More Female Judges: An Important Way to Adopt Gender Perspective in Judicial Process

As the proverb goes, “There is no right without a remedy”. In order to provide complete protection for women, it is important that the court which has the power to grant remedies adopt a gender perspective in its decision making. Measures like discipline and training turn out to be fruitless to promote the adoption because of their inability to insert a female perspective in male judges, while appointing more female judges proves to be fruitful. Female judges do have different experiences from their male counterparts; hence they have a deep understanding of the plight and demand of women, which will affect the way they address the problems that confront them, both substantive and procedural. In a word, females bring to judging a unique perspective which can better protect women’s rights; thus the appointment of more female judges ought to be adopted as an important social policy.

Personality features of an adolescent female offending population

The incidence of adolescent offending has been shown to be different for young males and females. However, there is a lack of literature concerning adolescent female offenders, and despite research suggesting that personality factors may be linked with antisocial and criminal behaviour in adolescents and young adults; there have been a lack of studies investigating intra-sex personality differences in young female populations. The Millon Adolescent Clinical Inventory, a 160-item self-report personality measure, was administered to 26 non-offending and 28 offending adolescent females. It was found that the offending group was significantly less submissive, less conforming, more forceful, more oppositional and more likely to exhibit borderline personality traits than the control group. The offending group also had higher reported incidences of childhood abuse and family conflict, and were more prone to substance abuse, impulsive actions and suicide ideation. These initial findings suggest that personality differences may well exist between offending and non-offending adolescent females.     

Global War on Girls? Policing Girls’ Sexuality and Criminalizing Their Victimization

This article briefly explores the disconnect between the global discourse on girls’ issues, which really focuses on girls’ rights, and most particularly their right to be free from victimization, and the American focus on girls, which is far more concerned with bad or violent girls. Specifically, the article reviews the increase in girls’ arrests in the United States for offenses like simple assault and the concomitant increase in girls’ share of juvenile court populations. Arguing that the maltreatment of girls is at the heart of such a shift, the article reviews current data on the prominence of cross-over or dual status youth (youth who have experienced both victimization and criminalization) in the female court population. Presenting evidence that the failure to protect American girls from harm is related to these patterns, the article concludes with a gender-responsive program that focuses on reducing harm to girls so as to prevent their future delinquency.

家庭暴力问题是当前社会的热点问题。家庭暴力中的女性犯罪更是值得关注的问题。湖南省 1997年至 2 0 0 0年女性家庭暴力犯罪人数呈上升趋势 ,犯罪手段残忍 ,性质恶劣 ,女性化特征明显。犯罪动因复杂 ,夫妻感情不和、家庭经济纠纷、生活琐事、第三者插足等等因素交织在一起。她们的犯罪 ,对社会造成了严重的危害 ,给亲人带来了心灵上无法愈合的创伤。女性家庭暴力犯罪应该引起全社会的高度重视
