日本行政法学理构造的变革——以行政过程论为观察视角

日本战后的行政法学大体经历了两个发展阶段,第一个阶段(1960—1980年)是在批判公私法二元论的基础上重构行政法解释学,第二个阶段(1990年至今)是在反思行政法总论功能定位的基础上探索与其它学科的交流与融合。而行政过程论在这两个阶段当中发挥了承前启后的重要作用。     

A dilemma for the welfare state: managing the cost for shorter working hours, 1919–2002

The purpose of this article is to study how the Swedish welfare state has managed the cost of shorter working hours. During the twentieth century, several official reports were published in order to produce knowledge about this issue and to deal with the cost for the reform. This article aims to examine the arguments and beliefs of the political economy of the welfare state that emerge from these formulations. An examination of shorter working hours as social policy sheds new light on the relationship between the welfare state and capital, in addition to limits for social policy imposed by the economic system. A reduction of work hours has never been justified as a reform that simply gives more time for leisure and less time for work, but has been assigned a cost that was necessary to manage. The reform was considered possible because it was interpreted as helping to reproduce labor power or capitalism as a whole. It was thought impossible and undesirable when considered to be a threat to this reproduction. This article shows the process of managing the cost for shorter working hours in Sweden and how arguments fundamentally changed over time, although the basic premises remained the same.     

加工速度、工作记忆与心算能力的发展

以243名10-18岁儿童为被试,研究了加工速度和工作记忆与儿童心算能力发展的关系.验证性因素分析表明,加工速度、工作记忆与心算能力之间存在显著的相关.结构方程建模表明这种显著相关的实质在于三者之间可能存在一个递进式发展过程,即工作记忆能力几乎可完全解释儿童心算能力的发展变化,而加工速度可解释2/3的工作记忆能力的发展变化.这表明工作记忆是心算能力发展的基础,而加工速度可能是工作记忆能力发展的基础,但后者尚需要进一步验证.     

Municipalities’ willingness to adopt process innovations: evidence for higher cost-efficiency

In the public sector, innovation is understood as a major driver of public service performance improvement and excellence. On the one hand, previous research has proven a positive effect of innovation adoption on performance in the public sector. On the other hand, a broad literature proves positive effects of innovation antecedents on innovation adoption. This study bridges this gap and analyses the effect of an innovation antecedent – willingness to adopt a process innovation (accrual accounting) – on municipalities’ service provision cost-efficiency. Therefore, the author makes use of a panel data set of German municipalities, located in the federal state of North Rhine-Westphalia. Evidence shows that a higher municipal willingness to innovate relates to higher cost-efficiency. A higher innovation willingness might have a maximal effect of 17 percentage points on municipality cost-efficiency.     

Commentary on Interdisciplinary Teamwork in Family Law Practice

This commentary discusses and expands upon Mosten and Traumm's extraordinary work on interdisciplinary teams. Focusing on the continuum between independence and interdependence in team formation, we explore the benefits of team members' shared responsibility and highlight potential challenges. We emphasize that regardless of where a team may fall on the continuum, establishing and adhering to a strong structure results in increased practitioner satisfaction and better client outcomes. This commentary identifies five best practices that promote highly functioning teams and urges family law practitioners to seek more advanced interdisciplinary team training opportunities.     

Research and Higher Education: UK as International Star and Closet European?

The research and higher education sectors have an exemplary place in the referendum debate. They were not part of the David Cameron renegotiation package, but stakeholders in favour of Remain have disrupted the consensus that in these sectors the EU's role is relatively unimportant and that the UK's achievements can be explained in national terms. The article seeks to explain, first, the change in political dynamics that has brought the EU connections out of the shadows in these sectors, and second, what these sectors risk losing by Brexit. It suggests that the campaign has made the case for a causal relationship between the UK's higher education and research achievements and its global reach and has shown how these sectoral policies are embedded in the EU's foundational principles of freedom of movement and non‐discrimination. There are also signs that EU membership may come to matter to students, a politically important group, for reasons which range from freedom of movement to conflict prevention. 1
