司法改革“上海方案”价值评析

在当前改革的关键时期,司法改革的核心是提高司法的公信力,树立司法的权威。我国三轮司法改革的实践证明,司法行政化与司法地方化是影响司法独立和司法公正的两大障碍性因素。如何根据法治的一般理论,遵循法治的基本规律,建构能够解决中国问题的具有中国特色的司法体制与机制,是中央顶层设计和地方实践探索的关键。“上海方案”作为本轮司法改革的先驱者,所探行的“员额制”、责任制、人财物统一管理体制等,彰显了司法改革的顶层设计性、开拓性、试水性、引领性等系列价值。同时,“上海方案”在具体制度的设计与实施中,还需要缜密论证与审慎推行。

Area Differences and Time Trends in Crime Reporting: Comparing New York with Other Metropolitan Areas

Police measures of crime are shaped by victims’ decisions to notify the police. To obtain a better understanding of US crime trends, this study uses the National Crime Victimization Survey to examine geographic differences and temporal trends in crime reporting in New York and other metropolitan areas for the period 1979-2004. We find that net of crime characteristics and survey methodology, the New York metropolitan area showed fewer increases in crime reporting than did other metropolitan areas. These divergent trends suggest that the real differences in the drop of nonlethal violence between New York and other areas may have been smaller than those indicated by police-based crime statistics. We also find that from the early 1990s to 2004, New York showed a sharp decrease in the likelihood of victims perceiving that “police wouldn’t help.” This trend suggests that police reforms in New York City have not resulted in more victims using police-related reasons to explain their nonreporting behavior. Instead, researchers need to develop a broader theoretical framework (not an exclusive focus on police actions) to understand how police- and nonpolice-related factors may explain the geographic variation in the trends of reporting observed in this study.

新时代系统总结和多维审思马克思主义中国化的基本经验,有利于科学把握马克思主义中国化的基本规律及发展趋势,为新时代中国特色社会主义的发展提供动力支持.这些基本经验启示主要概括为:科学回答"什么是马克思主义、怎样对待马克思主义"是马克思主义中国化的逻辑起点;准确把握中国国情,认清中国特色社会主义发展的历史方位是马克思主义中国化的现实基础;建构理论创新与实践创新互动的有效机制,找准马克思主义与中国实际相结合的切入点是马克思主义中国化的科学路径;坚持以人民为中心的发展思想,着眼人民群众的美好生活需要是马克思主义中国化的价值旨归.     

政治统一、支持监督与协商治理:中国新型政党制度的优势

中国新型政党制度是保持国家政治统一、实现权力有效监督制约和实践协商民主政治的重要制度载体.中国新型政党制度的优势主要体现在通过聚合性的政党制度结构,保持了超大规模国家的政治统一;通过非竞争支持型的政党监督模式,初步实现了政党之间的权力监督;通过多党合作和政治协商,实现了包容互惠发展导向的协商民主治理.新时代坚持和完善中国新型政党制度,需要通过制度改进和完善,进一步发挥中国新型政党制度的优势,促进国家治理现代化的实现.     

关于合作共赢的认识和思考:基于新型国际关系理念

合作共赢是中国在国际关系问题上首倡的一个价值理念,对于构建新型国际关系和人类命运共同体、站在人类道义和历史进步的制高点、促进世界持久和平和普遍繁荣、推动人类社会文明发展、实现全球有效治理等具有非常重大和深远的意义。习近平总书记深入、系统、现实地推进了合作共赢理念的完善和发展,使之成为当今中国对外关系思想的重大新理念和显著特色之一。实现合作共赢的关键在于价值上求同存异,根本在于寻求各国利益交汇点,长远考虑在于提升全人类的现代文明素养。     

“马克思主义中国化”概念提出的文化动因及其当代价值

马克思主义中国化既有特定的实践基础和理论诉求,也有特殊的文化背景和文化土壤。因此,从理论上来讲,马克思主义中国化表现为马克思主义在实践向度、理论向度和文化向度的充分展开过程。然而,由于历史上革命任务的紧迫性,马克思主义中国化的实践向度和理论向度充分展开而具有外显性,并得到学界的重点关注;马克思主义中国化的文化向度或文化动因问题则相对弱化而具有内隐性,也没有得到学界充足的重视。从近代中国文化发展视角来分析马克思主义及其中国化,能够为全面认识马克思主义中国化的历史进程提供另外一种面相。以民主革命时期"马克思主义中国化"概念的提出为例来看,在近代中国文化发展的逻辑中,"马克思主义中国化"是中国共产党在构建"中华民族的新文化"的过程中,随着自身对文化民族性关注度的提升而必然要提出的重要概念。在发展21世纪中国马克思主义的新时代,重视"马克思主义中国化"概念提出的文化动因具有重要的当代价值。     

There’s an app for that: Modernizing domestic violence support through the creation of new technologies,tools, and services

With domestic violence (DV) at an all-time high, police departments are drastically underutilizing technology to combat DV. Currently, New York police departments complete a “Domestic Incident Report” at the scene of domestic incidents but fail to adequately facilitate support services. New York State should mandate a services component into police DV protocols, specifically by commissioning: (1) an application linked to DV organizations presented at the scene of domestic incidents; and (2) a gateway application to refer victims to the correct services. Such tools would allow for the rendering of more efficient support to DV victims in times of immediate crisis.     

Can Social Media Predict Election Results? Evidence From New Zealand

The importance of social media for election campaigning has received a lot of attention recently. Using data from the 2011 New Zealand general election and the size of candidates’ social media networks on Facebook and Twitter, we investigate whether social media is associated with election votes and probability of election success. Overall, our results suggest that there is a statistically significant relationship between the size of online social networks and election voting and election results. However, the size of the effect is small and it appears that social media presence is therefore only predictive in closely contested elections.
