Following Boyes and Chandler (1992), it is investigated how adolescents’ epistemic understanding relates to the process of identity formation. In a cross-sectional as well as longitudinal study, identity status scores of diffusion, foreclosure, moratorium and identity achievement as assessed by the Extended Objective Measure of Ego Identity Status were analyzed as a function of adolescents’ epistemic stance, while simultaneously taking into account individual differences in identity processing styles. The cross-sectional sample was composed of 200 German adolescents from Grades 7, 9, 11, and 13 (mean age: 16.2 years, SD = 2.41). The longitudinal study consisted of 134 participants (mean age at retest: 16.5 years, SD = 1.7) and covered a time interval of 18 months. Findings confirmed the view that the development of epistemic cognition contributes to adolescent identity formation. Specifically, the development of a multiplistic epistemic stance predicted higher moratorium scores, whereas the more advanced evaluativist epistemic position contributed to identity achievement over time. These effects were not due to individual differences in identity processing style.  相似文献

The authors examine the future of public service broadcasting in the context of current debates about, and commercial pressures on, the BBC. They describe the European Community constraints on public service broadcasting and the need for a clearer definition of such broadcasting, noting that such a definition is not currently provided in UK law. The BBC is also under increasing pressure from fair trading rules derived from competition law, some of which may weaken its ability to deliver its public service mission. Original research undertaken within the BBC suggests that external and internal pressures have undermined the conditions for a distinctive public service output, although there remains the basis for such an output within the culture of programme-making. The authors develop theoretical bases for a redefinition of public service broadcasting centred on the principles of citizenship, universality and quality in relation to services and output, and examine the implications for the structure of channels in the digital era. Finally, the authors discuss the legal and regulatory implications of their analysis in the context of the Government's Communications White Paper, arguing that the social and cultural purposes of public service broadcasting must not be made subordinate to competition-based concerns.  相似文献

The political settlement resulting from the Belfast Agreement recognisedthe fundamental importance of the issue of rights to a stable peace inNorthern Ireland. Indeed, the agreement provided for a Human RightsCommission, one of whose tasks is the drafting of a Bill of Rights thatwill reflect the political reality of the province. This paper arguesthat the proposed document will have to reflect an understanding ofrights and their protection resulting from the particular history ofNorthern Ireland. This specific understanding of rights appeared firstin the Anglo-Irish Agreement and has been gradually developed andconsolidated in the political agreements since. The planned NorthernIreland Bill of Rights will have to reflect this rights thinking. Thearticle also chronicles the recent work of the Northern Ireland HumanRights Commission in drafting the Bill of Rights to be presented to theSecretary of State for Northern Ireland in February 2002. Thereciprocal, if belated, moves in the Republic to set up its own humanrights commission will also be addressed as part of the process to drawup a Charter of Rights for the whole people of Ireland.  相似文献

As the facts that led to the Dow Jones/Gutnick-decision of the High Court of Australia (10 December 2002) illustrate, the Internet is a powerful platform for communication. Its continuous worldwide accessibility urges discussion of a number of questions regarding tort jurisdiction. These are the starting points for some critical remarks regarding states' reciprocal claims to cross-border activities and the way in which they deal with the interests of the involved parties. For tort jurisdiction, the paper proposes and applies criteria for the assessment of the place where the harmful event has occurred or may occur (art. 5, subsection 3 Regulation 44/2001), as explained by the European Court of Justice of the European Union. Special attention is hereby given to some particularities that characterize Internet torts. On the one hand it concerns the alleged global assignment of jurisdiction that art. 5, subsection 3 may lead to and on the other hand the scope of the assigned jurisdiction in the court of the place where the damage occurs. The European approach is confronted with the principles of personal jurisdiction that are embedded in long arm statutes and the Due Process Clause, as applied in some leading American cases regarding Internet jurisdiction. It leads to suggestions regarding the development of a marginal test for the reasonableness of the jurisdiction art. 5, subsection 3 could lead to in a particular case, as well from the point of view of the weight of the connecting factor as to the scope of the jurisdiction that is based upon it.  相似文献

Attacks on computers and information networks, both public and private, are disclosed in the news daily. Most recently, Apple, Facebook, and Twitter acknowledged that they were attacked and were now taking additional measures to secure their networks. In January of 2013, Kaspersky Labs reported discovering malware that not only targeted government information in Eastern Europe, former Soviet republics, and Central Asia, but also had been actively doing so since 2007. The scope of global cyber attacks is staggering and the solutions to securing property and protecting national security are illusive, in large part because infrastructure is owned and operated by private, rather than public, entities. Nations struggle with choosing the most effective strategy and potential regulation of the private sector in order to reduce overall cybersecurity risk. This paper reviews the nature of cyber threats, and compares the United States and European approach to promoting cybersecurity in the private sector. Furthermore, the paper discusses how different approaches can affect cybersecurity risk, and suggests a framework for visualizing the impact of law and strategy on security.  相似文献

虽然《行政强制法》规定行政强制措施权不得委托给私人,但是在代履行中,却存在着"私代履行人"参与公法任务的空间。"私代履行人"理应被定位为行政助手。然而,作为公私协力的模式之一,行政助手理论制度存在一系列争议,需要对委托机关与"私代履行人"的法律关系性质、"私代履行人"的代理权行使及其侵权的行政救济等问题消除歧见。在此基础上,对"私代履行人"的条件、职责、权利义务、诉讼途径及法律责任等进行规范建议。  相似文献
