著作权正当性的危机与出路

在著作权利益集团主导的著作权体制下,著作权成为直接控制消费者的工具以及创作自由与网络技术发展的障碍,从而造成著作权侵权成为一种常态社会现象的危机。只有坚持每一种新生的著作权客体与权利都经过充分的正当性论证、构建以维护创作自由与网络技术发展以及不以消费者为直接控制对象的权利与权利限制制度,才能使已经发生或正在发生的对著作权正当性的偏离得到回归。     

现代性情境下青少年和谐人格建构探析

随着物质生产的高速发展,现代社会出现了明显物化、异化,表现出普遍的社会精神文化病态。西方马克思主义对发达资本主义社会的批判,对于正在迅速实现现代化的中国有一定借鉴意义,中国必须避免重走西方老路,主动避免现代社会病,着力抵消市场经济的负面影响,努力健全社会制度,将人的精神文化生活提升为社会改革的首要目标,为青少年以至全民的健全健康人格的养成创造良好条件。     

自我救赎与伦理情怀——《布朗德》中的道德困境与伦理选择

作为一部伦理悲剧,《布朗德》围绕着“母亲抱憾西归”、“幼儿患病夭折”、“妻子绝望自杀”和“悬崖葬身雪山”的剧情而展开,其悲剧的根源在于他淡薄的伦理意识、偏执的自我中心,以及空泛的道德说教、伪善的道德行为,不切实际地追求“全有或全无”的宗教事业,逐步失去了对自己的控制从而多次做出错误的伦理选择,因而走向毁灭。文章以文学伦理学批评为研究视角,关注作为牧师的布朗德同时为“人子”、为“人父”、为“人夫”的多重伦理身份及其感情纠葛,探讨布朗德所遭遇的道德困境及其颇有争议的伦理选择。作家一方面以外部聚焦的叙述方式关注布朗德的道德行为及其布朗德周边人们对布朗德的道德评价,另一方面以内视聚焦关注着布朗德自我赎罪的心路历程。剧本围绕着布朗德的家庭、婚姻、亲情和事业等伦理关系而展开,由此讨论所引发的关于责任、义务、使命、孝顺、仁爱、仁慈、信仰、死亡、恐惧、绝望、自责、自杀、负罪、救赎等伦理命题,透视了戏剧人物的生命历程中对道德力量的渴望以及以死赎罪的自我诉求,体现了作者易卜生对于人类理想道德法则的追求与向往。     

空间美学的理论生成与合法性建构

美学作为一门系统研究主体“感性之学”的学科形态,其获得自身的场域伦理和知识体系是一项重要的现代性事件,从维柯的“诗性思维”理论到鲍姆嘉通对美学学科的界定,都体现出主体感性能力对美学合法性存在价值的承担。与此同时,主体对“空间”的诗性审美能力是先验存在的,并成为主体感性能力的重要组成部分。所以,美学、感性和空间三者便相互融合,生发出崭新的“空间美学”话语。在前现代时期,主体对空间审美的朴素认知构成空间美学的理论萌芽;现代美学的“感性革命”清晰地凸显出主体与空间之间的诗性伦理,比如海德格尔的“空间栖居”和梅洛 庞蒂的“视知觉空间”便进一步延展空间美学的理论脉络;现代文学的空间审美实践和话语流变再次推动空间美学的场域自律,并最终形成既关注主体生存,又充满文化批判的现代美学形态。空间美学将持续给未来美学的发展提供有益的知识学资源和价值承担。     

中国当代美学与文论的原创研究笔谈(专题研究)

虽然原创研究应该是以创造当代中国原理、概念、范畴为目标,但就原创是一个古代和中国现代文论很少涉及的话题以及将原创的努力作为一个积累而逐步深化的过程而言,以下八位学者从不同的视角为理论原创问题的研究贡献了彼此独立而又相关联的思考：袁济喜、姚文放分别就原创的中国传统文化资源做了挖掘;刘顺利、韩德民通过姚永朴、宗白华对中国现代文论和美学的资源做了新的阐发;张锡坤则致力于中西方文论的打通;张伟 则致力于美学原创的综合方法的思考;何平就原创如何应对当下的文学批评问题发表了看法;张震则就文学性问题初步展开了个人化的理解与建构。     

Visions of Tsafendas: Literary Biography and the Limits of “Research”

Abstract

Research seminar, research cluster, research output. The word is almost a fetish within the contemporary academy—but what does “research” actually mean in a discipline like literature? And what happens when a research project overspills its bounds, or pushes up against disciplinary limits and protocols? In this piece, I explore such questions via the figure of Demetrios Tsafendas, the "mad Greek" who assassinated apartheid Prime Minister Hendrik Verwoerd in 1966, supposedly acting on instructions from a tapeworm inside him. It is one of the strangest facts in South African history; it is also, of course, a kind of fiction, and one that has been refracted into a range of literary and artistic works. Reading across both official and “creative” archives, I address a range of methodological problems that I encountered in attempting an academic treatment of Tsafendas and his (as the presiding apartheid judge put it) “useless life”.     

The Impact of Ethical Leadership on Police Officers’ Code of Silence and Integrity: Results from the Turkish National Police

This study aims to investigate the perceived seriousness of integrity violations and the impact of ethical leadership on integrity and the code of silence by using structural equation modeling. The results suggested that integrity violations are regarded by Turkish officers as serious offenses, as they are perceived by their colleagues in other countries. The study also revealed the existence of the code of silence among police officers. Finally, it suggested that leadership positively affects the integrity of police officers and has a significant effect on breaking the code of silence in Turkey. Based on the findings, policy implications were discussed.     

是“本土化”问题还是“主体性”问题?——兼谈“民国机制”与中国现代文学研究

近年来,在反思"全球化"理论的过程中,"本土化"问题的提出确实带给了我们重新认识现代文学自身的机会。但是,由于"本土化"理论模式"化"他者理论为己用的先天缺乏研究者"主体性"的缺陷,使得"本土化"理论在面对什么是新文学真正的中国特质这样根本性的问题时显得乏力,而"民国文学机制"问题的提出,刚好弥补了"本土化"理论的缺陷,以突出历史情境为切入口,强调研究者的"主体性",为塑造中国自己的文学研究思维打开了一扇窗。     

Vectors of traumatic memories and mass-mediated representations of the ‘last’ Nazi trial of John Demjanjuk

This is an ideological critique of key vectors of memory that could have circulated during the Munich trial of John Demjanjuk. While many members of the mainstream press applauded the efforts of German prosecutors who seemed to be dispensing belated justice to Europe’s ‘second generation,’ the circulation of these select legal vectors left us truncated World War II histories. Moreover, the binary choices that were posed stood in the way of more comprehensive and nuanced studies of Stalinism, Nazi and collaborator culpability.     

Aftereffects of Knowledge: Dogmatic Retreats and Sceptical Adventures

Abstract

A distinction between nature and culture is usually thought to be a condition of possibility of criticism. The idea is that, in comparison to natural laws, norms and conventions are merely relative and, therefore, susceptible to criticism and change. This paper contests this view and argues that critical practice is still possible, and even more productive, when nature and culture are seen to be continuous with one another. A general contrast is developed between ‘dogmatic’ and ‘sceptical’ modes of criticism. The suggestion is that theorists as diverse as Jürgen Habermas and Judith Butler adopt the dogmatic approach. An alternative, sceptical critical mode is elaborated in connection with Nietzsche and the ancient sceptics. This sceptical approach is based upon an identity between nature and culture, and has affinities with the aesthetic emphasis of some contemporary political theory.
