伴随着中国社会由传统向现代的转变,法制的转型、变革的过程也就是法制现代化的过程.社会不断的现代化,法律制度也随之完成了其自身的现代性转型."情理法"既是一种传统,也是一种惯性力量,在"乡土社会"与国家制定法一道规范、调整着人与人之间的关系;法理与亲情将在同一个场域之下,相互追求讨价还价式的利益分配.

英语交际教学法初探

交际教学法的提出为英语教学提供了广泛的研究空间,其核心内容是"以学习者为中心"的教学理念.简言之,就是确立学生在英语教学过程中的主体地位,激发并调动学生实际应用语言的积极性和主动性.培养并提高学生的语言综合能力应从交际法的理论根源、社会基础和理论基点出发,对交际教学法在英语教学中的重要性及英语教师角色的转换进行初步探讨.     

论现代环境法面临的若干新问题——以美国环境法为视角

人们因环境危险而产生的心理上恐惧、因有毒物质引发的染色体变异和新兴技术对人类未来产生的不确定影响三个方面的问题给现代环境法提出新的挑战。心理上恐惧被美国环境法所忽视,这缺乏相应的法理基础,也与其他相关法律领域对精神损害的处理方式不一致。对染色体变异本身是否构成损害以及是否构成损害的危险各方争论不一,还未形成一致的结论。对新兴技术的不确定性,美国环境法采取的应对措施通常是不作为。     

论我国对商标平行进口规制的完善

我国是一个发展中国家,因此在制定规制平行进口的法律时应当坚持两个平衡:一是商标权人、平行进口商以及消费者之间的平衡,另一个是保护商标权与促进自由贸易之间的平衡。基于这两个平衡,我国关于平行进口的法律不能绝对地坚持地域性原则或权利国际穷竭原则,而应坚持部分地域性原则与权利有限国际穷竭原则相结合,即原则上允许平行进口,同时借鉴美国的“实质性差异”原则,例外情况下禁止平行进口。     

Can you keep a secret? Introducing the RT-based Concealed Information Test to children

The present study validates a novel version of the Reaction time-based Concealed Information Test (RT-CIT) adapted for young children (7–10 years). Their ability to deny the possession of relevant information was related to individual differences in intelligence, processing speed, executive functioning and affective problems. The comparison between the knowledgeable group of children (N = 84) who took part in a mock surprise scenario and the unknowledgeable group (N = 78) indicated that by early school-age the RT-CIT can be considered a relatively reliable diagnostic tool for detecting concealed information. We found evidence indicating that executive functions are predictors of children's proficiency in concealing information; however, the specific interrelations were complex (children with lower inhibition and spatial working memory, but with better shifting performance were easier to detect as possessing concealed information). Finally, we found limited evidence for a substantial association between parent-reported emotional problems and children's proficiency in concealing information. This investigation has practical implications for the development of rigorous protocols to detect children's concealed knowledge within legal environments.     

论定罪量刑中的法官情感

情感是人对客观事物的态度体验及相应的行为反应 ,情感对认知活动具有重要意义。笔者认为 ,定罪量刑是一种认知活动 ,在该活动中不可避免地搀杂着法官的情感因素。情感在法官定罪量刑过程中具有双重功能 :一方面可能使刑事判决具有合理性 ,能够较好地实现刑法公正 ;另一方面可能使刑法判决失去理性 ,从而导致刑法公正丧失。在定罪量刑过程中排除法官情感对定罪量刑的影响是不现实的 ,也是不必要的。我们所要做的 ,是把法官情感控制在一定的合理状态 ,其方式有两种 :一是自我调整 ,二是制度保证。     

外交保护与对日民间索偿

外交保护是指允许一国按照一般国际法对另一国违反国际法使其国民遭受损害的行为要求赔偿的权利。外交保护的行使应符合一定的条件并采取适当的方式。在对日民间索偿问题上适用外交保护是符合国际法规范的,中国政府应考虑适时启动外交保护程序以取得对日民间索偿的理想结果。     

Face to Face with Child Abuse: Towards an Ethics of Listening

This paper is concerned with faces. It is concerned with the face of a sexually abused seven years old child -- with my face -- and with the marginalisation and violation of children’s own subjective experiences of abuse by the law. Drawing upon my own subjective experience of sexual abuse as a young child, silenced for twenty-five years, I interpret my own sexual abuse as a profound experience of ‘homelessness’. To be homeless is to lack a primal place in the world, to be in a permanent state of disorientation, to be displaced. To be homeless is not necessarily to be emotionally insecure, but to be voiceless. Accordingly, the subject of sexual abuse is an emotionally dislocated subject and I interpret my own abuse in terms of an enduring experience of the violation of place. In other words, I would argue that the physical act of sexual abuse is less important than the site or place of abuse. The significance of sexual abuse is that it reveals the homelessness of our own sojourn and the poverty of our own subjectivity. Given this interpretation, I find the 1989 UN Convention on the Rights of the Child problematic and I attempt to think child sexual abuse in ethical terms. Following Emmanuel Levinas, I present sexual abuse in terms of the ethical significance of the face-to-face relationship and I argue that rights-based advocacy must listen to what children say. It must think through what listening to that voice entails in ethical terms. This revised version was published online in July 2006 with corrections to the Cover Date.     

Political Trust,Emotional Contagion and Policy Implementation Performance

The problem of policy implementation“blockings” is a hot and difficult issue for political and social psychology research area in recent years. Based on Theory of Planned Behavior and Affective Event Theroy, the authors propose the hypotheses between political trust and policy implementation performance with the consideration of the moderator effect of emotional contagion, and test them based on 162 valid questionnaires. The empirical results show that political trust has a significantly positive effect on policy implementation performance, and emotional contagion plays a partial moderator effect in the relationship between political trust and policy implementation performance.
