Internet mediated crimes and theoretical approaches

Purpose: in the literature, the term ‘Internet crime’ has been coined to indicate the scenario in which a victim of homicide or other crimes is met through a chat room, and lured to death at the hands of the murderer. Various criticisms have been made of this new concept, on the grounds that the outcome is no different from that of other crimes committed without the use of Web resources, and so the method used has no particular influence. Indeed, it has been claimed that informatic crime just reflects a technological change in the nature of crime rather than a new form of criminal behavior attributable to the use of the Internet for criminal purposes. Method: our reflections were prompted by our experience as expert forensic psychiatry witnesses in three cases in which the aggressors had confessed to having had an exclusively virtual relationship with the victims, in which they spent a lot of time daily in a chat room. Conclusion: this scenario offers points for reflection on the nature of Web-mediated victim–aggressor interactions, to assess the effects on the planning and commission of the crime. Discussion. it’s our opinion that there really is such a thing as Internet-correlated crime, because in this case the quality and quantity of the Internet interactions progressively altered the men’s perception of the real relationship between themself and their victims.     

Recidivist criminal behaviour and executive functions: a comparative study

This study sought to analyse the relation between executive functions and criminal recidivism. We assessed a set of cognitive abilities associated with executive functioning in a group of recidivist offenders (n = 19), primary offenders (n = 25) and non-offenders (n = 30). Our results, tested with nonparametric statistics and Monte Carlo method, revealed that there were no executive differences between both groups of offenders but, when compared with non-offenders, the recidivists showed a worse performance in Trail Making Test part B, and the primary offenders presented a significant lower score on Porteus Maze Test Age score. This study suggests that there can be a different pattern of executive functioning deficits associated with the offenders’ criminal record: recidivism may be more related to mental flexibility impairments and primary offenders’ antisocial behaviour may be aggravated by planning deficits.

A Comparison of Men and Women Arrested for Domestic Violence: Who Presents the Greater Threat?

Recent increases in the number of women arrested for domestic violence raise important questions about implementation of proarrest policies, equivalency of intimate partner aggression across genders, and management of female domestic violence offenders. This study compares demographic characteristics, criminal history variables, and the past domestic violence history of men (n = 5,578) and women (n = 1,126) arrested for domestic assault against a heterosexual intimate partner. Using victim reported information and data collected by local criminal justice agencies, we found that female arrestees were significantly less likely than males to have histories that warrant concern regarding the potential for future violence. Implications of these findings are discussed.

DOMESTIC VIOLENCE,DOVE, AND DIVORCE MEDIATION

The primary objective of this article is to describe DOVE, a 19‐item instrument designed to assess and manage the risk of domestic violence between partners during and following their participation in divorce mediation. Assessing risk, more specifically how DOVE can be used to assess risk, is described first. The resulting risk scores (TOTDOVE) are used to assign individuals to risk categories. Problems associated with using categorical, frequency, and probability risk assessment formats in interpreting and communicating risk are discussed in the second segment of the article. A dual, categorical/probability format is advocated. Managing risk using Safety Plan interventions that are linked with risk category and predictor subscores on control, substance abuse, anger, relationship problems, mental health problems, and conflict is covered in the final segment.

1968年美国通过的<综合控制犯罪和街道安全法>对通讯监听的条件、程序、方式及被告人的权利保护等问题做出了规定,以实现有效执行法律和保护公民个人权利之间的平衡."9·11"恐怖袭击事件后,美国先后出台了<爱国者法案>、<外国情报监视法>修正案,以加强情报搜集工作,提高反恐和打击犯罪的能力.这个立法过程漫长曲折,在立法技术上也表现出严格限制和灵活处置的两面性,对我国相关领域的立法具有很强的借鉴意义和参考价值.
