从胡某案件人手,对国内外单独犯因果关系的学说进行了评述,并对共同犯罪因果关系的学说进行了认真的研究,肯定了毕克迈耶与牧野英一的共同犯罪因果关系学说的现代价值,以此为借鉴分析胡某案件中涉及的共同犯罪的因果关系问题,提出考察本案因果关系应遵循的整体性原则,即共犯行为间有引起与被引起的关系,它们互为条件、互相配合、纵横交错,具有单个犯罪所不具有的特殊性;各共犯的行为与犯罪结果之间无论是直接的因果关系还是间接的因果关系,都是一种不容否认的客观存在;共犯的因果关系还具有双重性的特征,即大因果关系与小因果关系.由此得出胡某与张某、江某均应以故意伤害罪论处的结论.  相似文献

This article reviews recent advances in the study of the European Court of Justice (ECJ) and its political impact at the European and member state levels. New quantitative as well as qualitative analyses show with great empirical precision that member state preferences guide the Court. The article summarises these findings, but argues that greater attention needs to be given to the (over-)constitutionalisation of EU law in order to fully capture the political impact of ECJ jurisprudence. Even if European judges are less activist than is often assumed and individual decisions are more restrained in the face of member state opposition, incrementally, case law evolves in a highly expansive fashion. And, exercising caution regarding unrealistic expectations about quasi-deterministic judicial law-making, it is found that the Court’s constitutionalised jurisprudence impacts heavily on European and member state policy-making.  相似文献

During the last decade, several formalized approaches have been developed to improve the effectiveness of probation and parole by implementing evidence-based research into community supervision practices. A key component of these new approaches are the use of officer coaching sessions, which are designed to improve officer fidelity in the core correctional skill areas. This study explores the impact of an initial training and monthly coaching sessions in the Effective Practices in Community Supervision (EPICS) model on probation and parole officer use of core correctional skills. The results examine the average quarterly officer use of skills over an 18-month follow-up period based on training status (i.e., trained versus untrained officers) in the EPICS model. This study adds to the understanding of the role training and coaching may play in improving officer use of core correctional skills. Policy implications and recommendations for future research are also discussed.  相似文献

Researchers argue that the therapeutic alliance is a crucial ingredient for successful releasee treatment outcomes, and more recently in effective correctional treatment. Within the context of the criminal justice system, I illustrate the value of the therapeutic alliance in effective case management and in supporting desistance from crime for reintegrating parolees. The study involved in-depth, semistructured interviews with 56 high-risk/high-need federal male parolees and three parolee case studies. Releasees reported an appreciation for their relationship with their caseworker(s), which they described as supportive and without judgment. I argue this relationship reflects the social dimensions of responsivity and embodies the valued treatment components, optimized through a therapeutic alliance, that foster pathways to releasee reintegration. I conclude by discussing the role of therapeutic alliances in processes of and implications for effective correctional treatment.  相似文献

With the increasing number of ethical violations reported across the public sector, the emphasis on ethics and values in governance is on the rise. Corruption is widely accepted as a form of unethical behaviour that can have detrimental effects on organisations as well as society at large. Research calls for empirical studies focusing on the contextual factors surrounding corruption. Based on the Contextually Based Human Resource Theory and using the case study method, this paper examines the role of context through a systematic analysis of corruption in a public sector organisation. We integrate corruption and human resource literature to understand employee behaviour, employee relations, HRM strategies, and organisational outcomes in the context of organisational corruption.  相似文献
