领导干部“主动辞职”现象研究

文章对领导干部“主动辞职”现象进行了探讨,认为这种现象引发社会注目有“主动辞职”行为的超前性、彻底性、趋利性和群体的特殊性四方面的原因;产生“主动辞职”行为有行为主体———“主动辞职”者自身、行为客体———党政部门、行为所处的社会环境三方面的原因。同时,文章指出应从正视现象、提升规范、反思党政机关自身三方面积极应对领导干部“主动辞职”现象。     

《著作权法》第三次修改的重要内容及价值考量

将于2021年6月1日正式开始实施的著作权法修改决定,对我国的著作权法律制度作了重大完善,修改的主要内容包括:一是完善相关概念和制度,包括完善作品的定义和类型,明确视听作品的权利归属,廓清广播权的内涵,修改合理使用的相关内容,增加职务表演制度等;二是强化对著作权人的保护,包括增加惩罚性赔偿制度,提高法定赔偿额,加大对严重侵权行为的行政处罚力度等;三是解决权利人维权难题,包括增加作品登记制度,增加文书提交令制度,实行举证责任倒置,完善诉前保护制度,完善著作权集体管理制度等;四是全面履行国际条约义务,包括延长摄影作品的保护期,完善残疾人合理使用的规则,增加表演者对其表演的出租权,增加录音制作者的广播和机械表演获酬权等。     

How Does The Charity Law Respond to Commercial Activities of Charity Organizations?

As commercial activities of charity organizations become increasingly popular, the behavior boundary of charities has changed, and accordingly a blank in supervision occurs. However, The Charity Law in China has not given any response to this phenomenon. In combination with the present situation of the domestic charities and experience of foreign legislation, this paper summarizes the different types of charity activities through typology analysis and proposes the key points to design the rules, then gives suggestions accordingly.     

关于加强公安高校教工基层党组织建设的思考

构建社会主义和谐社会的伟大实践为公安高校基层党组织建设提出了新的任务与要求。当前公安高等院校教工基层党组织建设仍面临许多问题,在构建和谐社会背景下,公安高等院校应当秉承学习与实践相结合、开放与创新相结合、民主与集中相结合的思路,从提高对教工基层党组织建设的认识、创新教工党员的教育形式、建立健全教工基层党组织评价机制、加强教工基层党组织领导班子建设等方面入手,加强公安高校教工基层党组织建设。     

Strategic or Principled? The Engagement of Civil Society Organizations with the EU

This article links the literature on the Europeanization of civil society organizations (CSOs) with the literature on the contribution CSOs can make to democracy in the EU. To do so, it asks which are the pull factors that support CSOs’ Europeanization: are they mostly strategic and linked to where law-making and the money are? Or are they likewise linked to a desire to contribute to EU democracy? To explore this question, the article looks at agricultural, environmental and anti-poverty groups and combines fresh qualitative with quantitative data. The findings suggest that we need to distinguish strategic Europeanization, on the one hand, from the identification with supranational democracy, on the other. They also show that the most Europeanized organizations need not be the most interested in EU democracy, whereas organizations with a comparatively low degree of Europeanization can still be interested in EU democracy.     

Strategies and hybrid dynamics of soy transnational companies in the Southern Cone

Economical liberalization, market globalization and soy expansion stimulated the advance of big transnational companies in the Southern Cone countries (Brazil, Argentina, Paraguay and Uruguay). Currently, the main corporations acting on the last links of the productive chain are ADM (Archer Daniels Midland), Bunge, Cargill and Dreyfus (the ABCD firms), global leaders in the soy trade. The objective of this contribution is to analyze the different strategies these companies articulate in the Southern Cone, and their dynamics in local space through market relations with local producers. The results show the rapid and intense process of denationalization of the firms in the soy productive chain as well as the high level of market internationalization and company concentration. In spite of this, this study shows that all transnational power of ABCD firms, which seems so abstract and intimidating when seen in the global scale, depends on its basis of the formation, maintenance and exploration of relations of proximity, trust and reciprocity with local actors (especially rural producers), including family friendship linkages.     

关于转型期企业共青团建设的几点思考

企业团组织引导青年发展,应基于青年特点和企业的实际展开。企业团组织要发挥政治上引领青年、帮助青年成才、对青年的考核等方面的作用。企业团建工作要从健全组织机构、介入企业文化、推进组织创新、规范组织生活、开展青年养成教育等方面入手。     

村基层组织人员“以国家工作人员论”的司法认定

2000年4月29日,全国人大常委员会《关于<中华人民共和国刑法>第93条第2款的解释》确定了村基层组织人员"以国家工作人员论"的基调和范围,但至今村基层组织人员"以国家工作人员论"的认定仍然是司法实践的难点。村民委员会与村党支部属于村基层组织,村基层组织人员是指在村民委员会等村基层组织中管理集体公共事务的人员,不是泛指所有村民。村基层组织人员在具备法律性、公务性、协助性等实质条件时才能"以国家工作人员论"。村基层组织人员"以国家工作人员论"时只能构成贪污罪、挪用公款罪与受贿罪。     

新形势下公安院校基层教工党组织建设探索

为了增强基层教工党组织的创造力、凝聚力、战斗力,充分发挥基层教工党组织推动发展、服务教工、促进和谐的作用,详细分析了基层教工党组织存在的问题,并结合实际,积极探索并提炼出基层教工党组织建设好办法、好措施,以推动公安院校基层教工党组织建设深入发展。     

Linking democratic anchorage and regulatory authority: The case of internet regulators

Scholars and practitioners have repeatedly questioned the democraticness and the authority of transnational multi‐stakeholder organizations, especially those that regulate the internet. To contribute to this discussion, we studied the “democratic anchorages” and the regulatory authority of 23 internet regulators. In particular, we conducted a fuzzy‐set qualitative comparative analysis assessing whether and which anchorages correspond to necessary and/or sufficient conditions for exerting regulatory authority. Our results show that strong anchorage in democratic procedures is specifically relevant for this outcome. Further, we find that weak anchorage in democratically elected politicians leads to high regulatory authority, confirming the significance of non‐state actors in this policy field. More generally, our findings support but also qualify expectations about the compatibility and mutual reinforcement of democratic quality and regulatory authority at the transnational level.
