Abstract

Mark Twain once famously quipped, “I never let schooling get in the way of my education.” Paul Simon, the American folk singer, begins one of his songs “When I think back on all the crap I learned at high school, it's a wonder I can hardly think at all.” These men could just have easily been discussing schooling in Ireland, for this is the way many Limerick children and youth felt about formal school life prior to their involvement with St. Augustine's Youth Encounter Project. But it is prior to their involvement.

This chapter provides a demographic profile of the pupils of that project and explores aspects of the day-to-day life of the project as a child and youth care intervention by examining some of the influences of risk replacement or resiliency projects that have influenced provision of services. This Limerick YEP attempts to alter the approach from one that is risk, deficit, and psychopathology-oriented to one that is protection, strength, and asset focussed. A question posed is, “Has the early intervention enrichment programme assisted the pupils to reintegrate successfully within the community?” By reintegrate I mean the ability to attend a regular school, hold a job, live again with their family and such things. This chapter also explores the establishment of the Youth Encounter Projects in Ireland in the context of an important but largely overlooked study completed by Egan and Hegarty over two decades ago (1984). Financial assistance provided by the International Monetary Fund (IMF) and other International Financial Institutions (IFIs) aims to help member countries reduce their economic policy distortions. Because these distortions are endogenously generated, it is important to understand how IFI assistance interacts with the domestic political economy. In this paper, we review recent models of IFI conditional assistance that are based on the theory of special interest politics (Grossman and Helpman 2001). In these models, governments adopt inefficient economic policies and instruments because of lobbying by interest groups. IFI assistance helps reduce these inefficiencies, at least under perfect and symmetric information, and provided IFIs are representative of the general public in creditor and debtor countries. Factors limiting the effectiveness of conditional assistance as an incentive system are also identified. These are related to information asymmetries, the potential for political instability in debtor countries, and the IFIs’ own financial solvency.

我国侦查实践中的调取证据是一项独立的、具备干预性的强制处分措施。调取证据措施之所以具有上述性质,与侦查机关对《刑事诉讼法》的误读密切相关。这种误读违背体系解释,有违法明确性原则,不利证据排除。应将现有的调取证据措施整合进扣押措施,使之成为提出命令式的扣押,在此基础上,应进一步平衡查明事实和人权保障之间的关系,对扣押措施的运用做出相应的限制。  相似文献

当前,犯罪分子的犯罪手段日益多样化、隐蔽化、科技化,为了有效制止犯罪,维护社会秩序的稳定,各国在一些特定犯罪案件的侦查中都或多或少采取了一定的特殊侦查行为。边防部门由于侦破案件的特殊性,在实践中对特殊侦查行为也有适用,但由于我国现行法律的缺失,给特殊侦查行为的适用造成了一定的障碍。为此,在实践工作中必须把握住特定案件原则、必要性原则、特定对象原则和审查批准原则,以正确、合法的原则指导行为,从而最大限度地发挥特殊侦查行为对侦控犯罪的作用和效果。  相似文献

中国知识产权专业审判组织的建构始自20世纪90年代,知识产权法院是其自然延伸。设立知识产权法院有诸多理由,如促进司法统一、提高程序效率、强化知识产权保护、树立良好国际形象、试点司法改革等,但并不能从理性上由此得出知识产权法院具有必然性的结论。因而,知识产权法院是综合政策的结果。知识产权法院在我国应定位于专门法院,其建立与完善是一个长期的过程。有必要借鉴域外知识产权法院的经验,并结合现实国情,建立有中国特色的知识产权法院制度。知识产权法院的建设还应置于司法改革的背景下,在司法体制、机制以及知识产权特别程序制度方面进行探索,为全面的司法改革积累经验。  相似文献

Abstract

The context for land resistance in liberalising India is dynamic. As the state promotes capital investment, lines between public and private are blurred. Land is central to these efforts, as new industries, mines, large-scale agricultural projects and infrastructure initiatives all require vast amounts of land. The introduction of Special Economic Zones (SEZ) in the Indian state of Goa highlight land deal tensions. Following protests rallying thousands and widespread public mistrust of land and regional planning processes, the state’s chief minister halted the zones. This action mollified public unrest and temporarily appeased anti-SEZ social movements. However, scepticism arose as the chief minister failed to legally de-register the zones and return SEZ lands to original owners or collectives. Amidst state inaction, movement members sought judicial justice. Protest and corruption theories are integrated with political interpretations of liminality in this article to frame how social movements shift their patterns of intervention in response to or in anticipation of inaction. Enhanced opportunities for corruption, exemplified by the SEZ model, lead movements to adapt strategies of resistance beyond state-oriented protest. The interventions discussed represent a shift in the ritual form of protest and the degree of political engagement with the judiciary. The multi-faceted contestation altered power structure, while politicising and scrutinising land deals.  相似文献

Family courts are seeing an increasing number of separating or divorced families who have a special needs child. These cases present complex challenges for family law professionals charged with crafting parenting plans based on best interests standards. For many of these children, the typical developmentally based custodial arrangements may not be suitable, given the child's specific symptoms and treatment needs. We present a model for understanding how the general and specific needs of these children, as well as the demands on parents, can be assessed and understood in the context of divorce. This includes an analysis of risk and protective factors that inform timeshare and custodial recommendations and determinations. The risk assessment model is then applied to three of the most commonly occurring childhood neurodevelopmental and psychiatric disorders likely to be encountered in family court, namely, attention deficit/hyperactivity disorder, depressive disorders, and autistic spectrum disorders.

  • Family law professionals of all disciplines should develop a fundamental knowledge base about the most commonly seen special needs children in family court, such as those with neurodevelopmental conditions like autistic spectrum disorder, attention deficit/hyperactivity disorder, and severe depressive disorders (especially with teenagers), which may involve suicidal or self‐harming behaviors.
  • Commonly recommended parenting plans may be inappropriate for many special needs children, as some function significantly below their chronological age and pose extreme behavioral challenges.
  • A systematic analysis of risk and protective factors should inform timeshare arrangements and determinations with this varied population, including the safety of the child and severity of the disorder, parental commitment and availability to pursue medical, educational, and therapeutic services, the parental attunement and insightful about the problem, and the differential parenting skills of each parent.
