劳动关系视角下的网约用工纠纷研究

近年来,网络平台与网约工的劳动纠纷开始显现在司法实务中。面对类似纠纷,法院采取了不同的立场。尽管网约用工打破了过去"单一企业对应单一员工"的劳动关系模式,但根据现行法律,仅凭合作协议难以认定网络平台与网约工存在劳动关系。一方面应当区分网约工与网络平台签订劳动合同、网络平台与其它企业进行合作、网络平台直接与网约工签订合作协议三种形式,另一方面应当在司法实践中对"各项劳动规章制度适用"、"受劳动管理"、"从事用人单位安排的有报酬的劳动"进行统一规范解释。最后应当在司法经验基础上根据"互联网+"背景下共享经济的特点完善劳动法。     

Civil society knowledge networks: how international development institutions reshape the geography of knowledge

What role have the processes and institutions of international development played in creating and propagating ideas around the world? This paper demonstrates that networks of development-focused civil society institutions can form global epistemic bridges even where communication technology, global markets, infrastructure, or state services do not reach. Given the penetration of these ‘civil society knowledge networks’ throughout the world, it is crucial to understand how these networks form, and how they create and spread ideas, mediating between global discourses and local needs. This paper builds on a multi-sited case study of one such civil society knowledge network, which includes an international foundation, its partner non-governmental organisations (NGOs) in Kenya, and one village where these NGOs run a forest conservation project. The case study provides a closely textured analysis of the mechanisms of knowledge production and consumption in the network, including personality politics, language, technology, political connections and the power dynamics of knowledge flows. It demonstrates the ways remoteness and disconnection are overcome through the epistemic reach of institutional networks involved in development interventions.     

The Blue (White and Red) Orchestra: a soundtrack for the country that never was

The aim of the paper is to go beyond the commonly accepted view of Sarajevo’s Plavi orkestar (The Blue Orchestra) as the 1980s “teen pop-rock sensation” and illuminate the less conspicuous, but nevertheless crucial, political dimension of the band’s music and visual aesthetics. This will be done by discussing several “pieces of the puzzle” essential to understanding the background to and motivations behind Plavi orkestar’s political engagement in the second half of the 1980s: (1) the “Sarajevo factor;” (2) the Sarajevo Pop-rock School and the New Primitives “poetics of the local;” (3) the generational Yugoslavism; (4) the New Partisans “poetics of the patriotic;” and (5) the post-New Partisans “hippie ethos.” The concluding section of the paper will reflect on Plavi orkestar’s resurgence in 1998 and explore the question of the band’s continuing resonance within the post-Yugoslav and post-socialist contexts. An argument underlying the discussion of all of these elements is that Plavi orkestar’s Yugoslavism of the 1980s is best understood as a soundtrack for the country that never was (i.e. a popular-cultural expression of what, from the viewpoint of a particular generational cohort and its location in the “Yugoslav socialist universe,” the community they thought of as their own ought to have been but never really was), and that the current value of this soundtrack lies in offering not only a particular window into the pre-post-socialist past but also in being a symbolic referent for a certain kind of retrospective utopia that gauges the realities of the post-socialist – that is, neo-liberal capitalist – present and, in so doing, figures as a “normative compass” for the life of dignified existence.     

The Origins of the European Coalition for Vision: Exploring the Formation of a Network

Despite growing interest in EU-level transnational networks, there is little understanding about how these form. This article investigates the formation of one network—the European Coalition for Vision (ECV). Using document analysis of 100 email exchanges, 12 semi-structured interviews, and observation of 5 ECV meetings, it identifies environmental and organizational triggers, most important to the creation of the ECV. Findings show that while environmental triggers played a role in ECV formation, organizational triggers were crucial. In particular, the presence of network leaders, a network entrepreneur and a network mentor were vital for the successful creation of the network.     

“Making It”: Understanding Adolescent Resilience in Two Informal Settlements (Slums) in Nairobi,Kenya

Many adolescents living in contexts characterized by adversity achieve positive outcomes. We adopt a protection–risk conceptual framework to examine resilience (academic achievement, civic participation, and avoidance of risk behaviors) among 1,722 never-married 12–19 year olds living in two Kenyan urban slums. We find stronger associations between explanatory factors and resilience among older (15–19 years) than younger (12–14 years) adolescents. Models for prosocial behavior and models for antisocial behavior emerge as key predictors of resilience. Further accumulation of evidence on risk and protective factors is needed to inform interventions to promote positive outcomes among youth situated in an ecology of adversity.     

Local Government and Local Governance: 1944–2011

Abstract

Since the establishment of the tri-partite system of state education after the Second World War, the once simple relationships between central government and local government and the individual school have become increasingly complex. This article considers the key governance issues for schools and colleges in England and how they have been affected by the redistribution of power between central government and local government. The principal foci are the main legislative changes and the impact they have had on the respective powers and responsibilities of central government, local government and schools and colleges. The radical developments since the formation of the coalition government in May 2010 have accelerated the shift of power to central government from local government and by the end of the first term of the coalition the local authority will have little more than a vestigial role in the provision of secondary education and a diminishing role in primary and special education. As academy status becomes the norm (as it already is for secondary schools in some authorities) central government will be dealing directly with autonomous schools and academy chains. With more schools directly employing staff and with funding levels set nationally, the pattern and nature of public education will have been irrevocably changed.     

网络问政的政府回应逻辑：公开承诺压力与选择性回应——基于66个政府网站领导信箱的实验设计

立足我国制度环境与行政体制,建构了网络问政领导信箱回应运行理论框架,提出影响回应绩效五个影响因素,包括行政系统区域特点与领导者特质两个内部因素,外部因素包括政治压力、舆论压力及诉求压力三个维度。采用德尔菲法建构了领导信箱回应绩效指标体系,并采用实验设计搜集66个领导信箱网络问政回应的有效样本。实证结果显示：政治压力中的公开承诺程度对回应绩效有正向效应,诉求压力中的诉求类别对回应绩效有显著影响,政府回应存在“选择性回应”问题。为了进一步提升政府网站领导信箱的回应绩效,可以完善内部回应流程、公开对外服务承诺与建立自下而上回应性问责机制。     

Accountability in Public Management Networks: An Analysis of Cost Monitoring in Chicago Municipal Networks

Public management networks (PMNs) continue to proliferate as governance becomes more complex, and so does the need to hold them accountable. Agency and collaboration theories provide a solid foundation, but additional constructs are necessary to adapt to this dynamic era. Building from Bovens et al. (2008), the authors offer an ecological framework of third-party accountability that incorporates a number of prominent accountability theories under the same construct. Employing a mixed-methods research design that examines eight local PMNs in the Chicago region, the study finds that an exemplar accountability mechanism—additional cost monitoring—occurs more often in situations predicted by the framework. Additionally, qualitative interviews of network participants suggest that cost structures can differ by network type, which is verified quantitatively.
