基于语料库的美国对华人权政策批判性话语分析

美国每年都会发布世界各国人权报告,以“人权卫士”自居,对他国人权状况说三道四,其中对中国人权的指责和干涉尤为严重。对此,以美国政府1997~2018年发布的22篇美国对华人权报告为语料对象,运用AntConc语言分析工具对报告语料库中的词单、关键词、关键性搭配词以及词丛进行长轴距对比分析。研究发现,四届政府对华人权报告是一套逻辑严谨、框架完整、战略清晰、目标明确的战略工具,美国对华人权政策的内在逻辑和战略意图可概括为“三位一体”(框架-战略-目标),即在“人权对象-人权内容-评判标准-人权状况-评判依据-人权诉求”的基本框架下,循序渐进地推进“人权政策主权化”战略,最终实现所谓西方自由世界民主价值和资本主义“普世化”目标。     

Constitutional Contestation of Religion in Sri Lanka

ABSTRACT

Sri Lanka’s constitutional policy regarding religion affords the ‘foremost place’ to Buddhism and obligates the state to protect and foster the Buddha Sasana, whilst assuring the rights and freedoms of the other religions. By explicitly creating a special status for Buddhism, the constitution has produced the category of the ‘Other’ that has the potential to discriminate against minorities in a pluralistic society and to undermine the fundamental principle of equality. The creation of this distinction generated contestation during constitutional reforms. By examining reform proposals on religion, interview material and comparing the debates of the Constitutional Assembly (October/November 2017) with the Constituent Assembly debates (1970–71), this study retraces the evolution of the Buddhism Chapter and identifies the present contestations and their role in deciding a constitutional arrangement for religion.     

Assessing Psychopathic Traits and Criminal Behavior in a Young Adult Female Community Sample Using the Self‐Report Psychopathy Scale

This study assessed psychopathic traits in a nonforensic female population (N = 343). Respondents completed the Self‐Report Psychopathy Scale‐4: Short Form (SRP‐SF) and also reported on their Criminal Behavior. The results revealed relatively higher scale elevations for the Interpersonal and Lifestyle SRP‐SF facets, compared to the Affective and Antisocial facets. Also, those with a history of Criminal Behavior had significantly higher SRP‐SF facet scores on all four psychopathy domains, compared to those without such history. Consistent with a number of previous studies, the structural equation modeling results revealed good fit for the four‐factor SRP‐SF model. In addition, a super‐ordinate SRP‐SF factor, which accounted for the majority variance of all four SRP‐SF first‐order factors, also accounted for 50% of the variance in a latent Criminal Behavior factor. Taken together, findings support use of the SRP‐SF to assess psychopathic features in a moderately large sample of Belgium women.

文章对"统一犯罪报告"项目、"全国犯罪被害调查"项目进行了比较研究,研究结果表明这两个项目既有广泛联系,又存在重大区别,是一个矛盾的统一体。只有综合地使用,才能较为全面地了解美国犯罪趋势。     

Discipline, Punishment And The Homosexual In Law

This article examines the creation and legacy of the 1957 Wolfenden Report, arguing that current trends to simplistically address the Report, along with a long standing academic focus on Foucault and the nineteenth century, have disregarded the productive and revolutionary nature of its recommendations enacted in the Sexual Offences Act 1967. Contrary to the common emphasis placed on Victorian medical discourse, and the 1895 trials of Oscar Wilde, it was the Wolfenden Report and the twentieth century that created the homosexual identity in law – an identity created not with a view to freedom, as is regularly assumed, but with the objective of the control of recalcitrant bodies in the forms of men's homosexual sex, and women's prostitution. 从新时期六次党代会报告看中共对台政策的演变及经验

新时期六次党代会报告对台湾问题的阐述集中反映了各个时期中共对台政策的凝结和创新。通过对六次党代会报告的具体考察发现,三十年来中共在对台政策上实现了"一个中国"原则由传统表述向新内涵阐释,由突出"和平统一"的目的性到突出"两岸关系和平发展主题"的过程性,以及由"两个寄希望于"到构建"命运共同体"的三次重要转变。坚持原则性与灵活性相结合,实事求是制定各项政策;坚持目的性与过程性相结合,重视目的性,突出过程性;坚持务虚性与务实性相结合,重视务虚性,突出务实性是新时期对台政策的重要经验。     

黎巴嫩禁毒报告(编译)

在20世纪七八十年代,黎巴嫩是中东地区毒品植物的主要生产地,特别是在贝卡谷地和赫迈勒地区,一直大面积种植大麻等可以提炼毒品的植物。进入本世纪以来,由于采取了禁毒措施,黎巴嫩的毒品问题日趋减少,正在得到有效遏制。     

论我国未成年人犯罪个人资料保护

未成年人犯罪个人资料保护是我国现行法律法规中较为薄弱的一个部分,现行规定较为模糊和笼统,和当前法治发展要求进一步加大对未成年人的保护趋势不相适应。针对现存的保护时间节点过窄、责任主体不明、抹销制度与前科报告三大问题提出相应立法和司法建议,力求符合未成年人犯罪个人资料保护的时代发展要求,完善我国未成年人犯罪个人资料保护。
