刑事司法审判中的公众参与及其改善

为提升司法改革的成效,一些地方法院革新观念,大胆尝试吸纳公众参与刑事司法审判过程．在取得实效的同时,也引发了法学理论界和实务界的争议。司法职业化是实现司法独立的有效保障,理所当然应当是刑事司法审判模式创新的主导方向。但司法职业化固有的一些弊端阻碍司法改革进程也不容忽视．社会公众对司法审判的有序参与则正好可以起到弥补作用。因此,有效改善公众参与机制,实现公众参与与司法职业化的协调发展,应当成为中国司法改革向纵深发展的一条新路径。     

论我国立法活动中的公众参与

＂公众参与＂的价值在于通过汇聚公众意志的方式增强项目、计划、规划或政策法律制定的民主性与科学性,以实现对公众利益的保障。文章分析了当前我国立法活动中公众参与的价值、实践情况及存在问题,并提出有针对性的改进建议。     

也谈责任政府的回应性

随着经济社会全面发展,公民的民主意识和法律意识不断增强,要求参与政治和提高政府回应的呼声越来越高,提高政府的回应性已成为大势所趋。做好责任政府的回应性工作,就要在深刻了解责任政府的重要性的基础上,有针对性地积极采取务实的措施,改进政府工作,最大程度地发挥政府职能,唤起民众的参与意识。     

Citizen Redress in Public Contracting for Human Services

This article examines from a regulatory perspective the legal position of citizens in respect of contracted out human services. It argues that the inadequate protection of individual interests and the public interest here is a reflection of increasingly complex relationships between the state and independent sectors, expressed in the essentially hybrid character of contemporary public service organisation. Accordingly a hybrid reform strategy, rather than one that attempts to extend or develop private or public law in any particular direction, is most likely to be successful in addressing associated legal governance problems. The attainment of improved redress for service recipients, and increased accountability of contractors and other parties engaged in human services networks, requires the careful tailoring of remedies to the conditions prevailing in particular sectors. The goal of responsive law should be to foster qualities of good administration and respect for fundamental public interest values within the whole range of regulated agencies and bodies performing public service functions.     

关于行政公益诉讼的思考

传统的行政诉讼只针对法律保护的权利受侵害的相对人,这样当行政行为危及社会公共利益时,利害关系人便无法通过司法手段矫正行政行为。从保护权利与公益角度出发,在综合参考其他国家的行政公益诉讼制度的基础上,应完善建立行政公益诉讼的理论基础,以在我国建构该制度。     

浅论中国知识分子阶层的政治参与

知识分子是中国社会的一个特殊阶层,其在我国社会政治生活中的作用不可低估,重视并研究该阶层的政治参与情况,有助于促进我国的民主政治建设。文章分析了我国知识分子政治参与的特点,并提出了完善知识分子政治参与的途径。     

Adolescent Women's Sports Involvement and Sexual Behavior/Health: A Process-Level Investigation

This multimethod study explored the promising link between organized sports involvement during the high school years and sexual behavior/health among 176 adolescent women. Using more sensitive and appropriate measures than those in existing studies and directed, in part, by cultural resource theory, this study helped to fill a gap in the literature by exploring potential mediators (i.e., functional body orientation and self-empowerment/efficacy) of that link. Results from the quantitative data indicated that adolescent women's involvement in organized team sports was favorably associated with each of the following: (a) sexual-risk-taking behavior, (b) sexual/reproductive health-seeking behavior, and (c) sexual/reproductive health. In addition, both functional body orientation and self-empowerment/efficacy emerged as mediators in the associations between sports involvement and sexual behavior/health among adolescent women. Content analysis of participant responses to open-ended items provided further confirmation of those mediating effects. Implications for the development of sports and community programs focused on the prevention of teenage pregnancy and STDs are discussed.     

公民身份意识释论

公民意识的核心源于公民对自己的身份———公民的认识。缺乏对公民身份的认识 ,就不会产生相应的公民意识 ;模糊了公民身份与其他身份 ,就会迷失公民意识。一个国家的国民只有具备了完整的公民意识 ,才能成为合格的公民。只有国民普遍具备了完整的公民意识和公民性格 ,成熟的有自治能力的公民社会才能建立。     

浅论中国现代化对公民素质的要求

公民意识作为社会意识的一种表现形式,不仅直接表明了一个国家精神文明的程度,而且对经济建设、民主法制建设有着重大的促进作用。构建社会主义和谐社会目标的实现,需要我国社会大力培育现代公民的主体意识、权利意识、责任意识、法律意识和道德意识。     

现阶段我国公民政策参与问题探析

公民政策参与是公民影响公共政策过程的行为,其受到诸多因素的影响。改革开放以来,我国公民政策参与状况有了长足的进展,表现在参与的过程、动机、功能、途径和方式等多个方面,但同时仍有许多问题存在。因此,需要从公民自身条件的改善、政策系统的优化、参与途径的制度化、参与平台的基层化、参与手段的现代化等多个方面加以改进。
