评诉讼时效司法解释中的价值趋向

2008年8月11日,《最高人民法院关于审理民事案件适用诉讼时效制度若干问题的规定》体现了督促权利人行使权利,禁止权利的滥用,以维护社会交易秩序,进而保护社会公共利益的价值趋向。此价值趋向具体表现在限定诉讼时效的适用范围,坚持诉讼时效的法定性,明确法院不得主动援引诉讼时效,放宽诉讼时效期间的起算,扩张诉讼时效障碍的适用等制度设计上。这与当前司法背景相适应,应当予以肯定。     

从“人肉搜索”现象反思校园BBS建设

网络上存在的“人肉搜索”现象主要基于互联网的发展、网民对焦点社会问题的普遍关注以及网民的各种心理动机的需要三方面因素。校园BBS在校园文化建设中具有重要地位，同时也凸现出“人肉搜索”的潜在危机问题。因此，需要从学校管理、网络监管、师生道德自律等方面来加以改进和完善。     

Case law of the EPO Boards of Appeal in 2006

Legal context: The article reviews significant decisions handed down by theBoards of Appeal of the European Patent Office (EPO) in 2006,concentrating on decisions of the Enlarged Board and the Boardsof Appeal issued in 2006 and published or to be published inthe OJ EPO. Key points: The article discusses the application of Art. 24 EPC on exclusionand objection to members of the boards of appeal in the lightof the following decisions: G 1/05, T 281/03 and J 15/04; referralspending before the EBA on the subject of divisional applications(Art. 76 EPC and R. 25 EPC) and exclusion from patentabilityunder R. 23d(c) in conjunction with Art. 53a EPC; and decisionsof technical boards of appeal on exclusions from patentability(Arts. 52 (2)(3) and (4) EPC), the requirement of industrialapplicability (Art. 57 EPC) and re-establishment of rights (Art.122 EPC). Practical significance: The article provides an overview of the 2006 case law of theboards of appeal which is particularly useful since most ofthe decisions discussed have not yet been published in the OJEPO. The author is critical of the recent case law on the applicationof Art. 24 EPC (exclusion and objection to members of the boardsof appeal) and reports on several decisions of particular legalinterest.     

优先：刑事被害人权益保护的理念重塑

以往刑法学、犯罪学理论由于将＂国家权益＂或＂被告人权益＂等诸多权益凌驾于＂被害人权益＂之上产生的悖论在现实表明：被害人权益保护的地位未得到合理的重视。或者说,在诸多权益权衡之间,被害人权益总是不得不让位于其他权益,然而只有被害人权益保护才是刑事法治中具有终极意义的根本正义。因此,在出现被害人权益与其他权益出现冲突的情况下,必须坚持被害人权益保护的实质优先性,实现最初的人本关怀。     

新农村建设中的社会和谐问题研究(下)

新农村建设必须以科学发展观为指针,建立和完善政府的服务、管理和科学决策体制;以提升农民的生活质量为出发点,构建农村物质和精神文明体系;建立城乡之间的和谐共荣,消除制度上的不平等和贫富差距,从根本上实现城乡之间的心理和情感和谐;以教育为中心,加强人的建设,着重提升农民的文明程度,实现两个和谐。     

大学生沉溺网络现象分析

网络沉溺现象有着复杂的因果关系,从发展心理学角度分析,包括角色同一性认知缺失、亲密感建立不完善、自我意识发展中的个人辩证分析失衡和人生价值观不成熟等众多因素。从发展的角度分析,大学生网络沉溺现象的发生不是单一大学阶段教育的问题,而是大学生在个体发展中长期存在不可调和矛盾的集中爆发,因此,要减少或避免大学生沉溺网络,从未进大学抓起。

2006年的中国权利研究,著述颇丰,学术研讨频率密集且范围广泛,呈现了多元化、立体化的趋势。人权研究生机勃勃,平等权是当下社会生活和权利研究中的一个关键词,农民、农民工等弱势群体的权利保护则是与平等权密切相关的热点问题。传统的权利研究继续深入,新兴权利的研究与日俱增,权利本位理论正在向现实论证扩展,有关权利的理论日益丰满。     

Educational Competency as an Indicator of Occupational Stress for Probation and Parole Officers

Probation and parole officers are assigned the responsibility of supervising convicted criminals in a community setting in such a way that the competing goals of punishment, public safety, offender rehabilitation, and deterrence are achieved. All the while, these tasks are accomplished within the confines of shrinking budgets, large case loads, increasingly high-risk offenders, low occupational prestige, and considerable political and public scrutiny. These competing demands often result in especially high levels of work-related stress. The point of this research is to consider the divergence in occupational stress among probation/parole officers and whether or not they felt educationally prepared for their job. The data for this study were collected during a two-month study period which began on March 15, 2005. Data were collected non-randomly through a national Internet based survey of active probation/parole officers. This study considers a sub-sample of 2, 364 officers from fifteen states. The results show probation/parole officers who feel educationally under-prepared are likely to experience higher levels of occupational stress and more likely to have negative manifestations of stress than those officers who feel well-prepared.

强化农村社会管理推动新农村建设

党的十七届三中会会明确提出：要完善农村社会管理体制机制，保持农村社会长期和谐稳定。近年来，山东省在这方面进行了积极地探索。社会主义新农村的构建离不开强有力的农村社会管理。提高农村社会管理水平需要在发挥政府作用、建立制度和机制等方面做出努力。
