在探究商业秘密保护制度的形成及发展进程方面,国外及国内的许多学者与法官曾先后提出了调整商业秘密关系的诸多理论,它们对当代商业秘密保护制度的建立与完善起到了巨大促进作用,然而,在这些众多的理论中,最能准确把握商业秘密特征,对西方国家商业秘密法律制度的形成最具影响力的则当属商业秘密的"财产权理论"和"保密关系理论"。深入考察保密关系学说和财产权论的形成及发展轨迹,将有助于了解目前英美及其他国家商业秘密保护制度。     

略论事实劳动关系

在我们现实生活中,存在着大量的劳动者实际上向用人单位提供了有偿劳动却欠缺书面合同的情形,对此种不规范劳动关系,原劳动部使用了“事实劳动关系”这个概念作为调整的依据,这一概念得到了学界和司法界的广泛认可。     

THE IMPACT OF RACIALLY INCLUSIVE SCHOOLING ON ADULT INCARCERATION RATES AMONG U.S. COHORTS OF AFRICAN AMERICANS AND WHITES SINCE 1930*

Despite the substantial body of research on the psychological and social effects of racial segregation in schools on African Americans, few studies have considered the possibility that more racially inclusive schools might reduce the risk of extremely negative adult life experiences such as incarceration. Yet such a connection is made plausible by research linking black racial isolation in schools to variables that are often associated with incarceration rates, including concentrated poverty, and low educational and occupational aspirations and attainment. In this paper, we apply methods first developed by labor economists to assess the impact of racial inclusiveness in schools on individual incarceration rates for 5‐year cohorts of African Americans and whites born since 1930. We find strong support for the conclusion that blacks educated in states where a higher proportion of their classmates were white experienced significantly lower incarceration rates as adults. Moreover, our analysis suggests that the effects of racial inclusiveness on black incarceration rates have grown stronger over time. These longitudinal effects are consistent with the argument that the educational climate of predominantly black schools has deteriorated in more recent decades.     

Analyzing Multiple-Item Measures of Crime and Deviance I: Item Response Theory Scaling

Multiple-item measures of self-reported offending typically provide the principal outcome measures for individual level research on the causes of crime and deviance. This article directs attention to the substantial problems presented by the task of forming composite scores for these measures, and it presents a possible solution to those problems. We consider scaling by means of the graded response model from item response theory (IRT) as a potential means of overcoming the shortcomings of traditional summative scaling and of obtaining valuable information about the strengths and weaknesses of our measures. We illustrate this strategy through a scale analysis of a fourteen-item, self-report measure of delinquency, using three years of data from the Monitoring the Future study, an annual national survey of high school seniors. The graded response model proves to be consistent with the data, and it provides results that address important substantive questions about self-report measures. The findings are informative about the strengths and weaknesses of alternative strategies for developing self-report instruments, indicating that there is little to be gained by making fine distinctions in the frequency of individual delinquent acts.     

需罚性在犯罪论体系中的功能与定位

作为对我国近年来发生争议的热点案件的一个理论回应,需罚性在犯罪论体系中的功能与定位被提出。我国目前的犯罪论体系均是以应罚性为中心展开的,缺乏对需罚性的判断,从而带来严重的理论与实践困境。犯罪论体系须认真对待刑法体系内的应罚性与刑法体系外的需罚性。从理论上,需罚性就是从刑事政策或宪法上判断有无刑罚处罚的必要性,是以预防的必要性为理论根据架设起刑事政策或宪法与刑法体系之间的桥梁,具有兼顾体系正义与个案正义的合目的性。同时,将需罚性导入我国犯罪论体系具有立法与司法基础,与我国实定法之间具有融贯性。我国应当建构应罚性与需罚性并重的犯罪论体系。     

Comparative Politics and the Synthetic Control Method

In recent years, a widespread consensus has emerged about the necessity of establishing bridges between quantitative and qualitative approaches to empirical research in political science. In this article, we discuss the use of the synthetic control method as a way to bridge the quantitative/qualitative divide in comparative politics. The synthetic control method provides a systematic way to choose comparison units in comparative case studies. This systematization opens the door to precise quantitative inference in small‐sample comparative studies, without precluding the application of qualitative approaches. Borrowing the expression from Sidney Tarrow, the synthetic control method allows researchers to put “qualitative flesh on quantitative bones.” We illustrate the main ideas behind the synthetic control method by estimating the economic impact of the 1990 German reunification on West Germany.     

Why me? An autoethnographic account of the bizarre logic of counterterrorism

The core concern of this article is derived from my personal experience of being stopped and questioned at Heathrow Airport on 28 March 2012 for possession of “suspect materials”: academic books on terrorism. I seek to utilise this experience to reflect on how logics of counterterrorism can become manifested in bizarre and prejudicial ways, and how autoethnography provides a unique means to articulate human experiences of such logics. I further utilise my experience to reflect on the dynamics of academic privilege, which often flourish at the expense of the voices of “ordinary citizens”, and argue that autoethnography can be embraced as an empowering form of self-expression through which “ordinary citizens” might de-subjugate themselves from the margins of academia towards an emancipatory ideal wherein the lived experiences of such citizens occupy a substantial space in academic and popular understandings of (counter)terrorism.

美国内幕交易归责理论研究

美国在证券法的发展演变过程中 ,结合证券法中公开、公平、公正、效率的基本原则以及秩序、正义、诚信的一般法律理念 ,提出了禁止、制裁内幕交易所必须遵循的依据 ,逐步形成了系统的内幕交易归责理论 ,包括平等享有信息理论、受托义务理论、信息泄露理论、非法盗用理论。现在 ,受托义务理论及盗用理论等已被世界上绝大多数国家的证券法采纳为内幕交易的归责理论 ,反映了全球性的主张公平、有效地传播信息的观点已取代了以市场为中心的内幕交易观点     

云南高校女性学学科建设的本土化尝试
