Contagion in the Transpacific Shipping Network: International Networks and Vulnerability Interdependence

To what extent are states vulnerable to disruptions in trade networks? We investigate this question by simulating attacks on the intermodal shipping network, whose ubiquitous containers carry 80% to 90% of all global trade in goods. While this network has reduced transportation costs and spurred international trade, the dependence of modern economies on ship-borne trade means disruptions in one region may produce considerable costs for states in another region. We simulate an “optimal terrorist” that learns about the conditions under which attacks on the network in other parts of the world generate economic losses to the United States. The study illustrates that by adopting a network- and process-oriented ontology, the study of interdependence may better anticipate new sources of interstate and transnational conflict.     

从美国法院附设ADR调解制度探索中国法院调解的改革之路

当今社会,社会矛盾呈现出复杂化、多样化的特点,替代性纠纷解决机制(ADR)作为一种在世界范围内被广泛应用的新型纠纷解决机制,不仅有效地缓解了司法机关的诉讼压力,也促进了各国多元化纠纷解决机制的合理构建及有效运行。而调解作为现代ADR的主要形式,它的广泛应用,尤其是美国法院附设ADR调解的成功应用经验,对我国调解制度特别是法院调解的改革具有深远的借鉴意义。     

Economically disadvantaged juvenile offenders tried in adult court are perceived as less able to understand their actions,but more guilty

We investigated the influence of a juvenile defendant's socioeconomic status (SES) on mock jurors’ perceptions of a juvenile tried in adult court. As predicted, participants convicted the low SES juvenile defendant of felony murder significantly more than the middle or high SES juvenile defendant. Yet, participants also rated the low SES juvenile as less mature than the middle or high SES juvenile – a belief that past research shows predicts leniency in verdicts (i.e., not guilty judgments). Finally, stereotypes about the criminality of low SES juvenile defendants, not a lack of perceived similarity, partially mediated the effect of SES on guilt.     

The role of venture capital firms in Silicon Valley's complex innovation network

Abstract

We still poorly understand why Silicon Valley has originated so many breakthrough innovations and large companies. The durability of Silicon Valley's innovative competence over the last seventy years also needs more explanation. The failure of several policy-makers around the world to reproduce the Silicon Valley cluster reveals the misunderstanding of the innovative dynamic in Silicon Valley. This study uses complex network theory – CNT (Barabási, Newman & Watts, 2006; Jen, 2006; Thompson, 2004a) to analyse the complex innovative capability of Silicon Valley and to understand the heterogeneity of agents and the multiplexity of ties that support creation and development of high-tech start-ups. As proposed by Barabási (2002, p. 200), we view the economy as a complex network, whose nodes are companies and whose links represent the various economic and financial ties connecting them. Innovation and entrepreneurship are understood as resulting from the interactions of numerous economic agents.

In a systemic perspective, by definition, the presence of a specific agent in a network induces specific interactions with other agents that could not take place if this agent were not there. Thus, the diversity of agents influences the dynamics of the system. The presence of venture capital (hereafter VC) firms in an innovative cluster opens potential specific interactions with other agents in the network (universities, large companies, laboratories) that determine a particular dynamic of innovation. In this perspective, what is distinctive about Silicon Valley is its complete and robust complex system of innovation supported by social networks of interdependent economic agents in which the VC firms have a specific function. Our perspective examines five different contributions of VC firms to Silicon Valley: financing, selection, collective learning, embedding and signalling. These five functions are different ways for the VC firms to interact with the other members of the complex network of innovation and to support the robustness of the system.     

我国控辩协商程序的规范进路:以认罪认罚案件为视角

认罪认罚从宽制度确立了具有中国特色的量刑协商模式。协商性司法模式的确立,使刑事诉讼的重心由审判阶段向审查起诉阶段前移,与对抗模式下的庭审实质化相对应,控辩协商实质化亦成为协商性司法模式的基本要求。然而,控辩平等协商作为协商性司法的核心和量刑合意形成的关键环节,却未受到立法、实务层面的应有重视,相应配套之程序性规则体系与保障措施的缺失,使得控辩协商的实施效果不尽如人意,控辩双方诉讼实力不平衡导致控辩协商实质性缺位成为司法实践中的突出问题。程序正义是刑事诉讼的灵魂。为增强控辩合意过程和协商结果的公正性,应探索控辩协商之规范模型,从控辩双方的主体地位、决策能力两个层面考量,探讨建立规范、具体、系统的控辩协商程序之基本方向和完善法律规范层面对控辩协商规制不足的路径。

文章依据犯罪心理学的基本理论,通过对绑架犯罪行为人、相关人心理的实证性调查,从犯罪心理学的角度,对绑架犯罪行为人的图财心理、抗拒心理和报复心理进行了分析。这对于预防、控制、侦训、矫治绑架犯罪,具有十分重要的理论和现实意义。
