情境在犯罪预防中的应用——以广州市白云区为例

随着情境预防理论的深入发展．情境已逐渐应用于我国犯罪预防的实践领域。犯罪情境就是在犯罪行为发生过程中的一系列主客观因素的总和。情境预防理论认为,通过对这些主客观因素的控制,可以达到预防犯罪的效果。不同的情境在犯罪行为发生过程中起着不同的作用,并且不同程度地影响犯罪人、被害人以及旁观者的行为选择,最终将可能影响到犯罪的走向。从广州市白云区的情境预防实践案例,可以了解一些情境在犯罪行为中的作用、情境预防的现状和发展趋势。     

如何构建我国社会保障制度的新机制

当代西方福利国家的社会保障制度正从"黄金时期"转入"社会福利危机时期",对处于转型时期的我国来说,现行的社会保障制度也面临价值选择与制度重构的双重挑战。在统筹城乡发展与建设社会主义和谐社会的宏大背景下,社会保障的核心价值理念应从"反贫困、重效率"向"保障积极人权、追求社会公平正义"回归;社会保障的核心制度模式应当是发展型社会保障制度。建立发展型社会保障制度的关键是将国民的发展权置于首位,促进充分就业,使发展型社会保障与积极的就业政策之间呈现良性的互动。我国应依据上述原则和理念,构建社会保障制度的新机制。     

Friendly neighbor or Trojan Horse? Assessing the interaction of soft law initiatives and the UN climate regime

Current global climate governance is characterized by increasing institutional proliferation. Within the last 5 years several non-legally binding initiatives have emerged, including (i) the Asia-Pacific Partnership on Clean Development and Climate and various other public–private partnerships working on the policy implementation level and (ii) the Group of Eight Gleneagles Dialogue on Climate Change, Clean Energy and Sustainable Development, and Major Economies Meeting on Energy Security and Climate Change as high-level political processes. As a first step toward analyzing the relationship between these parallel initiatives and the UN climate regime, this article looks at the negotiations of four UN-hosted climate meetings in 2007–2008, providing an examination of the interaction of ‘soft law’ climate initiatives and the ‘hard law’ UNFCCC/Kyoto Protocol process. The methodology of the study is based on participatory observations in the negotiations and document analysis of country and stakeholder positions. The analysis shows that the current multitude of processes in global climate governance entails potential institutional interaction. Deliberations of the key actors give some support to the claims of non-UN soft law being used to exert influence on the negotiations on a future climate regime within the UN context.

利益和谐视角下完善我国农村纠纷化解机制研究

在建设“和谐社会”的方针政策下,完善我国农村纠纷化解机制对推动和谐社会、实现依法治国有巨大意义。其中利益和谐是和谐社会的基本标志,也是农村纠纷化解机制的制度目标。但是现实中农民由于在社会利益博弈中的弱势地位而导致农村社会矛盾冲突加剧,造成我国农村纠纷化解机制运行困难。建立我国农村纠纷化解三维立体模式,强化我国的农村纠纷化解的制度体系、加强各个主体间互动,为推进新农村建设、实现和谐社会提出建议。     

“PARADOX OF ENGLISH LAND LAW” — AN ENLIGHTENMENT TO LAND LAW REFORM IN CHINA

Since the founding of New China in 1949, the land law system with Chinese characteristics has been formed based on various practices, inter alia, the evolution of the rural land law system from the agrarian reform to the cooperative and people’s communes and further to the household contract responsibility system, which made historical contributions to the development of Chinese social economy. However, with the development of the practices and the deepening of the reform, China’s land law system is facing great challenges under the new circumstances. Although many differences exist between English land law and Chinese land law in the areas of legal form, the regulated objects and contents, English land law can provide some beneficial enlightenment to China’s land law reform. Particularly, the “paradox of English land law,” which presents the way how the English land law, as the law adjusting the basic property relations with many traditional factors, responds to the process of social and economic development with leaps and bounds.     

Exploring the “Lost and Found” of Justice Theory and Research

Scientific interest in the nature of how people think about justice and fairness began approximately 70 years ago with Stouffer’s classic study on the American soldier. Since then there have been numerous theoretical frameworks and thousands of research studies conducted on what people perceive as fair and the consequences of making a fairness judgment. The goal of this article is to dig through the “lost and found” box of justice research in an attempt to re-examine where we have been, issues and ideas we may have forgotten, and to gain insight on directions we may want to go in the future. The key rediscovery of this review is that perspective matters. Specifically, how people interpret fairness depends critically on whether they are viewing a situation in terms of their material, social, or moral needs and goals. The implications of adopting a contingent theory of how people reason about fairness are discussed.

论当代东南亚华人文化与当地主流文化的双向互动

东南亚华人因深远的中华文化背景而长期保留其民族特征 ,但因与当地居民杂居混血 ,以及当地文化的巨大冲击 ,其文化正日益接纳当地成份 ,从而形成传统性与当地化交融并存的局面。另一方面 ,以融汇外来文化著称的东南亚文化 ,也正经历着适应与涵化华人文化的过程。华人文化与东南亚当地文化的双向互动由此而产生。     

鸡贫血病毒VP1、VP2和VP3基因酵母双杂交载体的构建及其自激活活性的鉴定

为构建鸡贫血病毒(CAV)VP1、VP2、VP3基因酵母双杂交载体并鉴定其自激活作用,从CAV细胞传代毒M9905毒株中提取基因组DNA,利用PCR分别扩增VP1、VP2和VP3基因,采用Gateway技术将VP1、VP2和VP3基因分别克隆到酵母双杂交载体pDEST32和pDEST22中,构建了诱饵载体及猎物载体,经酶切和PCR鉴定且测序正确后,用醋酸锂法转化酵母菌株Mav203,通过缺陷型平板SD/-Leu/-Trp/-His和SD/-Leu/-Trp/-Ura筛选以及LacZ报告基因检测载体有无自激活作用。结果表明,成功构建了诱饵载体pDEST32-VP1/VP2/VP3和捕获载体pDEST22-VP1/VP2/VP3,并证明其VP1、VP2和VP3蛋白在酵母双杂交系统中无自激活作用。研究结果为下一步利用酵母双杂交系统探索CAVVP1、VP2、VP3蛋白之间的相互作用奠定了基础。
