国家治理体系的主体包括中国共产党、国家机关、社会组织和公民,行政组织是主要的主体,而中国共产党是国家治理的领导力量。国家治理体系的现代化,政府现化代是关键,法治化是保障。在治理视域下,行政组织法不再仅是政府内部的结构法,而是包括协调党政群关系、体现共同治理的治理主体法。从优化组织结构,体现党政群协调共治出发,积极回应国家治理现化化对行政组织的要求,通过行政组织立法明确行政组织的职权范围,将中央与地方的关系、部门和地方间的横向协作关系法律化,确立社会组织的行政主体地位,为党委领导、政府负责、社会协同、全民参与的治理体系提供法治保障。     

危害食品安全犯罪之罪名体系考

危害食品安全的行为不仅包括生产、销售问题食品的行为,而且还包括非法生产、销售违禁原料的行为、假冒注册商标的行为、非法广告的行为以及相关监管主体的渎职行为。针对这些行为,我国《刑法》规定了相应的罪名,形成了危害食品安全犯罪的罪名体系。但是,学界目前对这一体系的研究还不够深入。有鉴于此,有必要全面梳理我国《刑法》中与危害食品犯罪相关的罪名,分析这些罪名之间的关系,以期有助于司法实践中对危害食品安全犯罪之罪名体系的理解与适用。     

中德(日)犯罪成立体系比较分析

我国刑法界目前正在进行"犯罪构成体系重构或者完善"的讨论。"重构说"强调应以德国及日本的犯罪成立体系为参照,对源自前苏联的我国通说性犯罪构成体系进行全面改造,而"完善说"对通说体系的态度则以调适修补为基调。因而,站在解说中国问题的立场对德日体系之利弊得失作出评析,便尽显必要。     

Cross-circulations and Transnational Solidarity: Historicizing the US Anti-apartheid Movement Through Song

In encounters with African-American expressive culture, black South Africans at the dawn of the twentieth century recognized possibilities for their own lives—educational institutions free from white intervention, professional advancement, and independent nationalist governance. African-Americans seeking to reconnect with the continent worked for South Africa’s independence from apartheid. Music was a critical component of these engagements, creating lasting connections across national boundaries.

This paper situates the anti-apartheid activism of Sweet Honey in the Rock and In Process…, both African-American women’s a capella ensembles, within a larger historical trajectory. Through cross-circulations between the U.S. and South Africa, music constituted shared interpretive space linking African-American and black South African activist communities in combating systems of racial injustice in both countries. Building on scholarship on the role of performance in social movements, I explore the creation of shared community across national boundaries through the profound circulation of song.     

The German Party System: Eternal Crisis?

Ever since the early years of the Federal Republic, the German debate about political parties and the party system has been almost obsessed with the theme of crisis. Contrary to what seems to be the dominant view from within Germany, this article argues that, by and large, the German party system has performed well. Gordon Smith's centrality thesis can explain why this has been the case. However, there are indications that the future may not be so benign.     

The Electoral Cycle and Multi-Level Voting in Germany

The aim of this contribution is to analyse whether Land elections may (have) become uncoupled from the federal electoral process, and, if they have, to explore the implications for party competition in Germany. Initially, an overview is presented of the relevant theoretical models that can help unpack the relationship between different electoral arenas. Secondly, how these ideas have been applied to national and sub-national electoral competition in Germany is outlined, before an examination of the 'fit' of the data in both the pre- and post-unification periods. We conclude with reflections on two key features that have regularly surfaced in Gordon Smith's writings: party system change and political stability.
