涉及商业秘密的政府信息公开问题初探

涉及商业秘密的政府信息是法定的公开例外种类之一。与涉及国家秘密的政府信息属于强制例外不同,涉及商业秘密的政府信息,行政机关具有部分自由裁量权。然而,由于缺乏对“商业秘密”、“公共利益”等要件的界定,同时也没有明确行政机关对此类政府信息的审查程序,因此,在实践中存在较大争议,有必要对政府信息公开语境下的商业秘密界定、公开程序的操作设想以及此类信息中的可分割性原则的适用等问题进行研究。     

论交通民警执勤执法时的安全防护措施

近年来,全国交通民警在执勤过程中因公牺牲的案件每年都有发生,究其原因,虽然有道路环境和车辆驾驶员严重违法行为方面的因素,但主要还是与民警自身安全防护意识不强、安全防护措施不到位有关。本文在分析交通民警执勤时发生安全问题原因的基础上,主要论述了在日常执勤、勘查事故现场、渠化分流车辆、执行堵截任务等四种情况下交通民警应采取的安全防护措施。     

加强云南公安信息化工作的思考

随着公安工作的不断发展,我省公安信息化工作取得了长足进步,但所面临的形势依然严峻,存在的问题亟待解决:一是要切实提高对加强公安信息化重要性和必要性的认识;二是要理清工作思路,找准工作目标和明确基本原则;三是要坚持以应用为核心全力推动全警应用;四是要坚持采集和整合两手抓,推进信息资源大扩容和全警共享;五是要以应用为导向稳步推进重点项目建设;六是要落实各项保障措施,加强保障工作机制建设。
