The compliant court — Procedural fairness and social control in compulsory community care

Compulsory community care (CCC) was introduced in Sweden in 2008. This article investigates all written court decisions regarding CCC over a 6 month period in 2009 (N = 541). The purpose is to examine how the legal rights of patients are protected and what forms of social control patients are subjected to.

1988年,Kasperson及其合作者创立的"风险的社会放大框架"以风险的社会属性为基础,揭示了风险在传播过程中的放大过程。通过分析"三鹿奶粉事件",可以发现该分析框架对食品安全风险放大具有解释力。为应对食品安全风险的社会放大,不能止于食品安全风险交流制度,而应当构建以多重食品安全风险为对象的风险评估法律制度,构建灵活多元的食品安全风险管理法律制度,探索食品安全风险社会放大的法制因应之道。     

Bullying and sexting in social networks: Protecting minors from criminal acts or empowering minors to cope with risky behaviour?

The availability and use of social networking sites creates both opportunities and risks for their young users. This article evaluates the applicability of the current legal framework to (cyber)bullying and sexting, two types of (potentially harmful) behaviour that are increasingly occurring between peers in the social networking environment. The analysis includes a mapping of applicable legislative provisions at the European and national level, an analysis of the Terms of Service of the largest social networking provider, Facebook, and an overview and assessment of self-regulatory initiatives that have been taken by the industry in this area in Europe. The ultimate goal is to identify a number of elements for a comprehensive strategy to ensure that risks of (cyber)bullying and sexting are dealt with in a manner that empowers young users.

Truth and Politics: Thinking About Evidence‐Based Policy in the Age Of Spin

Evidence‐based policy and the contemporary politics of spin are said to characterise contemporary politics and policy. The paper asks firstly what sense is to be made of this coincidence, and then documents this coincidence. It then asks how credible is the conception of ‘evidence’ espoused by advocates of evidence‐based policy when it is conventionally represented as an ‘objective’ counter to ideology, spin or opinion? It points to major problems with the conventional understandings of ‘evidence’. It is suggested that while the evidence‐based policy literature relies on the associations ‘evidence’ is presumed to have with ‘sensory data’, this is neither the case nor all that defensible. The paper reprises arguments advanced by Henry Mayer and Hannah Arendt that the relationship of politics to the empirical was and is a far more complex relationship than is conventionally understood to be the case.

Racism: Less is More

Racism has been in sharp decline in recent decades yet the word, as accusation, is used more than ever. The word/idea needs to be more restrictively defined and kept for when it is really needed. When almost everyone is a racist, no one is. To this end we need to distinguish more clearly between the greater comfort people often feel among familiar people and places and active hostility towards outsider ethnic groups. We also need a more discriminating language to describe the spectrum of discrimination. Prejudice, clannishness—even in some instances discrimination itself—should be regarded as sentiments and behaviours that are distinct from proper racism.
