庄子与后现代美丑观比较研究

“以丑为美”的观点是随着后现代这个大的文化氛围的到来而逐渐在当代美学界声誉雀起的,是后现代美学的一个主张,但却并非为其所独有,早在庄子那里,丑就具有了一席之地,成为被赞美的对象。     

论裁量余地原则在国际投资仲裁中的运用

当前，国际投资仲裁体系由于过度干预国家主权，因而面临着正当性危机。欧洲人权法院判例中采用的裁量余地原则能够较好地平衡国家主权与人权保护之冲突。目前国际投资仲裁庭对国家规制行为的审查标准不一，进一步影响到投资仲裁体系的正当性问题，因此，可以引入欧洲人权法院判例中的裁量余地作为对国家规制行为的审查标准，同时辅之于比例分析，以解决投资仲裁面临的正当性危机，这将会减少对国家主权的干扰，因而在政治上更加能够容忍。     

From global workers to local entrepreneurs: Sri Lanka’s former global factory workers in rural Sri Lanka

Abstract

Working in Sri Lanka’s urban free trade zones (FTZs) introduces Sri Lanka’s rural women to neoliberal ways of fashioning selves, which subsequently not only shape village entrepreneurial activities but also initiate negotiations in kinship, marriage, domestic arrangements, and community relations. The knowledges and networks that they develop while at the FTZ allow former workers to connect with global production networks as subcontractors, making them part of the cascading system of subcontracting that furthers the precarity of regular FTZ work. This article explores how these former workers manipulate varied forms of capital – social, cultural and monetary – to become local entrepreneurs and community leaders, while simultaneously initiating changes in rural social hierarchies and gender norms. When neoliberal economic restructuring manifests within local contexts it results in new articulations of what it is to be an entrepreneur and what it is to be a worthy, young, married woman. Overall, the paper sheds light on the fragmented and uneven manner in which neoliberal ethos take root in rural South Asia.

‘No ‘til we know.’ Fela ba a tseba naa? Using African languages to communicate about HIV and AIDS to young South Africans

Abstract

An experiment was conducted in order to determine the extent to which the presentation of HIV and AIDS messages in different languages would affect the appreciation and comprehension of these messages among young South Africans. Interviews were carried out with 60 learners in rural and peri-rural schools in Limpopo Province. Four messages (on posters or in radio advertisements), were presented in three languages. The interviews focused on appreciation (to what extent do the participants like the messages?), perceived comprehension (to what extent do the participants think that they understand the message?), and actual comprehension (to what extent do the participants really understand the message?). The language of presentation did not prove to have any influence on appreciation, perceived comprehension or actual comprehension. A considerable gap was found between perceived comprehension and actual comprehension; participants overestimated their level of understanding. Significant correlations were found between perceived comprehension and appreciation, indicating that the better members of this target group think they understand HIV and AIDS messages, the more they like them.
