JOURNEY FROM SUCCESS TO SIGNIFICANCE

One of the most important journeys that we can take as individuals is the journey from success to significance. Success is what we become and what we achieve when we value ourselves. Significance, however, is what we become and what we achieve when we value others. In this article, based on remarks by Judge David W. Young at the May 2007 “Summit on Unified Family Courts,” Judge Young invites us on a journey, first described by John Maxwell in The Journey from Success to Significance. Judge Young further explores what the journey from success to significance entails and reminds us that any success we have will leave the world with us while our significance will continue to live on in future generations through our service to children, families, and others.     

刑事审判监督的制度缺陷与完善

我国的刑事审判监督制度在制度设计上,存在监督程序启动标准过于抽象、再审程序启动权设置不尽合理等缺陷.要使刑事审判监督发挥保障法律公正实施,促进公正司法的制度功能,就要赋予审判机关接受刑事审判监督的义务和责任,明确刑事审判实体监督的启动标准,构建刑事审判监督中的证明标准,将再审程序启动权赋予检察院统一行使.

东南亚地区城市化发展中出现了城市首位度高、城市化水平整体较低、城市分布地区差别明显、过度城市化等问题,这些问题的形成既有主观原因,也有客观原因,既有历史原因,也有现代政府发展的原因.     

风险预防原则理论与实践反思——兼论风险预防原则的核心问题

尽管风险预防原则已经获得了广泛的认可,但其在理论和实践两个层面都具有较大的争议性。欲破解风险预防原则的内在困境,应在明晰存在的真正问题的基础上作出解释并提出可能的解决之道,避免仅仅依据法律文本进行＂空对空＂的分析。风险预防原则存在的真正问题是其法律效力问题,这就要求我们放宽研究的视野,从法律实效和社会实证入手,探究风险预防原则如何在社会中发挥效果。     

The Juvenile Justice Reform Act of 2018: Updating the Federal Approach to Youth Involved,and At‐Risk of Becoming Involved,in the Juvenile Justice System

On December 21, 2018, the Juvenile Justice Reform Act was signed into law, marking the first update in 16 years to the Juvenile Justice and Delinquency Prevention Act of 1974, as amended. The reforms reflect much of the knowledge that has been gained through research and science over the past decade and strengthen the Act’s core protections for youth in the juvenile justice system. The changes also expand the Office of Juvenile Justice and Delinquency Prevention’s role in research, and technical assistance, and provide for additional oversight for related programs.     

大清刑律草案签注考论

1907年大清刑律草案签注是研究《大清刑律》和"礼法之争"不可或缺的重要资料.本文利用诸多历史文献,对1908—1909年之间,中央部院、地方督抚的签注做了系统梳理,考证其文献来源、整理要点、上呈过程和表现形式,澄清以往研究中不清楚甚至错误的地方,辨析了签注的形成过程及其中的倾向性意见,分析了签注在《大清刑律》制定中影响和作用有限的原因.1907年大清刑律草案作为沈家本在法律领域贯彻"思想革命"的代表作,其得失是与政治领域的立宪运动同步的,由签注所引发的"礼法之争"的本质不是中西、新旧之争,而是法律领域"改良还是革命"的"主义"之争.1907年大清刑律草案既与中国自身的状况相脱节,也不符合法律自身的演进规律,是一次有着严重缺陷的立法实践.     

党的十八大以来关于制度治党研究述评

在推进全面从严治党的实践过程中,中国共产党特别强调发挥制度治党的作用,在学术界引起广泛关注。众多学者对制度治党的内涵界定、价值意蕴、存在问题、推进对策等方面都进行了深入探讨,取得了较为丰富的研究成果。今后,学术界在研究中要侧重解决制度治党在推进政党治理现代化中遇到的问题,在理论层面加强制度治党思想的理论构建,在实践层面以推进政党治理现代化为切入点,结合国家治理体系现代化的现实要求进一步探索推进制度治党的实践路径。     

Culture,Obesity Stereotypes,Self-Esteem,and the “Thin Ideal”: A Social Identity Perspective

Recent concerns with the increasing prevalence of overweight and obesity among children and adults indicate the need to better understand the psychosocial correlates of weight. We examined the relationships among negative stereotypes of obesity, thin ideal beliefs, perceptions of the causes of obesity and of control over weight, body esteem, and global self-esteem. A negative correlation between beliefs in control over one's weight and self-esteem was mediated by both negative attitudes toward obesity and thin idealization. Additionally, body esteem and gender were related but this relationship was mediated by beliefs in control over weight and valuation of the thin ideal. Central to the theoretical foundation of this research, however, was the observed negative correlation between negative attitudes toward obesity and self-esteem. This relationship was mediated primarily by the belief that obesity is caused by personality shortcomings. This last finding is explained from a social identity perspective.     

新时期以来唐诗学研究述论

新时期以来的唐诗学研究,在学科的理论性探讨上取得了初步的成绩,在唐诗学史的考察上呈现出多方位展开的态势,标示着唐诗学研究正日益成为甚具生长性的古典文学分支学科。同时,也存在研究视域不够开阔、理论探讨尚嫌单薄等不足。

新世纪是一个文化创新的多元化时代,如何重建文学批评?新世纪文学批评的形态及其责任是什么?浙江工商大学人文学院、《文艺报》、《文艺争鸣》杂志社联合主办了全国"新世纪文学批评的建构"学术研讨会。本刊就代表性观点以笔谈形式发表,意在推动对上述问题的进一步思考。
