂service-oriented buyers＂ and ＂price-concerned buyers＂.     

刍议公安机关在收容遣送工作中的法律地位

收容遣送工作是保证社会稳定、经济正常发展的必要措施,也是维护社会秩序的管理手段.公安机关的收容行为属协助民政部门的行政协助行为,也属可诉的行政行为.公安机关在实行收容遣送时要切实注重程序上的操作,按规定的程序进行,真正体现严格、公正、文明执法.     

论对第三人实施强制侦查措施的限制

在侦查过程中，犯罪嫌疑人以外的任何第三人都有可能是强制侦查措施的对象，但对第三人实施强制侦查措施应当受法律上严格的实体及程序限制。我国现行法律对侦查机关对第三人实施强制侦查措施未作任何有别于犯罪嫌疑人的特别规定，而且第三人没有充分有效的救济途径。因此，必须在法律上对侦查机关启动对第三人的强制侦查措施设置严格的实体及程序限制，包括对第三人启动强制侦查措施必须有合理根据、必须符合比例原则，在执行强制侦查措施过程中侦查机关必须按照批准的范围执行，第三人在事后要享有充分有效的救济手段。
