ABSTRACT

The political instability that has characterised Sudanese politics since independence is attributable to political exclusion, economic neglect and marginalisation. Discrimination based on religion, language and culture has constituted the main contradictions between the masses of the Sudanese people (periphery) and the politically dominant Arabised Nubians (centre) in all the different politico-ideological hues experienced by the nation. Attempts to resolve this contradiction have left the structural imbalances inherited from the colonial administration of the Sudan intact. This explains the resurgence of war, particularly in Southern Sudan. The recent peace agreements between the National Congress Party (NCP), namely the Comprehensive Peace Agreement (CPA) with the Sudan People's Liberation Movement/Army (SPLM/A); the Darfur Peace Agreement with the Sudanese Liberation Movement (SLM) (Minawi); the Cairo Agreement with the National Democratic Alliance and the Eastern Sudan Peace Agreement with the Eastern Sudan Front, have left the NCP still in firm control of the oppressive state machinery. The CPA power-sharing protocol awarded the NCP a majority which institutionalises a power asymmetry that the NCP utilises to obstruct implementation of the CPA and delay the process of democratic transformation.

This article analyses the asymmetry in the NCP–SPLM partnership and power relationship. It assumes that the tragic death of Dr. John Garang de Mabior is a major cause of the political weakness demonstrated by the SPLM since 2005. This power imbalance jeopardises the CPA implementation and the future of the Sudan as a state.  相似文献

In this study, I examine how the local news media covered members of Congress tied to the Jack Abramoff scandal during the 2006 congressional elections. Previous research suggests heavy coverage of any politicians tied to scandals, particularly during the campaign season. Using a multilevel data analysis approach, I show the local news media strategically considered whether to cover members under suspicion of scandal during the election season taking into account race competitiveness and challengers’ actions. Specifically, local newspapers paid the most attention to the Abramoff scandal when the incumbent was in a competitive race and the challenger was actively pushing the scandal.  相似文献

实证调查表明,代表人诉讼制度不是法院处理群体纠纷案件的唯一方式。当事人人数多少及其相互关系、案件类型、审判成本、外部压力等都是影响法院处理群体纠纷方式的因素。代表人诉讼制度设计存在明显缺陷,导致这个在理论上和立法上被赋予高度期待的制度在实际运作中遭遇重重障碍,群体纠纷案件处理结果成为多方力量博弈的产物。该制度的缺陷提醒我们:法治建设过程中不能抛开国外法律制度产生的特定历史背景、文化基础和制度环境,简单化理解,甚至曲解他国立法,"为我所用"式地盲目借鉴。  相似文献

This article asks whether legislators are able to reap electoral benefits from opposing their party on one or more high‐profile issues. Using data from a national survey in which citizens are asked their own positions on seven high‐profile issues voted on by the U.S. Senate, as well as how they believe their state's two senators have voted on these issues, I find that senators generally do not benefit from voting against their party. Specifically, when a senator deviates from her party, the vast majority of out‐partisans nonetheless persist in believing that the senator voted with her party anyhow; and while the small minority of out‐partisans who are aware of her deviation are indeed more likely to approve of and vote for such a senator, there are simply too few of these correctly informed citizens for it to make a meaningful difference for the senator's overall support.  相似文献

Since the “Divorce Challenge” in the Netherlands, a lot of initiatives have been taken on a political level, from the judiciary and in practice, to improve the situation for children of separation. Experimental legislation is on its way to enable the development of new court procedures. One of its ideas is to introduce a so‐called family's representative. This new professional, a lawyer or mediator, can represent both parents in court or coordinate the entire divorce process, both before and after the court procedure.  相似文献

健全宪法实施与监督制度是实现依宪治国的关键。宪法的实施首先是政治实施,宪法的法律实施也主要强调的是宪法对部门法实施的根本依据,而并非在司法判决中具体直接适用。宪法司法化并不是我国完善宪法实施与监督制度的应然路径。全国人民代表大会及其常务委员会是我国宪法实施与监督的机关,应该予以坚持。党的十九大报告指出,要完善合宪性审查,这意味着应加快在全国全国人民代表大会内部进行完善宪法实施与监督的专门机构的建设。  相似文献
