"道"与"一"

道家的“道”在中国哲学史上有如西方哲学史上柏拉图的“理念” ,具有重要地位。然而对道的含义之理解却始终充满歧义和困难。本文试图另辟蹊径 ,从道家经典文本中常用的“一”字入手 ,通过对其用法与含义的分析和解释 ,实现对道观念的全新阐释。     

September 11th and U.S. Hegemony—Or Will the 21st Century Be American Too?

The tragedy of September 11 highlights the stark contrast between the real and measurable capabilities possessed by one state, and the almost inevitable resentments which the possession of those capabilities engendered in others. The purpose of this article is not to interrogate the strengths and weaknesses of arguments of American decline. Nor is it to speculate at length about September 11th. It is instead to set the scene and try and identify the underlying causes of America's transition from presumed crisis in the 1970s and 1980s to new self-confidence in the 1990s—a self-confidence that some now feel has been shattered by the events of September. While there were important structural reasons why the United States was unlikely to go the way of other powers, it was a peculiar conjuncture of mainly unforeseen developments that combined together after 1989 to improve the U.S. position within the world. We will then move on to discuss the most effective way of characterizing this position. Here, we will mount a defense of the somewhat contentious notion of "hegemony" While recognizing the problems associated with the idea, it will be argued that as a concept it has serious intellectual advantages over its various theoretical competitors. If nothing else, because it focuses on the American role within the world system, rather than just its statically defined position, it is theoretically more suggestive than the less dynamic idea of unipolarity.     

论弱势群体的社会经济权利

弱势群体是现实社会的客观存在。处于社会弱势地位的人群并不是社会的弃儿,他们同样是社会共同体的平等成员。对弱势群体权利的关注和保障,奠基于基本的社会价值和人性立场。在诸多权利中,对于弱势群体而言,最重要、最具实质性的是社会经济权利。     

《史记》三"书"评议

<史记>篇目问题较多,而又以"八书"为甚.学界虽然对"八书"总体的看法没有什么分歧,但有三点需要注意:其一是<史记>缺少<礼书>、<乐书>和<兵书>,八篇中就有三篇有问题;其二是对<太史公自序>的几句话该怎么理解,<律书>和<兵书>的关系应是怎样的;其三是在司马迁创作"八书"的大前提下,上述三篇中是否还有后人搀入的部分.     

Data Protection: An Opening Door?

Swedish public law has incorporated a general rule of public access to documents, and to information in the wider sense, since the Freedom of the Press Act of 1766. On the Community level, the relationship between Regulation (EC) 45/2001 on data protection and Regulation (EC) 1049/2001 on public access to documents exemplifies the tension between the public's interest in scrutinising the administration carried on in its name, and the integrity of the individual. However, a similar tension exists between Sweden's Personal Data Act of 1998, implementing Directive 95/46, and the Freedom of the Press Act. A misuse model of data protection law, by seeking to concentrate on serious rather than technical infringements of privacy, might serve to ease the tension. 宋代公无论从数量、名篇还是从作队伍来讲，都达到了登峰造极的地步，对后代产生了深远的影响。宋代公的繁荣，与其崇抑武的国策和科举考试内容的改变、科举考试取士数量的增加密切相关；同时，与人士大夫的精神和整个社会思潮的嬗变也密切相关。北宋和南宋长期存在的竞争和派系斗争，使人以论事的现象非常普遍。这对以化事、长于说理、重实轻虎的公风格的形成和对公的繁荣和发展也是不可忽视的原因。     

大型公用建筑火灾时人员应急疏散评价模型研究

应急疏散措施的优劣是评价大型公用建筑安全水平高低的重要标准之一。本文通过分析影响大型公用建筑应急疏散措施有效性的主要因素,参照相关法规及大型公用建筑应急疏散时各指标因素的层次,建立了大型公用建筑应急疏散评价模型。将该模型应用到某高校图书馆的应急疏散评价过程中,验证了模型的准确性,为建筑物火灾人员应急安全疏散提供了切实可行的参考依据。     

Managing commercial risks in open source software licensing

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. End users and resellershave to adjust their own in- and out-licensing models to accommodatethis situation.     

冠状动脉内弹力膜缺损与冠心病猝死的关系

目的探讨冠状动脉内弹力膜(IEL)病变与冠心病猝死(SCD)的关系。方法从本单位近5年尸检案例中挑选60例病例和心脏标本,分为SCD组、对照组A和B组。每例分别在冠状动脉左前降支近段取材,常规制片,HE和双重组合特殊染色,显微镜下观察冠状动脉IEL,并用图像分析技术对特殊染色的IEL进行形态定量分析。结果60例中,SCD组(男性24例,女性6例,年龄30~83岁)的冠状动脉IEL缺失明显(缺失率=41.64%),未缺失的IEL失去原有弯曲度而变平直;对照组A(冠心病非猝死者,男性13例、女性2例,年龄41~80岁)的冠状动脉IEL缺失程度较SCD组稍轻(缺失率=30.53%);对照组B(无冠心病的其他死者,男性8例,女性7例,年龄17~54岁)的冠状动脉IEL仅有轻度缺失(缺失率=15.67%),多保持原有波浪状结构。统计学分析显示,SCD组与对照组、SCD组与对照组B、对照组A与对照组B之间IEL缺损率的差异均具有极显著性意义;SCD组与对照组A在IEL缺损率上的差异有显著性意义。结论SCD与其冠状动脉IEL缺损率的大小密切相关。
