实然与应然——法律伦理之可能

法律伦理及法律伦理学是否可能取决于从法律伦理行为事实能否推导出法律伦理行为应该。然而,单纯从行为事实是推不出行为应该的,只有通过法律目的判断以及法律伦理行为事实和法律目的之关系判断才能从法律伦理行为事实如何推导出法律伦理行为应该如何。法律伦理行为之应该经由人们的实践活动可以变为现实,其具体保障在于法律伦理良心、法律伦理名誉及底线法律伦理的法律化。     

党建价值目标的伦理建构

党建价值目标的伦理建构，要体现以人为本的核心立场，把促进人的全面发展，实现好、维护好、发展好最广大人民的根本利益作为党的建设的出发点和落脚点。基于党的建设实践路径，应把观念创新作为党建价值目标伦理建构的先导工程，从人民利益出发，在“民生”与“民富”、“民智”与“民强”、“民安”与“民享”协调发展中，彰显党的执政品格，体现党推进发展的根本目的。     

Die Tugend des Staatsmanns. Eine pragmatische Dimension in Kants politischer Philosophie

Der vorliegende Artikel sucht die Dimension konkreter Politik in Kants Philosophie und fragt anhand des Verhältnisses von Staatsoberhaupt und Untertan danach, wann eine Republik mehr ist als nur ein Wort auf einem Blatt Papier. Hierzu wird das Verhältnis zwischen Kants Ethik und seiner Pädagogik heranzuziehen sein. Weder kann die Lösung allein durch die Individualethik erbracht werden, noch befriedigt allein eine geschichtsphilosophische Hoffnung. Denn dadurch wird das Selbstdenken als zentrale Forderung der Aufklärung konterkarriert. Die realhistorischen Ereignisse in Frankreich und ihre systematische Erläuterung durch Kant weisen auf dasselbe Problem hin, wenn er die Abschaffung der Adelselite befürwortet. Die Institution des Adels genügt nämlich ebenfalls nicht dem Kriterium der Menschenrechte. Daraus ergibt sich für die Republikanisierung, damit sie für den Untertan nachvollziehbar wird, die Bildung eines politischen Bewusstseins. Hierzu antizipiert Kant dasjenige, was heute unter dem Begriff des Sozialkapitals diskutiert wird.

改革开放以来,以经济建设为中心的发展理念在一些领导干部思想中变成了单一的经济增长的发展理念,发展偏离了"人本"的本质,逐渐演变为排他的发展,冷酷的发展,缺乏伦理的畸形发展。因此,重建领导发展伦理,使发展回归"正统"已迫在眉睫。"包容性发展"理念为领导伦理的重建指明了方向。     

The Ethical Irrationality of the World: Weber and Hindu Ethics

Abstract

This paper argues that Weber ought to be read as a comparative ethicist who brings his German intellectual inheritance, especially Schopenauer and Nietzsche, to a dialogue with ethical traditions in India and China. It shows that Weber not only had a supple understanding of the tensions within Hindu ethics, his own account of value often closely corresponds to Hindu axiology and was enriched by an encounter with it.

我国公务员考核制度存在的问题及对策

《中华人民共和国公务员法》中公务员的考核制度存在诸多问题:比如考核标准过于笼统;没有解决考核内容,缺乏针对性;激励不显著;考核打乱了组织中的权责配置关系等。只有加强平时考核的力度,建立以绩效为核心的定期考核指标体系,加强考核工作的监督,公务员考核制度才可能得到进一步完善。     

Germany: public affairs reinvented

Reunification, growing international exposure and the move of the capital from Bonn to Berlin are not merely milestones for the major changes that have occurred in German politics since World War II. They are developments that have profoundly affected and continue to affect political life in Germany. The way that political, civic and economic interests engage with the political system has changed, and this raises the question of what public affairs is and can achieve in this context. As practitioner the author observes four main trends. First, public affairs is increasingly being understood in terms of the meaning of the German word ‘Gesellschaftspolitik’. Second, the changing nature of how political issues are being communicated demands a growing expertise from all the players involved. Third, the general feeling among organisations for ‘need to do something political’ does not yet correspond with a specific demand for public affairs services. And last, a market for high profile consultancy‐led public affairs services is still in the making. Public affairs practitioners in Germany will be key in shaping and developing the profile of public affairs as a serious discipline with services and expertise, maturely tailored to local market needs.
