论政府的制度型再造与业务型再造:以有线电视部门为例

本文构建了一个关于政府再造演化机制的理论框架:根据对西方政府再造理论与实践的梳理,提出从制度型再造到业务型再造的演化路径。结合英美国家有线电视部门再造的案例分析,深化了对政府再造的演化机制及其和政府职能转变之间联系的理解。通过横向比较和纵向回顾,对我国有线电视产业部门和规制机构再造所处阶段和发展方向进行了政策应用分析。本文的研究可以为我国其他政府部门设计再造的路径和方案提供一定的借鉴。

第三方支付在便利人们生活的同时,也带来了犯罪手段的升级,典型的如网购中利用淘宝系统的规则恶意申请退款的行为。对于吴某网购恶意申请退款行为的刑法定性,理论上出现了四种观点:盗窃罪、侵占罪、诈骗罪与合同诈骗罪。该案之所以复杂是因为涉及第三方支付平台和购物系统智能化,导致对沉淀资金的权属和占有以及购物系统默认自动退款行为等问题的理解存在较大分歧,对此,应当正确厘清这些问题,从而将吴某的行为认定为盗窃罪。     

电视频道的专业化与节目的本土化

电视观众分众化的趋势,要求电视节目必须对象化,于是,频道专业化应运而生。而节目内容的本土化,是电视媒体发展到一定阶段,最大限度满足观众需求,在市场竞争中赢得主动的必然产物。这两方面的变革,给处在夹缝中的地方电视台提供了难得的发展机遇。各地方电视台要以频道专业化为契机,更新节目生产、编播观念,改变原来综合频道千台一面的模式,对节目进行本土化运营。     

电视节目保护方式的有效性论证

电视节目之间的抄袭已成为一种社会现象,需要法律在其保护方式上予以回应。如果将电视节目模板视为作品,由模板到节目既不是著作权法上的复制,又不符合演绎忠于原作的义理,所以保护模板并非保护电视节目的有效方式。如果将电视节目视为试听作品,由于节目使用不同主题人物和主持人即可呈现不同的试听效果,所以依据著作权侵权三步法和第三方测试都很难阻碍电视节目之间的抄袭和题材雷同。即使寻求反不正当竞争保护,其为电视节目提供的庇护也非常有限。新鲜性和即时性是电视节目的灵魂,除雷同和剽窃者外,应允许电视节目之间相互学习和模仿。     

Context from a social semiotic perspective: a discourse analytical study of the children TV show,Bubble Guppies

In mainstream linguistics, context is either entirely ignored or dominantly viewed as an objective property of the external world. For instance, in sociolinguistics or pragmatics, scholars frequently attempt to learn about the meaning of words or sentences given certain social context. The social semiotic method presented in this paper challenges the objectivity of context and explores the dynamic between content and context from the perspective of Peircian semiotics. An episode of a children animations series, Bubble Guppies, where human-like mermaids learn about the mysteries of ancient Egypt, is used as a point of departure to show that content and context recursively co-construct with viewers’ participation. For instance, while there is little physical similarity between where the Guppies meet in the show’s story and a typical classroom, the context of a classroom is clearly established through the way the Guppies interact with each other and with objects they encounter. Additionally, the results indicate that learning is an important product of such context-construction, as TV viewers must constantly elaborate on events and link interactions that are perceived not as objects but as signs entangled in a growing web of symbolic system.

法制新闻在上个世纪末到本世纪初的最近几年才成为新闻学的一个新的分支学科,而这种新产生体系的不完整性,导致了各种不规范现象大量存在于法制新闻的报道中,其主要的是客观最大化和视觉冲击力间的矛盾.不同媒介的不同表现形式,所表现出来的矛盾形态也有所不同,从平衡两者之间的目的出发,应该从新闻标题的制作、正文的撰写、与电视节目特有的影像制作等方面,解决法制新闻中客观最大化和视觉冲击力之间的矛盾.     

论20世纪上半期的英国女性休闲活动

英国在20世纪初进入了消费社会阶段,英国女性的休闲活动在这一时期得到了迅猛的发展。英国女性的休闲活动主要有三种类型:购物型休闲、旅游型休闲和体育运动型休闲。英国女性休闲活动的迅猛发展,充分表明了英国女性社会地位的提高和自身一定程度的解放,但是,我们不能对这一时期英国女性的解放估计过高。     

美国对跨国并购融资中滥用税收协定的管制措施及评析

针对跨国并购融资中滥用税收协定行为,在美国,可适用国内法层面的反导管原则与国际法层面的管制措施——双边税收协定中透视法、渠道法条款来管制。国内法层面的反导管原则从规范具体交易的角度,而国际法层面的管制措施则从规范可获得税收协定利益的适格主体角度,两者形成一股强大的合力,可对跨国并购中导管融资安排施加有效管制。中国目前尚未在国内税法中制定反导管规则,美国立法例值得中国借鉴。     

The Impact of Television in Bulgaria on the Electoral Process and Voting Behavior

After 45 years of communism, Bulgaria held its first democratic elections in May 1990, following an interparty coup that had ended the totalitarian rule in November 1989. A new Bulgarian Constitution was adopted in 1991. During the following years of transition to democracy, a normal political environment was gradually established. Among the major achievements during this period were that the country joined NATO in spring 2004 and entered the European Union in January 2007. During this period of transition to a democratic political system and marketplace economy, the processes of decentralization, liberalization, and privatization led to a completely new media landscape with strong social impact. The past two decades have witnessed five presidential (1992, 1996, 2001, 2006, and 2011), seven parliamentary (1990, 1991, 1994, 1997, 2001, 2005, and 2009), six local (1991, 1995, 1999, 2003, 2007, and 2011), and two European parliamentary elections (2007 and 2009) and the appointment of twelve governments in Bulgaria. The main objective of the proposed paper is to present the impact of media and, in particular, of television on the democratization developments in the country.
