海权争端与中国海洋权益维护之道

文章阐述了中国与周边国家海权争端的概况;分析了当前这些海权争端的特点;重点探讨了海洋权益的切实维护之道:认为要摒弃"重陆轻海"传统历史观念;重视实际控制和主权宣示;建立高层统一协调机制、独立的综合管理部门和相对统一的海上执法力量;成立中国海权维护委员会;深入研究海洋法和各周边国家法律;大陆与台湾应联手维护海洋主权;采取必要的实际行动等十个方面维护中国的海洋权益。

本文叙述了我国南沙群岛岛礁被周边国家占据的现状,以及南沙群岛的战略地位与自然资源,并分析了《联合国海洋法公约》对南沙主权争端的影响,论述了当前南沙主权争端复杂化主要表现的几个方面。     

Polarity,preponderance and power parity in the generation of international conflict

Almost a decade ago one of the authors introduced the concepts of “opportunity” and “willingness” in this journal (Starr, 1978). We have since devoted considerable attention to clarifying these concepts and their relationship to international conflict. In a series of recent articles we have focused on the micro/decision making/willingness level. In the present discussion we expand more fully on the macro/system/opportunity level, demonstrating through the use of logic and simulation that such decision processes operate within structures which appear logically to set limits, ceilings or constraints on the amount of conflict which is possible. We do so by using the different positions regarding polarity and conflict, and the parity vs. preponderance debate as starting points; (and come to some non‐obvious conclusions on the roles of power and system structure).     

“枫桥经验”与构建中国特色的替代性纠纷解决机制

我国正在进行替代性纠纷解决机制(ADR)的构建,但对如何构建适合中国国情的ADR制度尚未达成共识。作为一种行之有效的纠纷解决机制,"枫桥经验"与ADR的特征和价值具有共性,对构建中国特色的替代性纠纷解决机制提供了有益的启示。     

论9·7钓鱼岛事件中的国家责任问题

日本9月7日在钓鱼岛海域对中国渔船冲撞、对渔民抓扣事件在中日两国都引起了较大反响。中国为促使日方停止非法行为,采取了中日建交38年以来罕见的反制措施。日前,外交部要求日方承担赔偿责任,日方则予以拒绝。那么,从国际法的规范性角度究竟应该怎样看待日方的行为以及中国的反制?当前国际法学界对此缺少探讨与回应。

《医疗事故处理条例》的发布实施在解决医患纠纷,缓解医患冲突方面确实起到了一定的积极作用。然而我们仍然应当清醒地看到其中存在的盲区、与相关法律存在的法益冲突以及可能对医疗纠纷诉讼产生的影响。通过对医疗纠纷诉讼中医疗事故技术鉴定结论应用的几个问题作简单地探讨,以期对司法实践能有所裨益。     

建立健全农村土地承包纠纷仲裁解决机制的思考

以家庭承包经营为基础、统分结合的双层经营体制是我国农村的基本经营制度。近年来,土地承包经营纠纷呈多发趋势,已经成为影响农村和谐稳定的因素之一。《仲裁法》规定,农村集体经济组织内部农业承包合同纠纷的仲裁另行规定;《农村土地承包法》规定,因土地承包经营发生纠纷的,当事人可以向农村土地承包仲裁机构申请仲裁。但是,由于《仲裁法》、《农村土地承包法》的规定都比较原则,各地在农村土地承包经营纠纷仲裁工作中存在机构设置不统一、工作程序不规范、裁决执行不及时等问题,以至于造成许多土地承包纠纷得不到合理及时的解决。面对日益复杂的土地纠纷,我国目前仍没有制定出一部有关农村土地承包合同仲裁的单项法律,使大量的农业承包纠纷不得不采取诉讼程序,增加了纠纷的解决难度。因此,为了切实维护农民的土地承包合法权益,以低成本、高效率解决农村土地承包纠纷,促进农村社会的和谐与稳定,建立和健全农村土地承包纠纷仲裁解决机制,就显得十分迫切和必要。     

论和解协议效力的司法确认

一般认为,和解与调解的分野在于有无第三方参与纠纷的解决,但事实上和解与调解是出于同一个基本原理,即当事人之间的合意。在纠纷解决的机制中,和解始终占有十分重要的地位,调解、诉讼和仲裁都是在第三方参与下解决纠纷的方式,但是其中都蕴含着和解的契机。虽然从原理上讲和解似乎只是纠纷当事人之间直接交涉的结果,但是直接赋予其法律上独立的地位不仅是必要的而且是可行的。

Over the past two decades, there has been a paradigm shift in the way the legal system handles most family disputes—particularly disputes involving children. This paradigm shift has replaced the conventional model of adjudication with a more collaborative, interdisciplinary, and forward‐looking family dispute resolution regime. It has also transformed the practice of family law and fundamentally altered the way in which disputing families interact with the legal system. This essay examines the elements of this paradigm shift in family dispute resolution and explores the opportunities and challenges it offers for families, children, and the legal system.
