UNTIL DEATH DO US PART? WHY COURTS SHOULD EXPAND PRENUPTIAL AGREEMENTS TO INCLUDE TEN‐YEAR MARRIAGES

It has become apparent that marriage, while still strongly valued by society and government, has become less appealing to Americans as a whole. The changes taking place in society, whether economic or moral, have resulted in married couples becoming the minority in the United States. This decrease demonstrates that there is a need for reform, and that couples need to be provided with new options that will incentivize them to choose this union over cohabitation. This Note will discuss how expanding prenuptial agreements to allow couples to contract to the length of their marriage may help to accomplish that goal. This expansion will give couples the ability to tailor their relationship to fit their individual expectations and quell the reservations commonly associated with formalized relationships. Furthermore, such an expansion would be consistent with current law regulating premarital agreements and would still allow state governments to remain involved in regulation, making it less drastic of a reform than privatization.

Toward a restorative justice pedagogy: reflections on teaching restorative justice in correctional facilities

Restorative justice is currently practiced in a variety of ways inside correctional facilities. One such way is the facilitation of restorative justice education. If grounded in restorative values, such education can contribute to outcomes similar to other restorative practices, such as victim offender dialogue. These outcomes include opportunities to speak to personal experiences, personal change, and growth, and a desire to engage in positive relationships and give back to the community. This paper draws on the teaching and facilitation experiences of the author and incarcerated peer facilitators to develop a restorative justice pedagogy. This pedagogy, based on restorative values, aims to inspire individual and social transformation; build community among participants; give voice to the unique experiences of participants; offer opportunities for real-life problem solving; provide a creative learning environment that is co-created by students and facilitators; view students as practitioners, theorists, and educators; and invite instructors to view themselves as students and share in the learning process. Implications of the restorative justice pedagogy for teaching outside the prison context and with course material other than restorative justice conclude the article.     

中国循证矫正的对象、问题与解决方案

中国监狱开展循证矫正,应当依据高危险性、高价值性、高匹配性三原则和多种方法确定对象,运用测试、观察、访谈等多种方法评估矫正对象犯因性缺陷等问题,善于寻找、鉴定和精选最佳证据,在此基础上,结合矫正对象的特点和意愿制定矫正方案,才能确保循证矫正取得良好效果。     

河北省农村社区矫正工作的发展策略

社区环境是开展社区矫正工作的基础。与城市社区相比,我国农村社区在经济发展水平、基础设施建设、人力资源储备等方面处于劣势,探索适合农村文化和现实的矫正制度是矫正工作者应当关注的重要问题之一。社区矫正工作实施以来,河北省在完善法律制度、建立工作机构和推进社区信息化建设等方面有所创新,但农村社区仍存在村民参与少、有关部门配合不顺畅,矫正措施层次低、工作队伍专业化不强等问题。社区矫正机构应当在现行法律框架内,结合农村实际,进一步转变观念、规范职能、提高矫正措施水平以及重视工作队伍建设,以推动农村社区矫正工作健康发展。     

Analyzing Forensic Evidence Based on Density with Magnetic Levitation

This paper describes a method for determining the density of contact trace objects with magnetic levitation (MagLev). MagLev measurements accurately determine the density (±0.0002 g/cm³) of a diamagnetic object and are compatible with objects that are nonuniform in shape and size. The MagLev device (composed of two permanent magnets with like poles facing) and the method described provide a means of accurately determining the density of trace objects. This method is inexpensive, rapid, and verifiable and provides numerical values—independent of the specific apparatus or analyst—that correspond to the absolute density of the sample that may be entered into a searchable database. We discuss the feasibility of MagLev as a possible means of characterizing forensic‐related evidence and demonstrate the ability of MagLev to (i) determine the density of samples of glitter and gunpowder, (ii) separate glitter particles of different densities, and (iii) determine the density of a glitter sample that was removed from a complex sample matrix.     

论循证矫正效果评价机制的构建

评估/评价问题始终是现当代监狱发展的重要领域之一。没有对于矫正对象在刑事干预前后的准确评估/评价,我们根本不可能获得"何为有效"的重要信息。在现代统计科学、信息科学和实证主义的影响下,罪犯评估问题、社区矫正对象以及其他矫正对象的评估/评价一直是确保相关实务工作科学高效运作的基础。在循证矫正的构建和推行中,有必要明确评估/评价理论和机制的地位作用,以达到对矫正干预措施和矫正机制运作状况的充分了解,从而在符合"评估相关过程与业务"的原则下有序开展矫正实践工作。     

开展研究型教学，培养创新人才

为了培养具有创新精神和创新能力的创新人才,高等学校（特别是教学研究型大学和研究型大学）必须开展研究型教学,以此推进创新教育。研究型教学是对传统教学模式的创新,它体现了高等教育中以学生为中心的理念,对培养创新人才有重要的作用。本文就研究型教学在创新人才培养过程中所起的重要作用,以及对我校的教学,研究型教学实践案例进行探讨。

Universities and State Policy Formation: Rationalizing a Nanotechnology Strategy in Pennsylvania

Technology‐based economic development programs have become a salient feature of the state policy landscape since the 1980s. While much research exists on the topic, little attention has been given to the processes of policy formation. State programs have moved towards high technology areas emphasized at the federal level over the past decades, and nanotechnology became one of the latest targets. This paper examines the eight‐year process through which Pennsylvania adopted a “state‐wide strategy,” culminating in the Pennsylvania Initiative for Nanotechnology. In this process, programs that responded to the interests of multiple agents came first, and a state policy was formulated after the fact. This pattern of “rationalized policy formation,” as opposed to rational policy formation, may be more common than suspected. Its strengths and weaknesses in this Pennsylvania case are discussed.
