Having developed conceptually and analytically civil society as a sociological category (based on a conceptual reflection stemming from a theoretical-epistemological dialogue between the collectivist and liberal perspectives), this article accounts for the implications that allow us to understand the potential of civil society in contributing to democratization. Throughout this work the dynamics that characterize the ambiguous relationship between civil society and community –ambiguous in as much communities with exceptionally strong ties between its members can provide both elements for the strengthening of civil society as well as obstacles to its growth– are analyzed. It is argued that the role of communities in relation to civil society in the social construction and civil strengthening of citizenship will depend on several factors, particularly the mechanisms available to build consensus within the community. The threat stemming from neopluralism as a novel discourse of interest intermediation, both for the community and civil society, is explored. In the final section, the implications of this discourse for democracy are discussed.     

Power and property: commercialization,enclosures, and the transformation of agrarian relations in Ethiopia

The transnational agrarian social movement Vía Campesina is campaigning to have the United Nations negotiate and implement a Declaration, and eventually an International Convention, on Peasants' Rights. This article analyzes the origins and demands of the campaign and the place of the claimed rights in international law. Peasant organizations hope to follow in the footsteps of indigenous peoples' movements that participated in the negotiations preceding the 2007 UN Declaration on the Rights of Indigenous Peoples. The peasants' rights campaign has succeeded in linking its demands to discussions of the right to food in the United Nations, where concern is growing over the approach of the 2015 target for realizing the Millennium Development Goals, in particular the halving of the numbers of people suffering from hunger. The campaign is likely to face stiff resistance from powerful UN member states, but could achieve substantial advances even if the path to a convention is difficult or never completed.     

Like a tree

The contemporary mediascape has been marked by a proliferation of popular TV genres in which the public appear as central protagonists. These genres are part of a broader shift in the relationship between media and audiences which challenges traditional conceptions of public service broadcasting and appear to represent a shift from media as public knowledge to media as constituting a space for diffuse popular engagement. A central feature of this shift has been the growing role of popular forms of expertise on television. This paper maps the main critical debates around participatory television and the role of the expert, from earlier work on talk shows to more recent discussions of reality and makeover TV. It notes a transition within the critical media and cultural studies literature from a focus on public sphere theory and questions of democratization to a growing concern with the role played by popular media culture in supporting new modes of governance based on the expert mediation of normative self-control. In this paper we analyze the role of experts on Oprah Winfrey's popular website Oprah.com, noting both the utility and limitations of a governmental perspective. Extending upon Foucault's notion of the productive nature of liberal subjecthood, the paper suggests the more positive role played by popular expertise in contributing to a media–civic culture articulated to a politics of recognition.     

Transnational policy networks in the migration field: a challenge for the European Union

The migration policy field is a multilayered and fragmented area still lacking a strong global and European regime. Nonetheless, different initiatives and fora have been promoted in the last decade to increase the international dialogue on migration, with the active participation of non-state actors, and particularly civil society organisations (CSOs). The article reviews selected initiatives undertaken at the UN and European level, whereby institutional representatives engage with CSOs in furthering migration policies. These initiatives and platforms may constitute transnational policy networks (TPNs). It explores signals towards the consolidation of more structured and ‘hard’ forms of participatory policy-making on migration issues, as well as obstacles present in this engagement dynamic. The key question addressed in this study is whether and how European institutions have engaged with the TPNs in the field of migration. The article also explores how some of the TPNs influence institutional policy-making at the EU level.     

Financialization,distance and global food politics

This paper provides a new perspective on the political implications of intensified financialization in the global food system. There has been a growing recognition of the role of finance in the global food system, in particular the way in which financial markets have become a mode of accumulation for large transnational agribusiness players within the current food regime. This paper highlights a further political implication of agrifood system financialization, namely how it fosters ‘distancing’ in the food system and how that distance shapes the broader context of global food politics. Specifically, the paper advances two interrelated arguments. First, a new kind of distancing has emerged within the global food system as a result of financialization that has (a) increased the number of the number and type of actors involved in global agrifood commodity chains and (b) abstracted food from its physical form into highly complex agricultural commodity derivatives. Second, this distancing has obscured the links between financial actors and food system outcomes in ways that make the political context for opposition to financialization especially challenging.     

农村承包地三权分置制度入典研究

《农村土地承包法修正案》将“三权分置”政策内容上升为法律规定,确立承包地三权分置制度。对解决承包地流转闭锁抵押难行等问题意义重大。却因将承包经营权本集体经济组织内封闭流转以法律固化,新设土地经营权性质不清、类型混合、流转不济,无益承包地债权性与物权性并可市场化开放性流转之“三权分置”目标实现。受其影响,《民法典分编(草案)》亦存同样问题。亟待农村承包地三权分置制度进一步入典完善。在实地调研基础上,遵循《民法总则》落实集体土地所有权前提下,于《民法典分编(草案)》完善中,基于英美地产权客体权益分离理论与大陆法系二次权能分离理论具兼创债权性与物权性经营权功能的地权二次分离理论,在保持土地承包经营权规定不变上,从其客体权益中分离出二元化土地经营权,并分别于合同编增设农地租赁经营合同具体规范债权性经营权、于物权编构造“农用地使用权”科学规范物权性经营权。以利能以债权性经营权顺农地灵活经营实践、物权性经营权应农地抵押及长期经营所需的二元化路径,促现行承包经营权本集体经济组织内封闭流转向派生出的土地经营权市场化开放性流转发展,以实现农村承包地三权分置制度入典达成“三权分置”、“放活土地经营权”之政策目标。     

预告登记权利人“排除异议”的判定——以《异议复议规定》第30条为中心

《异议复议规定》第30条作为预告登记权利人提出案外人异议的审查依据,因其中"排除异议"及"符合物权登记条件"在解释上易生歧义,致实务适用意见不一。依执行理论,除所有权外,何种权利始可排除强制执行,应依实体法之性质、效力及执行目的或方法确定。经预告登记之权利并非实体权利,其性质应为兼具物权性、债权性及从属性的请求权。目前,我国预告登记在强制执行中的效力,立法未臻明确,但结合我国预告登记实体法之"再处分禁止效力"及"不动产登记簿冻结效力",藉由目的解释,应将《物权法》第20条第1款之"处分"进行扩张,使其效力覆盖强制拍卖、变卖等"处分"性执行措施。而案外人据以《异议复议规定》第30条提出异议的,法院不应适用于商品房预售合同备案登记、网签及受让物权预告登记以外的其他预告登记之情形,其"符合物权登记条件"之确认,应参照预告登记转本登记之理论,采实务通说之标准,具化为满足合法有效的商品房买卖合同,已办理预告登记及支付全部价款或依约定支付价款之要件。     

European Union civil society support and the depoliticisation of Turkish civil society

Despite growing critical literature on external funding, the link between EU funding to Turkish civil society organisations (CSOs) and their depoliticisation remains understudied. This article fills this gap. This article explores EU funds in Turkey and shows the incentives it creates for a depoliticised civil society. Drawing on an original set of interviews with 45 CSOs, this article analyses how Turkish CSOs interact with EU funding and how this support impacts on Turkish civil society. This article argues that EU funding’s short-term, activity-based, measurable outcome and visibility-oriented structure contributed to the depoliticisation of those CSOs benefited from EU funds.     

对高校学生会运行的法律思考

高校学生会是大学生的自治性组织,受学校党委的领导和团委的指导,不具有民事主体资格,不具有民事权利能力和民事行为能力。高校学生会在运行中存在法律主体身份不明确、责任承担等问题,故应加强对高校学生会成员的法律教育和管理,规范高校学生会的运行。
