意思表示错误效力比较研究

意思表示错误应具有何种法律效力,因涉及表意人的意思自治与相对人合理信赖的风险分担,而成为民法中最为棘手的难点问题。各国立法对意思表示错误制度的效力设计,出现静态安全相对保护主义与动态安全相对保护主义两种立法方案。基于权利制衡的基本宗旨,可以得知静态安全相对保护的立法模式较为可采,但应辅之以表意人撤销权要件及损害赔偿责任等诸多限制。

我国农民工就业歧视问题的心理学解释

农民工在城市就业所遭遇的歧视可以从心理学的角度进行剖析。歧视源于偏见,偏见产生的原因在于社会群体的利害冲突、社会化、个体人格和心理因素,偏见会产生预言的自我实现和疏离。要想消除偏见必须消除刻板印象、增加平等的接触并树立共同命运的意识,而且要制定有助于消除偏见的社会规范。     

原发性高血压早期肾损害中医证候学观察

目的:观察原发性高血压早期肾损害的中医证候学特点和规律。方法:对120例原发性高血压早期肾损害患者进行中医证候学分析,并以60例无肾损害的原发性高血压患者作为对照,统计分析不同中医证候积分。结果:原发性高血压早期肾损害患者以肝、肾证候及阴虚、气虚、血瘀证候积分最高,明显高于无肾损害的原发性高血压患者(P<0.01)。结论:原发性高血压早期肾损害的主要病机为肝肾阴虚兼气虚血瘀。     

养肝益水颗粒对原发性高血压早期肾损害患者肾叶间动脉血流的影响

目的:观察养肝益水颗粒对原发性高血压早期肾损害患者肾叶间动脉及肾主动脉峰值流速(Vmax)、阻力指数(RI)的影响。方法:70例辨证为肝肾阴虚或兼血瘀型原发性高血压早期肾损害患者,随机分为治疗组和对照组各35例,治疗组给予养肝益水颗粒加西药常规治疗,对照组仅予西药常规治疗,观察治疗前后肾叶间动脉及肾主动脉Vmax、RI等指标的变化。结果:治疗后治疗组肾叶间动脉血流Vmax上升程度、RI下降程度与对照组相比,差异有显著性(P<0.05,P<0.01);治疗后肾主动脉Vmax均较治疗前有所升高,RI有所下降,但差异无显著性(P>0.05)。结论:养肝益水颗粒对原发性高血压早期肾损害患者肾叶间动脉血流有积极影响。     

Liabilities in Contract Law of China: Their Mechanism and Points in Dispute

China is drafting its first Civil Code now, and the Chinese laws have seen an expansion of contractual obligations and a new structure of contractual liabilities. This paper expounds this trend through the perspective of contract liabilities. It mainly analyses the anticipatory breach, the enforced performance, damages, payments stipulated by the contract, the statutory rights to termination, the unification of guarantee liabilities for defects and liabilities for breach of contract, and makes the conclusion that China Contract Law CCL will be put into the future Chinese Civil Code, with some necessary technical changes and amendments.     

Preferential Selection Independent of Race and Gender: Effects on Self-Evaluations and Newcomer Information-Seeking Behaviors

The current study investigated the effects of an experimentally imposed program of preferential selection on beneficiary self-evaluations and newcomer information-seeking behavior. One hundred-twenty undergraduates were randomly assigned to a classification condition (in which they were informed that they tended to think in either an analytical or abstract manner) and collaborated on a task in groups of three. A fourth participant was introduced into each of these 40 extant groups under either a condition of preferential selection or not. Preferentially selected newcomers were shown to have more positive self-evaluations than their nonpreferentially selected counterparts. The presence or absence of a similar (in terms of thinking style) incumbent moderated the effect of being preferentially selected on the use of specific information-seeking behaviors.
