录音技术训练课教学应强调在学生掌握课本理论知识的同时,还须学会专业操作,以培养学生的动手能力,使学生在实践操作中消化专业理论。

偷税罪是我国税收犯罪中最常见的犯罪,此类犯罪严重破坏了我国经济的发展,为了预防和打击此类犯罪,我国刑法对偷税罪犯罪构成作出了明确的规定。在司法实践中要认真分析偷税罪的犯罪构成,把握偷税罪的主客观要件,并综合考虑案件的具体情况,对案件作出正确的认定和处理。     

“法律”概念是怎样被使用的——在中西近代日常话语实践的交流中比较考察

在特定的近代中西交往时期里,参与交往的主体的“法律”概念的使用,不可避免地是“策略”性、“目的”性的,而非“一般语言化”的。在这一特定时期里,交往中的“法律”概念的涵义表达是具体语境化的、而非“中西对立”化的。在区分“法律”概念的“感性使用”和“探讨使用”的条件下,这一时期的“法律”概念使用,从某种角度暗示着从近代演化而来的现代及当代法律话语实践本身的相对自主的发展道路,在和近现代政治经济相互纠缠的过程中,甚至在融入近现代政治经济的过程中,中国近现代法律实践反而在一些基本方面依然可以是“独立”的。于是,发现一个认识历史的“法律行动者”的视角是必要的。

“异化观念”与“固执观念”批判:马克思意识形态思想的雏形

马克思在1844年厘清了"意识""观念"与"现实生活"的差异,并将前者作为概念的本身来阐述。在此基础上,他说明了意识形态形成的"实践"环节,并透过对"意识"与"观念"的表述,首次在意识形态视阈下阐释了"生活决定意识"的原理。马克思对"观念"的使用包含两种语境:"一般"观念及"具体"观念。在《1844年经济学哲学手稿》中,他指出在资本主义生产条件下人的(一般)"观念"如何因"异化劳动"而产生了虚假性质。在《神圣家族》中,马克思分析青年黑格尔派的哲学观如何成为(具体)"固执观念",因其颠倒逻辑、误解实践意涵之故,从而导致观念的虚假性。通过对异化观念与固执观念的分析,马克思开启了对意识形态的初步认识。     

Europe under occupation: the European diplomatic community of practice in the Jerusalem area

ABSTRACT

This article shows how the existence of a community of European practitioners in the Jerusalem area gives substance to the European stance on the Israeli–Palestinian conflict. The often-stated European Union (EU) support for a two-state solution could appear meaningless in the absence of peace negotiations. However, European diplomats (i.e. diplomats of EU member states and EU officials) in the East Jerusalem–Ramallah area are committed to specific practices of political resistance to Israeli occupation and recognition of Palestinian institutions. These practices have led not only to a specific political geography of diplomacy, but also to a community of practice, composed of European diplomats and based on their daily experience of resisting occupation and bestowing recognition. It is this group of officials who represent and actively “do” Europe’s position and under occupation.

One lawyer acting for two clients: implications arising from an experimental practice model ‘Family Matters’

The legal services market has faced unprecedented change following implementation of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO). Alternative business models and wider use of digital technologies have developed alongside debates about the future of legal practice in family law. Arguments have been made for new hybrid models that combine legal advice with mediation and for solicitors to be enabled to work with two clients. This paper contributes to that debate by highlighting implications for such practice innovations based on research evidence of solicitors’ experiences of delivering an experimental model of practice: ‘Family Matters Guides’. This model, piloted by Resolution, involved the Guides providing intensive support and legal information (not legal advice) to both separating parents to help them reach agreements. This paper is timely as the professions await the new regulations from the Solicitors Regulation Authority (autumn 2018) making flexible practice models a reality.

经过60多年的发展,新加坡已建立起以儿童福利为导向的少年司法制度。在借鉴普通法系国家少年司法立法与实践的基础上,新加坡少年司法逐步形成了具有本土特色的体系与结构,并在未成年人保护与未成年人犯罪矫正上发挥着愈来愈重要的作用。其某些做法可为我国时下的少年司法改革提供一些难得的域外借鉴素材。
