知识产权与标准全方位交织,即标准本体与著作权的交织、标准内容与专利权的交织、标准执行与商标权的交织。知识产权竞争策略的需要、标准对先进性与技术性的追求、标准本体需要受知识产权的保护以及标准执行需要监督的要求产生了知识产权与标准交织。知识产权与标准的交织引发了两者间的紧张关系,标准与著作权的交织产生了纳入法律的标准著作权与可获得性的紧张关系,标准与专利权的交织导致了标准必要专利权人滥用专利权的问题,标准与商标权的交织暴露了我国认证认可制度的法律供应不足的问题。     

高铁隧道内气动效应形成损坏痕迹特点分析

动车高速通过隧道时,运行车体推动的空气由于受到隧道壁的约束能形成能量很强的冲击气流,有时会造成一些设备设施损坏、脱落,进而危及高铁行车安全。这类事件发生后,铁路部门往往误以为是人为破坏,并以破坏案件进行上报。本文通过对特定动车行车事故的现场勘验、调查访问,分析了高铁隧道内气动效应对特殊位置设施造成损坏的过程及形成痕迹特点,准确认定了事件性质和事故发生原因,并对气动效应形成损坏痕迹和常见工具形成痕迹的区别进行了探讨。     

It Takes a Coalition: The Community Impacts of Collaboration

Members of Congress frequently collaborate on policy initiatives, reaching out to colleagues in both parties to find common ground on solutions for the problems faced by their constituents. Using a novel dataset of over 30,000 “Dear Colleague” letters sent by members of the 111th Congress, I use the collaborative relationships that exist in the earliest stages of the policy process to measure the social influence of legislators. I demonstrate that districts represented by members of Congress who are better connected to their colleagues receive a greater share of federal grant money. I argue that this is because collaborative legislators are well‐positioned to be influential allies to strategic bureaucrats who want to maintain a broad base of support for their programs in Congress. Thus, devoting resources to building relationships with their colleagues is one way members of Congress can more effectively support the communities they represent.     

Do volatile voters vote less correctly? An analysis of correct voting among vote (intention) switchers in US presidential election campaigns

The literature on electoral volatility and the literature on electoral campaigns hold contradictory views on voters switching vote (intention) during the campaign. In this note, we shed new light on this contradiction, making two contributions. First, we investigate the extent to which stable and volatile voters choose the correct party. Second, we distinguish levels of correct voting and the impact of the act of switching on the correctness of the vote. Our analyses of vote-switching in American elections show that, while volatile voters are less likely to vote correctly, they are more likely to switch from an incorrect to the correct party than vice versa. Furthermore, we show that following the campaign more closely makes voters more likely to switch vote (intention) towards the correct party.     

Small arms and light weapons: the disjunction problem

ABSTRACT

Growing in range and urgency, humanitarian needs now pose increasingly acute questions for national security policy formulation. Whether over forced migration, food scarcity or nefarious electronic penetration, state security preferences face uneasy accommodations with individual needs be it for child survival, basic sustenance or rights to privacy. This paper deliberates a further field of increasingly apparent value contest: that involving the transfer, diversion and lethal use of small arms and light weapons (SALW). After outlining the scale of this phenomenon, existing regulatory mechanisms over SALW transfers are assessed. It is argued that these controls are inadequate, a deficiency that is embedded within a range of inter-linked disjunctions. They are outlined in a model that is evaluated against empirical findings. Where SALW control inadequacy is causally connected to the disjunctive model, it is argued, current levels of SALW-induced casualties are unlikely to abate. The paper concludes by considering feasible options for enhanced management of global SALW proliferation.     

上海租界外人眼中的中国民族主义

本文主要根据上海公共租界职员郭泰纳夫的两部代表作,利用中华民族对立面的观察角度,对中国现代民族主义的兴起和演变作了初步的追溯,认为从19世纪70年代以来,随着上海租界制度的扩展,首先在中国官员、绅商中萌发出了公开的不满情绪,并不可阻遏的日益发展;第一次世界大战结束后中国政府向巴黎和会提出的《希望条件说帖》,第一次锋芒直指外人在华特权,得到了普遍的拥护;此后,国共两党均成为民族主义的热情鼓动者,并迅速获得了最广泛的民意支持;1925年的五卅运动的根本原因,就是中华民族前所未有的自信。中国共产党的反帝纲领,道出了近代以来中华民族的心声。     

肌肉电导率和pH两指标联用推断死亡时间

目的探讨肌肉浸渍液电导率(electrical conductivity,EC)、pH两指标联用在PMI推断上的意义。方法 SD大鼠处死后,保存在25℃环境中,于不同PMI提取大鼠后肢肌肉制备匀浆液,测定浸渍液EC和pH。分析EC、pH两指标联合使用推断PMI的意义。结果 EC、pH两指标随PMI均呈现阶段性变化:1d内,pH明显下降,EC无明显变化;2~3d,EC、pH均快速增大;4~10d,EC继续增大,而pH变化不明显。EC、pH联合使用,有助于划分PMI时段,以及特定时段内指标的优化:1d内,选择pH最佳,2~3d,EC、pH联用最佳,4~10d,选择EC最佳。结论 EC、pH联用有助于提高PMI推断的准确性。

党的十八大报告是新的历史起点上继续发展中国特色社会主义的政治宣言和行动纲领,更是指导我国新时期思想政治教育工作的重要文献.它的理论意义在于深化了思想政治教育学科的指导思想与时代内涵,而它的实践意义则在于拓展了思想政治教育的载体和创新了思想政治教育工作的实践路径.     

试析中国的政治稳定问题

政治稳定与否,关系着国计民生,关系着一个国家在国际上的地位,更关系着本国国民的幸福生活和前途。我国的政治稳定将依法治国作为总方略,将以人为本与发展作为其核心理念和关键点。为了寻求保持我国政治稳定的路径,必须要从党的建设、政府职能的优化和完善以及文化建设的角度进行把握。     

保障当事人诉讼权利的基本课题

在司法文明指数报告中,考察当事人诉讼权利的基本思路,包括设计二级指标和测试题目两方面内容。通过分析指数报告,可以发现当事人诉讼权利的保障情况总体不佳。保障当事人诉讼权利,应当强调发挥法院的作用;而未来改革的基本课题,包括如何防止权力主体滥用自由裁量权,以及如何为权力主体依法行使职权提供必要的外部保障。
