浅谈语文教学中审美情趣的培养

对青年学生审美情趣的培养,可以根据他们的心理特征,借助语文中美的因素,采用多种教育手段和现代教育技术,让学生在美的文化氛围中熏陶.由感知美、鉴赏美到创造美,提高自身的整体素质.     

未成年人取保候审程序主体之重构

我国未成年人取保候审程序主体系统在构造上存在权利主体面窄、启动申请主体过少、执行参与主体简单化、独立的救济主体缺位等缺陷。基于未成年人取保候审的特定的程序对象考虑,在借鉴国外少年保释制度运作的经验和考察本国未成年人司法实践基础上,应对未成年人取保候审程序主体系统加以重构。     

Beautiful Day: Awakening to Responsibility

Recently published works, such Elaine Scarry's On Beauty and Being Just, have suggested the natural confederacy of the sensory appreciation of beauty and the achievement of social justice. Scarry (amongst others) has proposed that the opiated moment in which one is arrested by beauty's spell results in a ‘radical decentrification’, where under they who behold beauty are awakened to alterity and, consequentially, encouraged to realize an ethical agenda based upon just (sic) relations between people. The present article refutes the adequacy of the beauty - ethics - justice triptych and, instead, proposes that the entire variegated aesthetic quantum operates as the medium through which recognition of (in)justice reminds us of our responsibility to the other. As essentially inarticulate concepts, justice and responsibility are capable of ‘speaking’ to us through the channel of the aesthetic. The aesthetic is the plane of dialogue on which our felt appreciation of (in)justice prompts us to responsibility. 公民权利抑或个人权利——宪法文本中的个人与公民概念分析

基本权利的主体有个人、公民、法人、组织集体之分,基本权利的最主要主体是个人,这是宪法思想史和宪法性文件所昭示的。中国宪法规定公民作为基本权利主体,个人只是义务主体。这样使得基本权利主体范围减少,在理论上与中国宪法规定的人权原理相悖。其原因有理论上的误区,也有翻译的误导。建议把中国宪法文本中的“公民的基本权利和义务”改为“基本权利”或者“人和公民的基本权利”,其具体内容则重新以“个人”基本权利为主进行规范,使得宪法规范中的基本权利条款与人权规范的本质特点相一致。     

论《治安管理处罚法》在立法技术上的改进

《中华人民共和国立法法》的出台使我国立法上了一个新的台阶,然而,该法并没有对立法技术问题作出专门规定,这便导致我国一系列行政法文件在立法技术上存在缺陷,进而不同程度地降低了法律文件的质量。《治安管理处罚法》作为一部重要的行政法文件在立法技术上较《治安管理处罚条例》大有改进,主要表现在:合理处理与相邻法的关系;适当处置立法授权;酌情控制法规援用;严格规范法律用语;准确厘定调整对象;相对周延规制主体;明确框定裁量幅度;分层设置程序规则;全面拓宽救济路径。     

试论人民币升值的原因、影响及其国际化

金融危机以来,在世界经济的不稳定性和国内因素的交互影响下,人民币升值的压力加大。人民币升值将对我国的进出口贸易产生深远影响,这一趋势将推动人民币走向国际化,并使其成为国际储备货币的可能性和现实性进一步增强。人民币走向国际化能增强我国在国际货币体系中的话语权,有利于维护我国的贸易平衡和汇率稳定。但国际化进程还需要很长的时期,加快我国经济发展和综合国力提升,进一步完善金融体制是当前最紧迫的任务。     

Post‐Secularism and the European Court of Human Rights: Or How God Never Really Went Away

This article analyses the critical yet elusive notions of state neutrality, secularism and religious coercion under the European Convention in light of the European Court of Human Rights recent decision in Lautsi v Italy. We contend that the real concern in the Italian crucifix case was not the infringement of the school pupils’ religious freedom nor the proselytising or coercive effect of the ‘passive’ religious symbols. Rather, opponents of the longstanding symbols were animated by desire for strict religious equality, a notion that is, correctly in our view, not guaranteed under the Convention. Lautsi has significantly cleared the conceptual undergrowth surrounding state neutrality and the varieties of secularism, reined in the elastic notion of religious coercion and eschewed attempts to squeeze the constitutional diversity of European religion‐state frameworks into a strict American‐style separationist mould. The Convention jurisprudence on freedom of religion has finally come of age.     

The rate of dissipation of mouth alcohol in alcohol positive subjects

Seven subjects participated in a two-part study to evaluate mouth alcohol dissipation in alcohol positive subjects. In part one, subjects rinsed their mouths with a vodka solution and were breath tested after 1, 2, 3, 4, and 5 min intervals. On average, breath alcohol concentration (BrAC) decreased 20.4% (range 3.2-47.9%) between 1 and 2 min after rinsing. In part two of the study, multiple breath tests were administered after rinsing once with the vodka solution. The BrAC decreased more than 0.020 g/210 L between the first and second tests for all subjects (average 0.095 g/210 L, range 0.021-0.162 g/210 L). The average time for subjects to reach their unbiased BrAC was 9.35 min (range 4-13 min) after rinsing. This study reaffirms the need for duplicate breath testing and confirms that the minimum of a 15-min observation period is sufficient for mouth alcohol to dissipate in alcohol positive subjects.
