Study on the standard components of digital forensics laboratory

Recently, digital forensics has become increasingly important as it is used by investigation agencies, corporate, and private sector. To supplement the limitations of evidence capacity and be recognized in court, it is essential to establish an environment that ensures the integrity of the entire process ranging from collecting and analyzing to submitting digital evidence to court. In this study, common elements were extracted by comparing and analyzing ISO/IEC 17025, 27001 standards and Interpol and Council of Europe (CoE) guidelines to derive the necessary components for building a digital forensic laboratory. Subsequently, based on 21 digital forensic experts in the field, Delphi survey and verifications were conducted in three rounds. As a result, 40 components from seven areas were derived. The research results are based on the establishment, operation, management, and authentication of a digital forensics laboratory suitable for the domestic environment, with added credibility through collection of the opinions of 21 experts in the field of digital forensics in Korea. This study can be referred to in establishing digital forensic laboratories in national, public, and private digital forensic organizations as well as for employing as competency measurement criteria in courts to evaluate the reliability of the analysis results.     

略论处理突发事件的方法和艺术

在现阶段,正确处理突发事件是领导工作面临的一项重要课题。本联系领导工作的实际,从马克思主义哲学的高度,对突发事件产生的原因、突发事件的特点以及处理突发事件一般方法和艺术等问题进行了分析,试图大体勾画一个处理突发事件的方法论框架。     

执法办案风险评估预警工作的困境与对策研究

上海检察机关自2011年开展执法办案风险评估预警工作。从风险评估、风险预警、风险处置三个方面对该项工作的现状作出分析,对实践中存在的困境进行研究,并提出相应的对策。     

边境民族地区群体性械斗事件的特点及处置对策

边境民族地区群体性械斗事件原因复杂,械斗双方法律意识淡薄,械斗后果严重,后期容易反弹。公安边防部队应快速机动,运用防暴战术,坚决果断处置,尽量减少伤亡。处置结束后,要积极协助地方政府做好善后工作,防止反弹,妥善处理该类事件,维护边境地区的安全稳定和民族团结。     

论起诉替代措施在我国的应用及其不足与完善

起诉替代措施是在起诉便宜主义范畴下讨论的概念和制度,是起诉便宜主义的主要体现和应有之义。起诉替代措施的运用不仅有利于保护被追诉者的人权和预防犯罪、保护被害人的合法权益;而且有利于节约司法资源、提高刑事诉讼效率;同时,由于其能较彻底的化解纠纷和解决社会冲突,因而对于当前和谐社会的构建也有一定的现实意义。当前世界大多数国家都有起诉替代措施的实践,在我国的立法及司法实践中,也存在着起诉替代措施,如酌定不起诉、公诉机关非刑罚处理方法和暂缓起诉等,但我国在这方面的做法尚显不足,应加以完善,以彰显起诉替代措施之价值。     

健全与完善信访机制是科学发展的需要

信访是政府沟通公民的一条特殊渠道,是公民参与政治,寻求司法和行政救济的有效通道。健全完善的信访机制,对更好地落实和实践科学发展观构建和谐社会具有积极作用。为更好地发挥信访的功能和作用,规范信访程序和完善信访机制就显得成为必要。     

“捕诉合一”视域下侦查监督的路径偏差与改革回归

检察机关监督侦查活动是防范侦查权滥用、推进公正司法的重要制度安排,捕诉一体化办案模式的推行影响着检察机关法律监督职能的发挥,加强了检察院对于侦查活动的监督效力。但是,新办案模式下侦查监督或多或少存在一些运行偏差。为了解决这些问题,我们需要在"捕诉合一"视域下,通过平衡检察机关办案节奏、推广智能化监督方式、落实司法责任制以及探索建立侦查监督"案件化"办理模式等措施,实现新形势下侦查监督的改革回归。     

运用计算机处理签名字迹与捺印指纹图像

Photoshop图像处理应用软件，通过替换颜色、复制通道等方法，能够有效地分离各种彩色图形，能够从签名字迹与捺印指纹的混合图像中分别提取签名字迹和捺印指纹。     

Flexible enforcement and fine adjustment

This paper considers the level of, and changes in, optimal noncompliance penalties under the following conditions: (i) where the regulator responsible for setting policy parameters, such as a penalty, is different from (and thus may have a different objective from) the regulator responsible for enforcing existing regulations; and (ii) where enforcement behavior changes from one in which enforcers are unresponsive to overtures on the part of firms to increase compliance to one in which enforcers are responsive to such overtures. The model developed shows that when enforcers “switch” from unresponsive to responsive enforcement, the optimal penalties for noncompliance need to be reduced. The analysis also gives insights as to what variables dictate the degree of penalty reduction.
