宪法义务比较研究

由于对传统义务本位的深恶痛绝,研究义务特别是宪法义务被看作是"屈服国家"或"过时的思想"。宪法学界普遍认识到人性与失察权力结合可能导致严重后果,但人性与失范权利结合可能产生的后果关注较少,造成了宪法义务研究阙如的事实。世界多数国家宪法都有公民义务的规定,鉴于此,我们在对156部宪法中义务内容与结构进行量化比较的基础上尝试做出一些结论和预测。     

执政文明向度下的我国公民政治参与

公民政治参与的良性发展和执政文明建设是互相依存的关系。执政文明建设的立足点和归宿,理应建立在公民有序、有效、有利的政治参与基础上,这样的政治生态,恰恰是文明执政和政治现代化的根本性标尺。执政文明建设与我国公民政治参与的良性互动,应从意识建设、制度建设、行为实践等方面大力推进。     

浅析市民社会法对利益的分配

中国法治社会的进程伴随着市民社会的形成,面临着国家利益与个人利益的重新分配问题,可以通过对不同阶段、不同类型的法对利益分配方式的分析,来归纳出影响法对利益进行分配的因素,从而为顺利解决这一重新分配问题找到理论依据。     

THE COLLABORATIVE DIVORCE PROJECT: A Court-Based Intervention for Separating Parents with Young Children

The role the legal process of separation and divorce plays in affecting outcomes for young children and their families was examined in the Collaborative Divorce Project (CDP), an intervention designed to assist the parents of children six years old or younger as they begin the separation/divorce process (married and unmarried couples). Evaluation and outcome data were collected from 161 couples, their attorneys, teachers, and court records. In addition to positive evaluations from both parents, intervention families benefited through lower conflict, greater father involvement, and better outcomes for children than the control group. Attorneys and court records indicate that intervention families were more cooperative and were less likely to need custody evaluations and other costly services. The CDP illustrates how prevention programs can be located within the courts, can be systematically evaluated, and can aid in helping the legal system function optimally for families with young children.     

Thoughts on building a just market society

This paper explores the tensions that exist in contemporary society between the individual as citizen and the individual as consumer. The power of the global market place can potentially drive the polity, so it is necessary to raise questions about the means to secure a healthy civic and political life. Financial capitalism, knowledge capitalism and social capitalism are explored as a means of understanding the nature of modern market capitalism. Can financial knowledge and social capitalism be turned into a virtuous circle of innovation, growth and social progress? The paper suggests that trust is the glue, the cement of a just society, and the dimensions of this trust are explored. Finally, the paper examines the nature of stakeholder society. Are you a Citizen? Insights from Borderlands

This paper explores the meaning of citizenship in a border town along the US-Mexico boundary. The central theme is to analyze how boundaries between nations and identities remain permeable and contested; and how such negotiations are reflected in state–citizen relations. The city of El Cenizo, a colonia, in other words, low-cost, low-service, and semi-legal housing in border areas, serves as the study area. The paper analyzes how the real life meanings of citizenship are constantly changing because of different government policies and socio-political norms of engagement. It applies Lefebvre's notion of space to analyze “citizenship” beyond its legalistic definition and understand how the systematic rules of inclusion and exclusion shape the rights and privileges of the residents of El Cenizo.     

美国环境公益诉讼的借鉴与启示

20世纪60年代的美国环境公益诉讼对环保法的发展起到了巨大的推动作用。环境公益诉讼作为一种新型的诉讼模式,专门适用于环境保护领域。同传统的诉讼形式相比,环境公益诉讼在原告资格、诉讼范围、诉讼请求等方面均有很大的不同。然而这种新的诉讼模式却能够很好地提供了公民参与和监督政府行为的途径。鉴于此,我国建立环境公益诉讼具有一定的必要性和可行性。     

宽严相济刑事政策在老年人犯罪中的贯彻与运用

目前存中国，老年人犯罪无法定从宽处罚情形。而根据国外及新中国成立前对老年人犯罪一般予以从宽处罚之实践以及相关理论，结合宽严相济刑事政策宽缓之需要，中国刑法有必要明文规定对老年人犯罪予以从宽处罚。     

论公民教育的内在机理

公民教育与民主息息相关，其实质是协调个人与政府、社会的关系，是实现个体政治社会化、法律社会化与道德社会化的过程。公民教育作为一个系统性的过程，由多种要素构成，其中社会环境是外在于公民教育的构成要素，教育主体、教育目标与内容以及教育方法与途径是内在于公民教育的构成要素。这些要素对公民教育的实施具有重要影响。我国在实施公民教育时应注重公民教育体系的构建、公民教育目标与内容的细化、公民教育课程的开发以及教材的编制。
