它山之石 如何攻玉？——从公共管理视角看中国知识精英学习外国经验的心路历程

从公共管理的视角,回顾了中国100多年来,特别是最近几十年来,学习外国经验的心路历程。提出,东西方国家差别虽有,但这些差别并不足以用来论证东西方差别的本质性,也不足以支持东西方不能相互学习的结论。用东方还是西方作为思考和比较的基点,来审视国家的治理模式和社会的发展道路,不是一个合理的思维范式。过去被使用,不是因为它理论上的合理性,而是因为它的方便性和情感性。从中国近百年的历史来看,这一方便性和情感性事实上负面影响了中国对外学习的过程,因而有必要正本清源,从理论上给予修正。公共管理的学习和学科发展只有跳出了东方西方之争、最新和过去之争,用现代社会发展理论来审视和解释国家的治理和社会的发展,用科学和社会发展的态度,审视学科建设和管理实践的需要,才能最大限度地从人类文明的成果中汲取必要的养分,辅助中华文明的成长和发展。     

金融监管治理框架与指标衡量

金融监管机构作为金融中介的领导性机构,在监管金融中介有效运行、提高金融稳定性方面具有重要的作用。监管机构的健全是金融机构稳定高效运行的前提。我国正处于经济转轨时期,金融体系的稳健性对我国的发展尤为重要。监管治理要有一定的独立性,实行问责制,要有透明度。还要借鉴国际上监管治理的先进评估方法。     

Governance and order-making in Central Asia: from illiberalism to post-liberalism?

ABSTRACT

This forum brings together five different angles on the question as to whether and how political regimes and forms of order-making can and should be researched through the concept of ‘illiberalism’. The discussion engages critically with this and associated concepts, such as ‘illiberal peace’ and ‘authoritarian conflict management’, which have been developed out of the Central Asian / Eurasian context and discussed in their wider global ramifications and, within the framing of ‘illiberal peace’, explored in various contexts in and beyond Central Asia. While further assessing the relevance and implications of this approach, this forum also attempts to think beyond ‘illiberalism’ by introducing and discussing the idea of ‘post-liberalism’. This way, the authors engage in an exchange that serves to probe both concepts and to determine their strengths and limitations when it comes to analysing and understanding politics and societal processes in Central Asia.

Childhood poverty and evidence-based policy engagement in Ethiopia

This article explores efforts to bridge multi-disciplinary research and policy engagement to tackle child poverty in the contexts of developing countries, based on the experiences of Young Lives, an international longitudinal policy-research project. It focuses on a case study involving the application of research evidence on child poverty to shape policy debates concerning Ethiopia's second-generation Poverty Reduction Strategy Paper (2006–2010). The discussion is situated within theoretical literature on the interface between knowledge, policy, and practice, which supports the conceptualisation of policy making as a non-linear dynamic process. It pays particular attention to the importance of understanding the political and policy contexts of Southern countries, rather than assuming that they should simply import Northern-derived models of advocacy. It concludes by identifying general lessons for translating research into social-policy change.     

Destructive Competition or Competition Destroyed? Regulatory Theory and the History of Irish Road Transportation Legislation

The principal aim of our study is to contribute to the debate over whether regulation is enacted in the interest of consumers, producers, political agents, or some combination of these. We examine the legislative debates and subsequent regulatory bills surrounding road transportation regulation in Ireland in light of the three dominant theories which purport to explain the existence of regulation: the public interest theory and the so-called Chicago and Virginia theories. A unique feature of our study is an attempt to integrate specific rhetorical concepts used in the public policy debates into the theoretical analysis of regulation. One noteworthy conclusion of our study is that theories of economic processes affect the shaping and results of public policy.     

论我国上市公司高管报酬的法律规制

近年来,我国上市公司高管报酬数目畸高、增长迅猛,与公司业绩脱节,与普通员工报酬差距不断拉大。这引发了社会对高管报酬合理性的质疑。上市公司高管报酬问题集中反映公司治理结构中存在的问题。由于上市公司高管报酬的自我交易特征和潜在的利益冲突,公司法应从程序性公正方面来对其进行规制。     

政党规范的形式与效力

政党规范是关于政党的各种规范的总称,其核心问题是如何有效进行政党治理、维护政党政治秩序、促进民主政治发展。政党规范主要包括法律规范、社会规范、内部规范。这三种形式的政党规范既有一定的联系,在价值追求、形式特点、效力范围、实现方式方面又有明显区别。在当今世界,政党政治的复杂性、系统性、多样性,决定了仅靠任何一种规范都难以有效地进行政党治理;只有把政党规范作为一个体系、树立系统的政党治理观,既加强立法、依靠法律来匡正政党行为,也加强政治伦理建设、用伦理秩序来匡扶人心,还要加强政党内部建设、整合党内秩序,做到德法相济、内外相济、各种政党规范相协调,才能构建合理的政党政治秩序、促进民主政治发展。     

中国现行乡村关系中存在的问题及对策分析

＂三农＂问题的顺利解决要求把乡村治理好,然而,在乡村治理过程中却出现了乡村关系不顺的现象,乡镇政府干预村民自治的情况时有发生,严重影响了乡村治理的成效。因此,必须理顺现行乡村关系,健全相关的制度体系,转变乡镇政府工作人员的观念,改革现行政绩考核机制,转变乡镇政府职能。
