De-Europeanisation and Equal Citizenship in Turkey: The Case of Circassians

ABSTRACT

The Europeanisation process in Turkey that extended roughly from 1999 to 2006 boosted the political and cultural rights of diverse ethnic groups in Turkey, including Circassians, and strengthened their claims for equal citizenship. With the loss or weakening of the EU as an anchor for democratic reform in the post-2007 period, however, the de-Europeanisation process has resulted in the disappearance of the main legal and institutional basis for the democratic integration of ethnocultural minorities. Nevertheless, analysis of the activities of four large Circassian communities in Turkey shows that the same process has enhanced the cultural reification of these groups as their survival strategy.     

Parents’ knowledge and attitudes about youths’ interrogation rights

Some states and police agencies require youth to consult with parents before or during interrogation by police, yet these policies rely on the untested assumption that parents themselves are knowledgeable about police interrogation practices and youths’ rights. This study assessed knowledge of, and attitudes about, juvenile interrogations in a sample of parents (N?=?294) recruited from urban locales. On average, parents correctly answered fewer than half of the questions about juvenile interrogation practices; knowledge about parental notification procedures was especially poor. At the same time, parents strongly endorsed youths’ rights to support (including support from parents) during police questioning contexts and only moderately endorsed youths’ decision-making autonomy, even for older youth who are legally adults.     

论宪法平等权的内涵——以平等观念发展为视角

面对近来司法实践中逐渐增加的宪法平等权案件,首先需要对平等进行理论上的反思,表明平等一词内涵的变迁,厘清平等一词的复杂含义,才能在实践上做出是否违反宪法平等权的判断.平等一词在当代与自由之间具有辩证的关系,并与人之尊严紧密联系在一起.     

A Catathymic Infanticide

Abstract: A case of infanticide committed by a 37‐year‐old married man, the father of three sons, is reported. Clinically depressed since adolescence, and also diagnosed with obsessive‐compulsive disorder and a dependent personality, the subject began to worry about killing someone a decade before the homicide. Increasingly disabled by his major depression, unable to work, and confined in his home, the idea that his only recourse was to kill one of his sons became fixed and frequent. Following his fourth psychiatric hospitalization, he took his 13‐month‐old son home from day care and drowned him in the bathtub. He then called the police and reported his crime. This sudden act of intentional killing was followed by a period of emotional relief and calmness, clearly illustrating the three stages of chronic catathymic homicide.     

我国反就业歧视法律规控研究

就业歧视现象在我国普遍存在,而反就业歧视法制相当落后。就业歧视的本质特征是没有正当理由的差别对待,法律禁止就业歧视的主要目的是保障平等就业权并实现社会正义。在市场化就业背景下,反就业歧视必须正确处理用工自主权与平等就业权这对“轴心”权利的相互关系。我国应当以正面赋予劳动者平等就业权作为反就业歧视的权利基础,以准确界定就业歧视作为反就业歧视的中心任务,从立法、执法和司法三个层面逐步建立健全我国反就业歧视的法律规控体系。     

福德汉姆的后荣格分析心理学

米歇尔·福德汉姆是20世纪英国杰出的心理治疗家、后荣格学者中发展流派的主要创始人之一。他以荣格集体潜意识的心灵模型为基础开展临床实践和理论思考,借鉴了当代精神分析特别是克莱因的客体关系理论,填补了分析心理学的不足。在很大程度上使分析心理学淡化了其现代神话的色彩,而增添了很多现代科学的色彩。福德汉姆对分析心理学的理论和实践的发展,既有积极贡献,也存在一定局限。

心理现场与物质现场的关系,诚然有一种反映与被反映的关系。但是,需要辨析“反映性”和“反应性”两个不同的概念,以及它们相互之间的联系。心理现场的物质支点是心理痕迹,它是以记忆痕迹为基础的物质痕迹之转换。犯罪心理现场区别于犯罪物质现场,有其自身的基本特点,把握了这些特点,就能更加自觉而有效地在案侦中重建犯罪心理现场。而犯罪心理现场运用的特点,需要辩明心理现场的重现与重建,如何提取犯罪心理痕迹,心理现场在犯罪重建中的运用等问题。     

论犯罪心理的不确定性

不确定性总是与偶然性、复杂性、模糊性、相对性等概念联系在一起的。犯罪心理具有不确定性,个体犯罪心理的发生在事先是不能唯一确定的,这是由客观环境的复杂性、主体心理的复杂性和主、客观互动的复杂性所决定的。在不确定性视野下需要对犯罪心理概念进行再解读。不确定性给犯罪心理学带来了挑战。
