法官非物质利益保障的价值基础与制度建构——以法官角色伦理为视角

本文从法官角色伦理分析出发,分析法官职业的本质,从法律的不确定性与法官角色伦理的博弈中引出法官的任职保障制度对于做好"法律世界中"法官的重要价值意义。文章从确保法官职业身份、树立法官职业尊荣、强化法官职业队伍三方面就法官非物质利益保障的若干问题进行探讨。

女性参政是提高妇女地位的一个重要方面,也是女性人才开发的重要途径,更是衡量一个国家社会发展和文明进步的重要标志之一。我国女性参政的发展已取得了一定的成绩,但女性参政、女性人才开发仍受到性别、政策歧视、自身意识等因素的影响。社会需要充分认识女性参政的重要性,优化女性参政的社会环境;女性自身需要强化自主意识,增强参政的信心;家庭要对女性参政给予支持;国家需要在政策上为女性参政提供保障,加大女性教育和培训力度,健全女性领导干部培养选拔体系。     

Articulating language oppression: colonialism,coloniality and the erasure of Tibet’s minority languages

ABSTRACT

Roche’s article discusses ‘language oppression’ as a form of domination that is coherent with other forms of oppression along the lines of ‘race’, nation, colour and ethnicity. Scholars have defined language oppression as the ‘enforcement of language loss by physical, mental, social and spiritual coercion’. It is part of an evolving suite of concepts from linguistics, sociolinguistics and linguistic anthropology that examines issues of language discrimination, or ‘linguicism’. Roche explores one aspect of linguicism—language erasure—and how it relates to language oppression, focusing on Tibetans in the People’s Republic of China (PRC). He examines how language oppression is produced through practices of erasure: the ways in which certain populations and their languages are systematically rendered discursively invisible. He argues that the erasure of certain languages in the Tibetan context is systematically reproduced by two otherwise opposed political projects: the colonial project of the PRC state; and the international Tibet movement that seeks to resist it. He refers to the contingent cooperation between these two opposed projects as ‘articulated oppression’. In concluding the article he examines how the disarticulation of this oppression is a necessary condition for the emancipation of Tibet’s minority languages, and discusses the broader significance of this study for understanding language oppression, and its relation to other forms of oppression.

Framing the fall of Sinjar: Kurdish media’s coverage of the Yazidi genocide

Abstract

In the early morning of 3 August 2014, Islamic State of Iraq and Syria (ISIS) attacked the Sinjar district in the vicinity of Mosul. The area was largely under the control of Kurdish forces at the time, especially those associated with the Kurdistan Democratic Party (KDP). Those forces could not defend the district and ISIS was able to take control of the area. Consequently, a considerable number of Yazidi people were killed or displaced, while female Yazidis were raped and kidnapped. This study, based on framing theory, attempts to explain how two major Kurdish media organizations, Rudaw, which is loyal to KDP, and the Kurdish News Network (KNN), which is loyal to the Gorran (Change) Movement, each covered the event in their news reports. By performing a content analysis of 222 news stories covering the event, the key finding of the research is that, in instances of assigning responsibility for the fall of Sinjar, political considerations are the determining factor in how the narrative was framed. Taken as part of a growing literature on media in Kurdistan, the research outlined in this article supports the conclusion that the framing of media coverage in the Kurdistan Region is subject to strong political bias and media organizations support the political narratives advanced by their political patrons, as it is the case in many other Middle Eastern countries.     

Persistence and change in Soviet and Russian relations with Afghanistan

This paper examines persistence and change in the Soviet Union's and then Russia's relations with Afghanistan with respect to development and security. First, a detailed analysis of the promise and reality of Soviet development assistance reveals conceptual shortcomings in their attempt to induce economic development in Afghanistan. The Soviet Union's heritage is then revealed in order to understand Russia's current perception of post-Taliban Afghanistan as well as Russia's emerging interests and commitment to Afghanistan's economic development. This paper argues that Russia will most likely replicate standard industrialization development approaches in contributing to Afghanistan's development. Therefore, Russia will probably run into problems similar to those that led to the failure of the Soviet modernization project, which consisted of large-scale development projects that were inappropriate to the country's institutions and the lives of most Afghans. It is questionable whether such reiteration will induce economic development now, in the complex setting of a fragmented and fragile state with a multitude of external players looking out for their own interests.     

Vegetation dynamics as a tool for detecting clandestine graves

The burial of a body can affect plant communities through mechanical disturbance and nutrient balance alteration. We performed an experimental trial using five swine carcasses buried in an open site in Italy. Vegetation dynamics was monitored recording monthly every plant individual on a regular sampling grid during 1 year on the graves, on an empty control grave, and on an undisturbed plot. Plant species composition and cover were significantly different between the disturbed and the undisturbed plots. Disturbed plots showed the increase in ruderal species and the reduction in stress-tolerant ones. Graves and the control grave could not be distinguished from each other. Disturbance was the main factor affecting plant cover, while the presence of a buried body did not affect vegetation dynamics. However, disturbance could be easily detected; the functional approach seems promising for the identification of dynamic patterns to be used in different biogeographic and ecological contexts.     

Discrimination of transparent polyethylene films based on identification of inorganic antiblocking agents

Several nondestructive and semidestructive analyses were used to discriminate colorless transparent polyethylene bags. Transparent plastic bags made from low-density and linear low-density polyethylene usually contain antiblocking agents to prevent sticking of the film, which makes it difficult to open the mouths of plastic bags. Inorganic antiblocking agents are uniformly dispersed in polyethylene films, so they are easily observed using optical microscopy. The particle size distributions of the antiblocking agents were compared by statistical tests. Particle composition was examined by elemental analysis using energy-dispersive X-ray spectrometry with a scanning electron microscope and by molecular vibration analysis using a sensitive microscopic Raman spectrometer. The compositions could be determined nondestructively on the basis of the results. These data reinforce the morphological discrimination. Morphological discrimination of the dispersed antiblocking agent powders, statistical comparison of particle size distributions, and compositional analysis of the antiblocking agents strengthen the ability to discriminate polyethylene films.
