试论干部培训院校教师考核评价机制创新

随着教师聘任制改革的不断深入，原有的考核评价机制已不适应新形势、新制度的要求，因而如何建构与创新干部培训院校教师考核评价机制的问题日益凸显。干部培训院校教师考核评价机制的创新，只有认真抓好制定科学规范的考核流程，科学构建教师的考评指标体系，进一步完善平时考核办法，以及建立、健全绩效考评结果的反馈制度等四个环节，才能做到使教师的考謦、评价更加准确、科学和客观。     

民众评价活动中的误导、悖论和言论自由

民众评价活动在众多个体评价活动的传播互动中形成。其"无机方式"使得它容易被民众领袖和权威机构误导,由此就产生了悖论。言论自由是解决这一悖论的重要途径。可以从哲学的自由角度和政治学的民主角度来理解言论自由的涵义。不同涵义的言论自由对于悖论解决的意义不一样,它们相互补充。要在政治文明建设中促进民众评价活动中的言论自由。

高校校园文化活动作为高校校园文化建设的重要方面，其组织工作的好坏直接关系到活动的成效。校园文化活动组织工作有效性的途径有：校园文化建设氛围的创设、活动的具体实施以及评价体系的导向作用等。     

完善刑事执行程序若干问题的探析

随着依法治国和司法体制改革进程的深入发展，现行《刑事诉讼法》在司法实践中发挥了积极作用。但基于社会形势与刑事政策的变革，司法实践中积累的新经验、国际刑事司法交流协作发展的新趋势等，对现行《刑事诉讼法》也提出了新挑战。尤其是“执行”程序的立法空白、不足、冲突等体制性“硬伤”，从立法层面上造成诉讼实践中执行程序与其他诉讼程序的不对称，彰显法律支撑不足，以致司法层面出现“重审判、轻执行”，“重惩罚、轻改造”等不良现象。因此，亟待通过立法修订，进一步完善有关执行程序的法律规范，提高诉讼效益，实现诉讼目的。     

加强政协民主监督 推进干部执行力建设

执行力是政府工作的生命力。当前,干部执行力不强,直接影响到组织决策和目标的实现,党和国家政策的落实,关系到党的事业的成效。民主监督是政协的基本职债,政协对干部执行力的监督是题中之义。要加强政协的民主监督,推进干部执行力的建设。     

Constitutional Barriers as Limitations to State Activity

The study deals with constitutional constraints and examines which constitutional limits or barriers set by ordinary law are effective against too much public policy. Are these limits useful to block the level and the growth of expenditures, taxation and public debt? Starting points of the analysis are historical considerations on past experiences with constitutional constraints. In a second step a typology of constitutional and legislative barriers will be presented and discussed. These barriers can be distinguished between quantitative and procedural constraints. Empirical findings for different countries as well as for the European Union will be presented. Finally, empirical results will be derived from a pooled cross sectional regression, where several factors are regressed on the annual deficit. It turns out that limits on taxation and expenditure limitations (TEL) as well as limits on public debt have pros and cons. These will be assessed on the basis of the empirical findings. A clear result of the comparative research points to the efficiency in blocking public policy, i.e. spending, taxation and the public debt. This entails that the main target of such rules is usually achieved.     

The Executive and the Constitutional Reforms Process in Sri Lanka

ABSTRACT

The debate on whether the executive presidential system which was introduced to Sri Lanka in 1978 should be retained, reformed or abolished is not a new one. It is a topic which is central to constitutional reformation in Sri Lanka, but one which always carries the potential of either making or breaking any attempt made at reforming the Constitution. This article examines the character of the post of executive president in Sri Lanka and how the most recent constitutional reforms process (initiated in 2015–2016) has sought to engage with the topic of executive presidency. Departing from the more popular trend of unconditionally critiquing the executive presidency, this article calls for a more realistic and dispassionate assessment of not only the possibility of abolishing the executive presidency but also of the viability of a prime ministerial system in Sri Lanka.     

Routine Activity Theory and Sexual Deviance Among Male College Students

Much research on sexual deviance on university and college campuses is limited by its narrow focus on group affiliation. In this study, it is argued that prior deviance and opportunity serve as more robust predictor variables of sexual deviance. Using a sample of 304 male college students from four universities within the Ohio Valley Conference, this paper utilizes Analytic moment structures (AMOS) analyses to examine the relationship between prior deviance and sexual deviance. Results support the assumption that sexual aggression is significantly (β=.17) mediated or accounted for by opportunity. Overall, the relationships among variables lend support to the argument that alternative explanations of sexual deviance may provide a better understanding of such a complex societal problem.

政府执行力与行政文化的隐性链接

“执行力”是衡量一个政府管理能力的重要指标。执行力的强弱关系到一个政府管理效率的强弱。如果缺乏强有力的执行效力,政府的公共政策和战略决策只能是无本之木、无源之水。加强政府执行力可以从多重角度考虑,尤其要注意到行政文化对政府执行力的潜在影响。从行政文化的角度出发,创建“执行力文化”,是提高政府执行效力的良好途径。     

论问题的认识论意义

问题是由人们提出的需要解决而尚未解决的任务。问题在本质上是主观与客观的矛盾,或人与世界的矛盾。问题具有社会性、时代性和"为我"的主体性。问题是人类特有的反映形式,只有人才有问题,问题也只是人的问题。问题以系统的形式存在,不同的问题系统构成了人类不同的认识—实践领域。问题是联结主体与客体、主观与客观的中介环节,是从已知到未知的桥梁,也是人类文明进步的动力。人类的认识—实践就是不断提出问题与解决问题的过程。
