特殊非婚生子女之合法权益保护新探

随着社会的发展，青年人婚前同居行为尤其是未成年人偷食禁果而致使非婚生子女这一社会现象不断出现。男女自身一方或双方为限制民事行为能力人而导致婴儿抚养、弃婴溺婴、抚养等一系列法律纠纷、严重的违反法律和伦理道德社会问题，社会正常秩序遭到破坏，人权得不到保障，不和谐的因素增加。因此，为维护非婚生子女的合法权益，我们必须诉诸法律这一强有力手段，充分发挥其协调规范人们行为的作用，加强执法达到现阶段减少、长远预防之法律根本目的。     

职务侵权民事责任若干问题探讨

国家赔偿属于民事责任中的职务侵权民事责任,国家赔偿法应当在赔偿范围、归责原则等方面作必要的修改。民法通则关于职务侵权民事责任的规定极少,且极为原则,现有的民法典草案也未作系统、全面的规定,建议增加相关条款。     

关于特别行政区制度研究的若干思考

目前宪法学界和政治学界有关以特别行政区制度研究为论题的论著很少,这一现状与学界对＂一国两制＂方针政策、港澳基本法的理论与实践研究成果十分丰硕相比存在明显落差,不足以反映特别行政区制度的重要地位和作用,亦不适应它在港澳相继成功实施已有十余年并将长期坚持和完善的任务,需要引起高度重视。展开对特别行政区制度的研究具有多方面的意义和价值,其中如何认识和界定特别行政区制度在我国社会主义民主政治制度中地位和作用是一个尚未解决的重大问题。     

对驰名商标特殊保护的若干思考

国际上对于驰名商标的特殊保护已突破商标专用权的地域原则和注 册原则,要求成员国之间相互保护尚未在本国注册的外国商标,并扩大到非类似商品 及服务上,还在驰名商标对抗的要素上,除商标外,进一步涉及到厂商名称等商业标 记及域名。我国对驰名商标的保护在立法和执法方面都有所进展,但在商标注册、地 域范围、认定方式等问题上,还有值得探讨的地方,对于驰名商标的特殊保护的目标、 途径都应加强研究,以期完善立法,维护公平竞争,保护消费者权益。     

特种行业管理的回顾与改革思考

对特种行业管理的改革,应转变管理方式,变审批制为备案制;建立特种行业协会,发挥协会的自治作用;加强从业人员科学化、系统性管理;利用网络技术对特种行业实施信息化监管,确保信息畅通。     

冷战后的英美"特殊关系"

冷战结束后 ,围绕英美“特殊关系”问题产生了两个主要的争论 :一是冷战后英美两国应该放弃还是继续保持“特殊关系” ?二是这种“特殊关系”在冷战后是加强了还是淡化了 ?前一个争论主要发生在英国国内 ,尤以“疑欧派”与“拥欧派”之间的对立为代表。后一个争论 ,从英美关系的现状看 ,尽管两国在双边关系及一些重大国际问题上存在分歧 ,但由于两国继续保持并强化了战略伙伴关系 ,这种“特殊关系”在冷战后实际上得到了加强

Swiss Politicians' Ties: A Comprehensive Dataset

Focusing on the of 49^th Swiss legislature, we build a dataset about the politicians' links with lobbying groups. We approximate political ties considering three dimensions: (1) politicians' mandates in legal entities; (2) their professions, and (3) the enterprises, associations and other organizations related to the recipients of access rights provided by politicians. This research note proposes an objective and integrated way to classify the links coming from different sources by using codes of the General Classification of Economic Activities (NOGA2008). We find that the three dimensions used to approximate politicians' links are complementary, each of them containing additional information. Our results also show that politicians' interests distribution across economic categories depends on political group, gender and geographical origin.     

Hidden corporate profits in the U.S. prison system: the unorthodox policy-making of the American Legislative Exchange Council

Using a leaked document trove containing 800 model bills, we analyze the American Legislative Exchange Council’s (ALEC) hidden corporate profit making in the prison–industrial complex. We find that ALEC seeks to expand the private prison industry in three ways: (1) promoting greater use of private prisons, goods, and services, (2) promoting greater use of prison labor, and (3) increasing the size of the prison population. ALEC’s efforts to increase the prison population by expanding definitions of existing crime, creating new crimes, enhancing enforcement of existing crimes, amending the trial process to increase the likelihood of incarceration, and lengthening prison sentences for crimes pose a threat to civil liberties. ALEC’s unorthodox policy approach exemplifies John Gaventa’s theory that powerful interests maintain their power by creating conditions in which citizens are not able to identify and advocate on behalf of their interests.
