人身伤害重新鉴定的困惑与出路

刑事诉讼法和司法解释对人身伤害重新鉴定立法位置安排的不当和程序设计的缺失,遭到了鉴定实践的抗争,默默演变为不断重复鉴定的制造源。因此,应当完善人身伤害重新鉴定的启动程序,经过文证审查的过滤,建构专家委员会的终结性复核鉴定制度,并通过诉讼程序消解鉴定障碍,达到公正选择适用重新鉴定程序规则的目的。     

China's new regulatory regime tailored for the sharing economy: The case of Uber under Chinese local government regulation in comparison to the EU,US, and the UK

Although Uber's arrival in China has resulted in disruptive competition for incumbent taxi companies, it offers an attractive alternative in China's supply-demand-imbalanced urban passenger transport system. China's regulatory regime for Uber has evolved in three stages: from the regulatory vacuum prior to 2015 to its official legalization in 2015–2016, and the enactment of numerous local regulations in 2016, with specific and more demanding requirements for Uber. This policy is a part of the Chinese approach to the gradual liberalization of the urban passenger transport market. Policymakers should consider ‘fair competition’ as the guiding principle to balance the interests of sharing firms and incumbent service providers, as well as between different sharing firms. The core value of this principle lies in the benefits it provides for consumers and the way it engenders a pro-competitive market environment. The labor protection arrangements for sharing firms’ laborers should be more flexible and diversified. In order to recognize whether an Uber-Driver is an employee or independent contractor, a new standard taking into account a range of factors should be established through collective negotiations between the participants of the sharing economy, and dialogues between members of the judiciary, academics, and the policymakers. Further, consumer protection law and personal data protection provisions should apply when sharing firms misuse their distinctive algorithmic management model to compete unfairly to the detriment of consumers and other users. Ex ante regulatory measures designed to protect the personal data of users should be introduced for deployment in the context of the sharing economy. When enforcing these rules, a balance should be struck ensuring free data flow that is essential to sharing firms’ innovation and competition, and the need to ensure the level of data security required to underpin a well-functioning sharing society.     

Tricyclic Antidepressants Found in Pilots Fatally Injured in Civil Aviation Accidents

Prevalence of tricyclic antidepressants (TCAs) has not been explored in pilots. The National Transportation Safety Board (NTSB) aviation accident and the Federal Aviation Administration's Civil Aerospace Medical Institute (CAMI) toxicology and medical certification databases were searched for pilots fatally injured in aviation accidents. During 1990–2012, CAMI received bio‐samples of pilots from 7037 aviation accidents. Of these, 2644 cases were positive for drugs. TCAs were present in 31. TCA blood concentrations ranged from therapeutic to toxic levels. The NTSB determined that the use of drugs and ethanol as the probable cause or contributing factor in 35% (11 of 31) of the accidents. None of the 31 pilots reported the use of TCAs during their aviation medical examination. The prevalence of TCAs in aviators was less than 0.5% (31 of 7037 cases). There is a need for aviators to fully disclose the use of medications at the time of their medical examination.     

政府在食品安全监管中的职能转变与策略选择——基于北京市场的案例调研

基于对我国食品安全监管现状的认识,本文提出了以政府为主导的食品安全控制体系向以企业为主导的食品安全保证体系的发展方向;以农产品批发市场为例,通过案例调研进一步阐述传统监管体系在实际运行中存在的问题及转变政府职能的必要性,如监管重复化、程式化和低效率,市场执行效果不好,抽检规范化、标准化和信息追溯可信度低等;并通过博弈模型分析政府和企业(市场)进行食品安全监管和控制的行为决策过程,找出通过政府职能的转变而促使企业从"反应型食品安全监管"向"自主型食品安全监管"转变的关键所在与有效路径,为提升我国食品安全监管效率、创新食品安全监管模式提供思路。     

高校腐败犯罪研究

我国高校腐败犯罪数量突升,大案、要案居高不下;犯罪主体年轻化,领导干部涉案多;贪污受贿犯罪为主,窝案串案比例大;犯罪领域众多,后勤基建成高发区。造成这种状况,既有市场经济消极作用的原因,也有高校内部权力过于集中、管理制度存在缺陷、监督严重不力等方面的原因。因此,必须采取多项有效的防治对策,才能遏制高校腐败犯罪的发展。     

对民警培训评估体系建设的几点思考

民警培训质量评估对加强和改进民警培训中心或基地的自身建设,改善民警民警培训教学训练和管理水平,提高民警培训质量具有积极意义。培训中心应充分理解民警培训评估的科学内涵,积极构建评估组织完善、程序合理、指标体系科学的民警培训质量评估体系。

An evaluation approach that is collaborative and elicitive may well serve as a catalyst for transforming relationships of power, standing in stark contrast to more conventional and staid evaluation practices that are technical in nature and actuarial in intent. Election of an orientation is the most decisive and strategic choice that is made in approaching evaluation and articulating value imperatives in fieldwork, coloring as it surely does the pragmatic stages of evaluation and good practice for the peacebuilder.     

Narrative accounts from the citizens,victims, and offenders restoring justice program

This paper describes the Citizens, Victims, and Offenders Restoring Justice (CVORJ) program, a prison-based program conducted as a pilot study at the Washington State Reformatory. The program brings together offenders and victims - though not involved in the same crime - in the company of interested community members to discuss restorative justice principles. The program focuses on the sharing of personal narratives of crime to explore how the harms resulting from crime can best be addressed and justice achieved. Of interest was how a restorative justice model that highlighted community participation could be incorporated into a correctional setting and whether healing could result from the use of surrogate offenders, victims, and community members. The restorative nature of the program, its method of operation, results from the qualitative evaluation, and key implementation challenges are presented.     

Can Twitter Add to Performance Evaluation in the Area of Performing Arts? Reflections from La Scala Opera House

ABSTRACT

Social media are continuously diffusing in performing arts organizations. Yet little is known on how social media data can contribute to the performing arts evaluation process. This article addresses this issue by investigating if and how Twitter data can add a valuable source of information to the performance evaluation process. A literature review with an empirical application on the evaluation of the performance Aida at Teatro Alla Scala provides evidence about the type of indicators that can be derived from Twitter and support a discussion about potentialities and pitfalls connected to their adoption for the evaluation of performing arts.
