改造权力——法律职业阶层在中国的兴起

统一司法考试有利于法律职业者素质的提高和法律职业阶层的形成。世界各国都注重通过法律职业的建构来保证司法产品的高品质。中国传统社会权力结构的二元冲突体现在司法上 ,即是司法政党化、行政化和地方化。法律职业阶层的兴起是中国向现代社会转型的结构力学 ,是司法独立的保障。

何谓法律职业 ,无疑是法律职业研究中的核心问题。本文以社会学关于职业内涵的界定为参照 ,试图通过对法律职业的六个特征的具体解析来揭示法律职业的内涵。这六个特征是学识性、独立性、同质性、组织性、规范化和垄断性

中国律师业的可持续发展意味着律师业应注重自己的行为规范 ,同时 ,国家对律师业的发展也应提供相应支持。应当通过提高律师在诉讼中的地位、减轻律师业税费及统一法律服务市场等措施使律师业获得可持续发展。     

The Legal Profession in the european Union – a Comparative Analysis of Four Member States

Cross-border legal practice has finally become reality in Europe mainly thanks to two factors: the legal framework offered to EC lawyers by the EC legislator and the effect of globalization on legal profession. This article focuses primarily on the success of EC/EU efforts in abolishing obstacles to the free movement of lawyers. Particular attention is drawn to the Establishment Directive, adopted in 1998, opening up new perspectives for lawyers. Secondly, it discusses how globalization has contributed to this development. In relation to the above, this article also explores the new concept of establishment stemming from the expansion of law firms in Europe. Thirdly and mainly, it considers the national positions and the difficulties in harmonizing the legal professions throughout Europe. The examples of four Member States: the UK, France, Germany and Italy demonstrate how much they differ from each other as far as the needs, expectations and rules governing the legal profession. Gender and the academic profession in contemporary Tajikistan: challenges and opportunities expressed by women who remain

This article attempts to describe the deleterious impact of higher educational changes affecting female faculty members working in Tajik universities in the post-Soviet era. Over the past two decades, the social and economic position women gained during Soviet times has significantly eroded, bringing enormous challenges to education and higher education access, completion and staffing. The demographic and cultural marginalization of women here has negatively impacted university teaching opportunities and the status of women faculty members. Ethnographic interviews – along with relevant secondary data – reveal that despite various official gender-equity policies announced by the state, female participation issues remain prominent in the university. Our interviewees also report continued difficulty entering higher faculty ranks and leadership positions in university. However, significant numbers of women are still to be found there, and they report a workable compromise between being professional educators and trying to navigate a local culture that is becoming more ‘traditional’.

法律职业化与司法现代化的共同理论语境是现代性理论 ,共同实践背景是法制现代化运动。法律职业化意味着一个经过法学理论熏陶和法律知识传授之法律职业家共同体的形成 ,这个职业家共同体共享法律价值并娴熟于法律技能。司法现代化作为法制现代化的一个重要组成部分 ,倡导并通过现代司法制度确认司法独立、程序正义、程序效率等基本价值准则。法律职业化与司法现代化之间的理论关联可以从法律与经济关系、司法独立与程序正义、司法制度资源供给与分享、法律作为科学学科和知识体系、司法效率实现等多种维度进行分析和把握。     

司法现代化进程中的法律职业伦理

在某种程度上 ,法律职业群体的伦理素质状况决定着司法现代化的成败 ,进而决定着司法改革的成败 ,甚至决定着法治国家宏伟目标的实现程度。法律职业群体伦理的现代化是司法现代化的先导 ,是权力制约机制的必然要求 ,是防治司法腐败 ,重塑司法权威的现实需要。就当前中国的司法现状而言 ,司法现代化进程中的法律职业伦理建设应特别注重以下内容 :关注人性 ;崇尚正义 ;忠于法律 ;珍视荣誉。
