当代中国法治进程中的文化阻滞力

当代中国的法治进程正处于特殊的历史情境中,社会转型带来了前所未有的文明冲突和文化碰撞,不同的文化精神同时影响着这个寻求现代化的国家。以理性化、契约化为核心文化精神的现代法治,要在有着千百年宗法伦理文化积淀的中国社会扎下根来,需要克服来自传统之中内在的文化阻滞力,这种阻滞力通过个体的行为和社会结构表现出来,通过人们的日常生活潜移默化地渗透到政治、经济、法律等各种非日常的社会领域,阻碍了法治社会的形成。中国在寻求适合自己发展道路的过程中,越来越意识到自身文化问题的重要性。在法治发展的现阶段,要真正打破困境,必须从根本上逐渐限制和消除来自于中国社会内部的具有结构性特征的文化阻滞力,变不利为优势和特色,从而为法治建设的进一步深化创造条件。     

关于进一步加强农村文化建设的思考

目前农村普遍存在的伦理道德危机和信仰危机,凸显我国农村文化的一些缺失,因此,加强农村文化建设显得尤为紧迫。深刻分析农村文化建设面临的诸多问题、困境及其原因并有针对性地采取谎话,尽快消除城乡二元体制,加强农村文化建设,成为当前新农村建设的重要课题和当务之急。     

The idea of a Southern Criminology

Southern Criminology is a theoretical perspective that shifts the focus from the state criminal justice process to global inequalities, transnational crime, and postcolonial politics. While recognising the importance of this shift in perspective for a globalising world, this paper asks two difficult questions. Firstly, how easy is it to generalise about whole regions of the world in advancing a political viewpoint? Secondly, is it possible for those in the West to imagine an alternative global criminology, if non-Western societies really do have different cultural values and epistemologies? For example, how should we respond to traditional practices among Indigenous Australians or a Confucian understanding of crime? These questions may make a Southern Criminology sound impossible in the same way as other varieties of critical theory. But this paper is intended to strengthen this emerging movement by acknowledging, and working through, potential difficulties.     

The Greenbook and the Overrepresentation of African American,Hispanic, and Native American Families in the Child Welfare System

Effective Intervention in Domestic Violence & Child Maltreatment Cases: Guidelines for Policy and Practice (the Greenbook) provided a valuable framework for child welfare agencies, domestic violence agencies, and the courts to work together to address the co‐occurrence in families of child maltreatment and domestic violence. It did not specifically address the overrepresentation of families of color in the child welfare system or the disparity of outcomes for these families. Yet the Greenbook’s approach to systems change can be used as a foundation to implement strategies to reduce overrepresentation and to improve safety, permanency, and stability for children and families.     

Omnivorous Cultural Policy: The Case of Concerts Norway

This article uses the case of Concerts Norway to analyze how the agency of esthetics is changing and expanding within a cultural policy institution. Concerts Norway has provided concerts to all age groups and all parts of the country for nearly fifty?years. The ambition of the institution has been to ensure that all Norwegian citizens have had access to quality music. The article describes how these cultural policy ambitions entail a general esthetic agency, and how different kinds of musical genres have been given agency through the work of the institution, thereby representing a seemingly omnipotent and increasingly omnivorous cultural policy.     

文化产业发展与社会结构变迁的关系——基于西方社会发展进程的分析

文化产业在西方社会的产生与这些国家的经济发展和工业化进程关系密切。机械化的规模生产应用到文化领域催生了现代文化工业。大众文化娱乐形式的出现让普通大众也可便利地接触文化艺术这个曾经只属于少数人的特权领域,西方社会进入大众文化消费时代。大众文化内嵌着物质主义的实用价值观,是一种打破雅俗之分的文化。进入后工业社会,西方国家向着重视自我价值实现的后物质主义价值观转变,同时信息技术的应用使得定制化服务和灵活生产成为可能,文化产业作为高经济附加值服务行业以及以内容为核心的知识经济代表性领域再次迸发活力。文化产业发展与西方社会从工业化到信息化的社会变迁呈现出一种相互作用的同构关系,这种互动关系主要通过文化生产和文化生活（文化实践活动、文化价值观念）两个方面的基本机制来实现。     

论王充思想文化精神的内涵——纪念王充诞辰1990年

王充治学以儒家为根基,但他善于打通各家学说,并吸纳新的知识成果,创立新说,通过自由思想的独立精神、“事实判断”的思维方式、求索创新的治学风格和“实事疾妄”的思想成果等四个层面,成就了一种难能可贵的思想文化精神,这种精神的传播,不单局限于学术学人领域,还以学术精神为内核外延至百姓生活之中,对塑造大众的认知方式、价值观念、行为准则及风俗习惯等方面,形成持久的影响与引导。这是王充有别于许多主流学术思想家的一个重要特征。     

“Just Describing is Not Enough”: Policy Learning,Transfer, and the Limits of Best Practices

Despite widespread use in the cultural field, best practices remain theoretically and empirically under-researched. The aim of this article is to achieve better understanding of their use and effectiveness in policy learning and transfer, using a case study of a cross-national policy coordination process in the European Union, the Open Method of Coordination. Using empirical data from interview and participant observation material, the article highlights several fundamental challenges of best practices, such as issues of contextualization, representativeness, and critical analysis. It finishes by offering six critical reflection questions on the use of best practices.     

文化相对主义述评

文化相对主义的产生及其理论的应用,使美国文化人类学有了自己的理论体系,形成了自己的研究方法。由于鲍亚士及其门生对文化相对主义的不断充实与发展,使它替代了进化学说和传播理论,使其理论在一定时期成为权威性的解释而广为流传。这在一定程度上有自己的进步性和合理之处,对丰富文化人类学的研究和推动文化人类学的发展作出了一定的贡献。文化相对主义远不是文化人类学思想的终结,它显然存有理论研究的缺陷和方法论上的不足。
