法律职业的特征解析

何谓法律职业 ,无疑是法律职业研究中的核心问题。本文以社会学关于职业内涵的界定为参照 ,试图通过对法律职业的六个特征的具体解析来揭示法律职业的内涵。这六个特征是学识性、独立性、同质性、组织性、规范化和垄断性     

国际经济法教科书体系的反思与重构——一种“跨国经济公法”的思路

传统的基于大国际经济法而定位的主流国际经济法教科书体系存在着公私不分、条块分割和内容杂乱的弊端和问题。为此,有必要反思传统大国际经济法教育模式尤其是大国际经济法教科书体系,进而结合国际经济法的制度实践,融会国际经济法的学术理论,借鉴美国国际经济法教科书体系,确立国际经济的“公法”定位,适当分离国际商事交易法和国际经济规制法,打破传统国际经济法教科书模式,阐释跨国经济公法的“公法原理”,贯通国际经济法的“问题”流程,构建权威的“跨国经济公法”教科书“体系”。

全面建设小康社会的战略部署为当代青年发展提供了新空间、新机遇,与此同时,青年思想政治教育的地位与作用日益凸显。全面建设小康社会对青年思想政治教育提出了深化和创新的全新历史性要求。     

Going, going, gone: the effects of aid policies on graduation at three large public institutions

This paper exploits uniquely detailed data and cross-institution variation in aid for three large public universities to identify the effects of aid on the probability of college graduation. The results indicate that need-based and merit-based aid both increase graduation rates at large public institutions, but primarily through the types of students that ‘select’ these institutions. Merit-based aid facilitates an institution attracting students who have higher observed academic ability that raises the probability of graduation. Need-based aid enables an institution to attract students with non-academic attributes such as social and cultural networks that, while often unobserved, improve graduation success. Broadly, our results suggest that recent aid policy that has moved away from need-based aid for low-income students (reducing their ability to find the best institutional match) and toward merit-based aid (that alters the distribution of high ability students across colleges) could foster stagnant graduation rates even with rising enrollment rates that have been observed over the last three decades.

青少年德育实效性偏低关键是学校德育中的学生主体性缺失,具体表现为:在德育的目标和内容上,以社会为本位的价值取向造成对主体德育需求的漠视;在德育的方式方法上,以灌输为特征的传统方法造成对主体认知发展规律的忽略;在德育的载体途径上,以学校为中心的德育体系造成主体价值选择的困惑;在德育的评价标准上,以道德认知为内容的评价体系造成主体人格的分裂。     

'I Find Myself as Someone Who is in the Forest': Urban Refugees as Agents of Social Change in Kampala, Uganda

An in-depth investigation of the Kampala Urban Refugee Children'sEducation Centre (KURCEC), a refugee-initiated community-basedorganization in Uganda, allows for detailed exploration of thelivelihood strategies employed by urban refugees in the sphereof education and of the ways in which these strategies can promoteself-reliance and individual and community development in urbansituations. Urban refugees' development of KURCEC challengesperceived notions of refugees as burdens or as passive recipientsin a system that fosters dependency and shows that they areagents of social change within their own and their host communities.The focus on what works in the midst of crisis, desperation,and uncertainty is a deliberate attempt to promote researchand policy-setting that is forward-looking and productive ratherthan reactionary and regressive in the context of new developmentsin policy and practice relating to urban refugees worldwide.
